You see, being a Police Officer is a job on a salary. It is a community need to have Police Officers. They are there to keep public order and to enforce the rules. Now, being a singer in a progressive rock band means that you are one of many in a crowded marketplace. There is no salary and no guaranteed income. Everyone needs to make a living, however you need to be in the industry for the music first. Money comes a distant second.

Simply economics 101 dictates, when there is unlimited supply of a similar product, demand is low. When supply is limited, demand is high. At this point in time, there is a lot of new music coming out everyday.

So what are the fans going to latch onto?

We don’t know, there is just too much noise, so we wait. Meanwhile that act is percolating, spreading slowly from city to city, country to country. But that takes time. In some cases, a lot of time.

So, it’s time to bust a myth.

Being in a band is a financial struggle.

Being in a band with a label behind you is also a financial struggle, unless you are in the one percent of acts that cross over. The label will give you an advance that they will need to recoup from sales, touring, etc. However if you are in a band and you have an audience that cares, you can monetize that audience so that life is not a financial struggle.

In today’s market, the audience needs to go and find you. The hype and marketing of the past doesn’t work anymore.

TesseracT is a good band who are good musicians and songwriters. However, the big money-oriented labels find these kinds of acts no longer acceptable, unless they start making millions on an indie label.

It’s just a shame that so many fall by the wayside because there’s just too much saturation. It’s always been that way. There’s plenty of good music, it’s just in different places than the equivalent of what being on the radio used to be.

Being an artist means that you have to work for free and if you have worked for free and have built up an audience, then it’s up to you to monetize them. Normally, the record label would enter at this point in time. However, the myth of the label as the hero is greatly exaggerated. I remember the transitional period in the early 80s after MTV broke and made everyone a star and music become a sales driven vehicle.

Look at Protest The Hero. They had a label deal. They sold decently. They had decent film clips. They toured a lot. Then the sales dried up. By the end of it, they had no label and no money. They could have packed it in and done something different.

So what did they do?

They went to their fans to see if anyone cared. They set a target of $125K. They got a lot of hate in the process. Days after launching Indiegogo, they broke past their target. The fans cared.

Just this week, I got an email from Protest about another campaign, a subscription based service. I signed up straight away for the $25 package. Imagine they get the same 10,000 people signing up. You do the math.

Coheed and Cambria broke away from the label’s and went DIY for “The Afterman” releases. Claude got creative with the release package for the double album release and offered up an excellent Super Deluxe package at $70.

And they get opening week sales of 49,500. Assuming those sales are a mixture of Super Deluxe and Normal releases, the gross return is still pretty impressive. Then they had second week sales of 10,200. Third week sales of 4,000. Fourth week sales of 2,800. After four weeks, the band had moved over 60,000 units of the “Ascension” album. Then they went on a year-long victory lap around the world. During that tour, “Descension” comes out, three months after “Ascension” and it moves 40,600 units.

Again, you do the math on gross sales.

It’s hard making money in music, there is no doubt about it, but so is every business enterprise. There is no guarantee that every start-up will succeed, and it’s the same deal for artists. But history has taught us one thing. The artists that stick it out, percolating on the fringes, do end up crossing over. Pink Floyd, Yes, Metallica, Iron Maiden, Def Leppard, Nirvana, Pearl Jam, Nine Inch Nails and Disturbed are just a few acts that come to mind quickly. And then, the sky is the limit.

A Day In The Life – Leaks and Sales with Dream Theater, Avenged Sevenfold, Coheed and Cambria, Five Finger Death Punch, Black Sabbath, Trivium, Stryper and Protest The Hero

In the lead up to the release of any widely sought after album there is one certainty. The album will leak ahead of its official release date.

So in order to circumvent this problem, artists (in conjunction with their backers/labels) are organising early stream deals of their new music (a legal way to say “album leak”).

Dream Theater and Roadrunner went all nuclear with their corporate deals for their self-titled album, which had sales on the board for the first 5 weeks and for the last 2 weeks – nothing. Since Roadrunner was cashed up due to the departure of Machine Head and Megadeth, they placed those extra dollars into Dream Theater. Was it a good investment?

Five Finger Death Punch on the other hand are doing it a touch different. They are doing all their pre-release streams, in conjunction with YouTube track by track stories of each song, along with promotional video clips plus live performances.

Avenged Sevenfold added a full live show of the “Hail To The King” album to their pre-album stream promotional campaign.

Trivium’s new album leaked a whole week before the actual pre-release stream of the album (and a full two weeks before their album came out). They kept on dropping songs in their set list’s and they also released full version streams of certain songs.

There is no sure-fire way to prevent leaks, however how an artist reacts is important.

The new Protest The Hero album leaked on Torrent Sites a week before it’s actual release date. So what did Protest The Hero do? They set up a fan connection, that allowed the fans that contributed to the making of the album to download it from a secure site. They made sure that the real fans had music in a high quality rip, along with a 50 page plus digital PDF and artwork. Then when they realised that ending of the song “Mist” was cut short in the download that they offered, they rectified it, by offering the song as a stand alone download.

Anyone who tries to stop a record from leaking is going against the way of the world.

The focus for the artist is to give the fans that legally pre-order an album access to it as soon as they are aware of the leak. This is hard when artists put all of this into the hands of the record label and the record label puts it all in the hands of brick and mortar stores, iTunes or Amazon.

Artists like Coheed and Cambria (via their http://modlife.com/coheedandcambria) website have a huge advantage over bands that continue to be ignorant as to who their fans are and in what cities their fans reside.

Protest The Hero now has a list of 8000 plus devotees that they can use to further their cause. They have their addresses, so they have an idea as to what cities and markets to hit. Other successful fan funded campaigners also have this advantage. You see the most important currency in 2013 is data.

As a band you would want to know which fans always order the Super Deluxe packs, which fans download your music, which fans stream your music and which fans purchase CD versions of the album. This is where the bands should be pushing the fans to purchase from their own web stores.

So looking at sales of music today how relevant are they. So many different metrics exist. Streaming, YouTube views, mp3 downloads and physical sales

Let’s look at the sales in the U.S of Dream Theater (by the way all sales figures are quoted from the excellent http://www.metalinsider.net website.

The above is a familiar cycle for Dream Theater with each album cycle. The numbers you could say have been pretty close with each album release since “Systematic Chaos.”

So is the new album a dud. From a record label point of view, I believe so. Roadrunner invested heavily in Dream Theater after they lost Machine Head and Megadeth. Has it paid off for them? I don’t believe so.

From a fan perspective, I don’t mind it, however it wasn’t good enough to take up room on my iPhone. The bizarre part in all of this is the gap between the album release and the tour beginning.

By January 2014, the album is old news. Whoever thought it was a good idea to leave a three-month gap between the album release date and the tour start date should be fired immediately.

Three months in the current music business is an eternity. It looks like Dream Theater is getting some bad advice and to be honest they are shooting themselves in the foot.

Dream Theater need to hit the studio again for December 2013 and release a few more songs as free digital downloads. Maybe even get in some outside assistance in editing the musical pieces into actual songs.

What about Avenged Sevenfold? How are they tracking at the moment?

Looks like Avenged Sevenfold are going to ensure their legacy. Call this album what we will, what is clear is that it is successful. It has high stream counts, high YouTube views and decent sales on the board. They are on the road at the moment supporting it.

Shows are being added into next year. It is obvious that Avenged Sevenfold are getting better advice than Dream Theater is.

With every successful act, the haters come out. A lot of the online news sites are trying to portray this imaginary war between Robb Flynn and Avenged Sevenfold. It is all a load of crap. Online news sites are there to sell advertising. They sell advertising by getting people to bite to the stories. To make up a feud between two different bands is an advertisers dreams.

The Avenged Sevenfold album sold more in week one than Dream Theater’s self-titled album will sell in total. In week 6, the Avenged Sevenfold album sold more than Dream Theater’s self-titled album which was in week 2 of its sale cycle.

What about Five Finger Death Punch? They just released the second part of “The Wrong Side Of Heaven and The Righteous Side Of Hell.” So how is Volume 1 going at the moment.

What can you say about Five Finger Death Punch. All of their releases so far have achieved Gold status in the U.S. They basically have been selling albums since 2007. “American Capitalist” was certified GOLD almost two years after its release and just a few months before the release of “The Wrong Side of Heaven” duology.

The albums have some great songs on there that will make the casual metal fan commit to a purchase and they will be in an enviable position of having two albums selling at the same time.

A recent Revolver cover is showing Black Sabbath along with the comment, “Band Of The Year.” Are they serious? The beauty of mainstream rags. They kiss the butt of the PR company. Five Finger Death Punch is the band of the year. Avenged Sevenfold is the band of the year. Coheed and Cambria is the band of the year. These three bands have done way more than what Black Sabbath have achieved this year. So how did they go with the sales?

A 20 week run of sales is a good thing in today’s terms. Even on Spotify, the following songs have gotten some traction;

Age of Reason – 540,630 streams

What about Trivium? How is another Roadrunner act doing? This is album number six for Trivium and it’s a similar cycle to their previous album “In Waves” and a very similar trend to Dream Theater’s.

Wow, that was a quick spiral out of the public consciousness. Reading the reviews of the album, a lot of people are blasting the Draiman influence on it. But hey people blasted the Bob Rock influence on certain bands as well. The bottom line is that Trivium delivered a great album that no one has really heard.

Protest the Hero was recorded as having a debut week ending 6th November of 8,775 sold and it was the guys best debut of all their albums. Amazing what a little fan funding does. If the guys hold it together, bigger things will come to fruition.

What about Stryper? 2013 has been a huge year for them, with the release of their re-recorded greatest hits album earlier on in the year, along with a new album in November.

Listening to the album, Dave Mustaine was right. Sympathy is the best track on the album.

It’s a tough music market and the aim of each artist is to remain in the public eye. The modern paradigm is here today and gone tomorrow. Robb Flynn gets this. That is why his weekly Journals are important. It is keeping Machine Head in the public eye while they write and record their new album.

Sales are still relevant, however they are not the only metric in which an artist should measure success.

From all of the above, Five Finger Death Punch are doing great numbers however after listening to both Volumes, I easily could have come up with a song list for one album. The remainder of the songs could have been offered as free downloads on a monthly basis, which would always bring attention to the main product, the album. Think about that, they recorded 26 songs for the album. Just say they released 12 songs on an album. The leaves 14 months worth of songs to release and bring further attention to the album and the tour.

“A Day In The Life” is a great song from Volume 2 by the way. It’s melodic, heavy and it has a great vibe happening.

But wait, piracy exists. All of the above music can be downloaded for free. So why are people paying for it. They can even stream it for free. However for some reason people are paying for it. That is what the record labels and the RIAA will never understand. People will do what they want to do.

The Gremlin Day, Generic Metal & Protest The Hero’s “Underbite”

You ever had a gremlin day. I have. You know one of those days when conventional wisdom falls over. One of those days when things that always worked ceased working the same as they always have for no real reason.

It makes you question everything. It makes you feel paranoid and you start to believe that everything you have done up until that point is rubbish.

From my perspective, I work in IT and I have been working on a project since August. We implemented successfully over the weekend, however on Thursday before the weekend implementation I questioned everything and I was about to pull the plug on it.

This is what normally begins to happen when you spend so much time on the one piece of work. This is why Top 40 sounds so bland and processed. Using I.T. speak “the Top 40 has been tested to death.”

The songs go through so many rewrites it’s not funny. That is why you have as many names as “The Last Supper” listed as songwriters of the generic and lifeless Top 40.

However Heavy Metal and Hard Rock music is generally written “in-house”, meaning that most of the material is written within the band. So why are we getting a similar generic output as the Top 40. Why are we getting lifeless and soulless songs that mean nothing and say nothing and to be honest if I heard them live I would probably yawn. The artists that created something great always lived on the edges, merging various influences and styles. However, when one artist sees another artist strike a pot of gold, they follow suit, believing that the same pot of gold would come to them if they replicated what the other artist did.

For example, every band wanted to be like Bon Jovi in 1987 and by 1988 every band wanted to be like Guns N Roses and by 1989 every band wanted to be sober like Motley Crue and by 1991 every band wanted to be Metallica and by 1992 every band started to incorporate grunge influences.

I started thinking about the above, after listening to the song “Underbite” from Protest The Hero and after watching the hilarious puppet clip. The Protest The Hero channel is showing that the clip has had 112,436 views. Not bad for a fan funded band that was told by their record label that are washed up.

Underbite means the projection of the lower teeth beyond the upper teeth. Protest The Hero have taken that term and twisted it up to include the rock n roll show. They are focusing on the generic mediocrity of artists who go out there and fake it. They are focusing on artists and labels that couldn’t care less about the fan experience. They are focusing on artists and labels that care about maintaining the status quo and the profits that came with that.

Jon Bon Jovi is one such artist that comes to mind. Eventually the shows sell out on this tour however for the first time ever, Bon Jovi concert tickets got the reduced treatment on Living Social and other web outlets. If he tours again next year and charges the same high prices, he will be in for a shock.

The Rolling Stones is another.

Motley Crue have gone back to the same marketplace again and again since 2008’s “Saints Of Los Angeles” and with each re-iteration they are getting less and less to the show.

Metallica needs new music to come out. It has been a 5 year victory lap for Death Magnetic and with 2014 approaching, that will make it 6 years.

Black Sabbath is another. Watching Ozzy sing live was a joke and he had the balls to say in interviews that Bill Ward couldn’t perform live because he was old, overweight and he had to use post it notes to remember his drum tracks. Well Ozzy is old, out of key and he never strayed too far from the prompts as he struggled to remember the lyrics.

The song Underbite also focuses on artists who see themselves as gods and their fans as stupid kids who are expected to consume every piece of music they produce regardless if it’s good or not. It has lyrics like “An understanding between you and I that the ground that you stand on is somehow less than mine” and “Now you comprehend our complex relationship—consumer/consumed, You’re just some stupid kid and I’m a megalomaniac.”

The part in the film clip where the fan goes to purchase the merchandise is so spot on. I could relate as it happens to me all the time.

First, the merchandise stand rarely has the size that a person wants. Good luck to all the ones that rush in and get it early and bad luck to the fans who get their later or the fans who just want to purchase merchandise later.

Then the prices are ridiculous. So as the clip shows, you end up forking out a decent amount of cash for a band t-shirt that doesn’t fit or is too large.

I really like the lyrics about “You’re disgracing your effort by conforming to textbook performance of music to fill in the gaps.” This is about going through the same motions and the same dialogue and the same songs day in and day out.

“Let’s not repackage the same old performance, Original content is so much more rewarding.”

While I love Twisted Sister, I don’t agree with the viewpoints put out by them, that there is no need for them to create new music. Dee Snider has mentioned that there is no motivation to write any new songs while Jay Jay French and Mark Mendoza have talked about giving the fans what they want in the live show and how if a new song is played these days from the classic rock bands, the fans see it as a toilet break. While each performance is unique due to Dee Snider’s banter, the songs however don’t stray too far from the first three albums era.

How many times can Iron Maiden revisit their past and repackage past tours as current ones. “Caught Somewhere Back In Time” and “Maiden England” are two that come to mind in the last 4 years. While the “Caught Somewhere Back In Time” tour broke box office records, the “Maiden England” tour not so much.

Their show at the San Manuel Amphitheater, Devore, California on September 13, Iron Maiden got 27,000 fans in a venue that fits 41,000. Megadeth, Anthrax, Testament and Sabaton also appeared on the bill. Of course 27,000 is a massive attendance however the venue is just over 50% full. Iron Maiden needs new content and great content at that.

Listen to the song. There are some hard truths in there and Protest The Hero try to cover them all.

2013 Metal and Rock Releases. Are they Derivative, Evolutionary, Original or Clones?

Artists need to think about their music as a product. In the end we (the fans) are all suckers for good products. Give us a good product and we will reciprocate.

So I am listening to the new Protest The Hero album, “Volition”. What a product it is! For the record, I was one of those fans that contributed to the Indiegogo campaign so you can say that my views are biased.

And what about this for a piece of PR? As soon as they were made aware of a few leaks hitting the internet in bad quality, Protest The Hero hastily arranged a download site for their Indiegogo contributors, sent an email to everyone about it with instructions on how to get their unique download pin and away we went, downloading the album.

The best way to fight piracy is to communicate with your fan base. They are your only concern. In relation to people downloading the album some will come to a show and some will download it and hate it.

So what was my immediate thought on the new album?

Original and evolutionary. This is Protest The Hero continuing on from what they have created in the past by adding a few more bells and whistles. The decision to go the fan funded route was just the beginning. During the recording process they lost a drummer and got an even better drummer in Chris Adler. They then got some friends to build some IT support to store all the data of the fans that contributed via Indiegogo.

So to sum up, Protest The Hero were able to record, mix, master and produce an album without having any record label support and without the need of a record label advance that they would have had to pay back AND they are still able to use the record labels to distribute the standard release worldwide.

Going back to the drumming, what a brilliant job from Chris Adler? It’s inspiring in the sense of “I Want To Break Stuff” inspiring. It just feels very metal like.

While Dream Theater and Korn get a lot of ink in the press, it is bands like Protest The Hero, Machine Head and Digital Summer that are stealing the thunder by reaching out to their fans, connecting and doing it the new way. They are cutting out everyone that gets in the way of them and their fans. It is a band to fan connection. It is a fan to band connection.

On a side note, when I listen to new music from bands, I normally place the music in the following categories;

1. Progress is derivative (to others this is the stolen or copied bucket).

2. Evolutionary (this is bands building on their past a little bit each time. It is the iterative approach)

3. Original (this is something that is so divergent or out there that it hasn’t been done before)

4. Maintenance (this is where the band delivers the same album over and over again)

So looking at my top 20 list of music so far from 2013, in which categories do they fall in.

Progress Is Derivative
Avenged Sevenfold with the “Hail To The King” album.

“Lift Me Up” from Five Finger Death Punch and “Kingmaker” from Megadeth also fit into this category.

Evolutionary

This list has quite a few releases in it.

Protest The Hero leads the way with “Volition”. It builds on all of their previous efforts.

“Vengeance Falls” from Trivium is also an evolutionary album, building on the shorter song structure from “In Waves” with better melodies and technical precise riffage.

The concept album from Black Veil Brides falls into the evolutionary bucket for me. While the overall musical themes of the album are still rooted in the previous releases, there was enough growth to show a band evolving.

Mutiny Within hit the evolutionary path with the release of “Synchronicity” which shows the band moving further away from the metalcore stigma that Roadrunner put on them.

30 Seconds To Mars went all world music on “Love Lust Faith Dreams” which is again an evolution of “This Is War.” My wife loves this album.

Audrey Horne released “Youngblood” which is a further evolution from their previous album, moving more into a blues rock/metal vibe.

The next two albums are debut albums and the reason why I saw them as evolutionary is that the evolve from the sounds of Korn and Genesis/Pink Floyd.

Brian Welch’s solo project, Love and Death released the excellent “Between Here and The Lost” which is an evolution of what Korn was doing prior to Head’s departure. If i had to pick between Korn’s new one and Love and Death, my vote goes to Love and Death.

Sound Of Contact released a sci-fi concept album with “Dimensionaut” that captures the eerie spirit of sci-fi soundtracks merged with Pink Floyd/Genesis and Marillion prog.

Original

I see Volbeat as an original band.

With “Outlaw Gentlemen and Shady Ladies” they merge country with their metal/rockabilly style. This album could have fitted in the evolutionary bucket as well, however in my opinion there is another of a blend of different music styles to class it as another original release.

I just finished reading a post on the Classic Rock Magazine website with Michael Poulsen, the lead singer from Volbeat. In that interview, he states that artists cant make any more money from record sales and that selling records doesn’t put food on the table anymore.

This is strange coming from a band that shifted 300,000 units in the U.S with their previous album. So if you do the math 300,000 at $10 a CD comes to $3MIL gross earnings on the CD. The current album is sitting at about 130,000 units in the U.S so far. So if Volbeat are not getting any money from the sales of recorded music, they should be speaking to their label about re-negotiating their deal.

TesseracT’s “Altered State” to me is a great piece of work. It isn’t just a bunch of songs put together and called an album. This is an album that needs to be listened from start to finish, with high quality headphones. There is so much happening that each listen is a new experience. It’s original to me.

Maintenance

All of these releases are good releases showcasing what the band does best. In a lot of cases, bands produce their greatest album by doing this and in some cases bands produce a few forgettable albums as well.

The lessons here are that bands don’t have to be ground breaking original to be successful. They just need a well thought out approach that is executed well.

Create The Undeniable Song – It Will Sell

I am listening to “Are You Gonna Go My Way” today, the third studio album by American rock musician Lenny Kravitz, released in 1993.

It’s funny that after all this time I still like only 3 songs from the CD, which are “Believe”, “Sister” and “Are You Gonna Go My Way” in that order. There is also a track called “All My Life” that appeared on some bonus CD’s or as a B-side that is also up there. However, to hear all of the songs mentioned, I had to purchase the record label “promotional tool”; the good ol’ expensive CD.

That is why the album went multi-platinum everywhere.

Consumers of music had to purchase 10 to 14 songs, just to hear 4 to 5 songs. Of course we could have purchased the singles, however at $7 a single (that was the price in 1993), why spend $14 on two songs, when for $20 (on sale) or $27 (as a new release) you could buy the album.

I actually purchased the album for the song “Believe”. That is a great song and a dead sit hit in my book. When that lead break cuts in at the end, along with the strings, it’s goose bumps all the way.

The album went Gold (U.S) in May, 1993, three months after its release. By June, 1993, it was certified Platinum (U.S). By January, 1995, it was certified 2x Multi-Platinum. If you look at Kravitz’s most recent certification, it is for a single. How times have changed?

I don’t want to pay for a batch of songs I don’t like anymore. I didn’t used to be this way. I lived for music.

Misguided people think that piracy ruined the recorded business. What they don’t realize is that most people didn’t want the album/CD. People wanted that unique track. When the CD came and the record labels started charging us a fortune for it, albums suddenly became very long.

Instead of getting 35 to 45 minutes of music every year, we started to get 50 to 70 minutes of music every two to three years.

So the recording business saw the large profit margins and just kept on marching along with the overpriced CD’s business model, using MTV to push and promote the artists. So when people got the option to download, to cherry pick what they wanted to hear, a whole new market place was born.

We didn’t have to pay attention to what the major labels pushed on us anymore or any other label for that matter, because we started to have options. Today, we have options galore. That is why there will not be any super stars like there used to be. Competition in the market place diluted the record sales.

When I see artists like Thom Yorke and Nigel Godrich complaining about Spotify, I just shake my head. Thom and Nigel have to be real damn great just to have a little bit more than a tiny audience today. The old paradigm of fans purchasing CD’s that had a lot of filler because very little content was available is over.

To stand out today, artists like Thom and Nigel have got to be incredible. Protest The Hero went via Indiegogo to raise funds for “Volition”. Their goal was $125K and they ended up getting over $341,146 USD from a fan base of 8361 fans. I gave $50. A small audience that was happy to spend money.

The report from the “London School of Economics” called “Copyright & Creation: A Case for Promoting Inclusive Online Sharing” hits the nail on the head. Online piracy is not hurting the music industry. It has put a dent in recorded music sales, however that was inevitable with the shift in technology, the over saturated marketplace and the years of fan abuse by pushing overpriced CD’s. It’s simple economics. There is so much supply and the fans of music demand only what is great.

There is an argument from certain song writers that since people began downloading music without paying, royalties for them have dried up. Some have even had to take full-time jobs. Big deal is what I say. If you are a songwriter, then write more songs and better ones. Copyright was never designed to be a pension fund.

The bottom line is this – if the artist creates that undeniable song, they will have no problems selling it. The song will sell itself. I parted with $27 back in 1993 for the song “Believe.”

Looking at all the certifications around the world from the industry bodies, one thing is certain. The singles are dominating. So all those metal and rock bands spending years and dollars on a long player are doing it wrong.

Even Metallica now, have single Platinum certifications from songs that were released on their first five albums.

The following songs were given a GOLD certification by the RIAA (U.S) on December 13, 2012.

  • Enter Sandman (was also given a Platinum certification for both digital and physical singles)
  • The Day That Never Comes

Five albums are presented in the above list that ranges from 1983 to 2008.

We don’t need new laws to provide better protection for artist copyright. We need artists to create great tracks. We need laws that reduce copyright and puts the focus back on the Public Domain.

We don’t need to encourage internet service providers to make their customers do the right thing. We need to give customers a reason to buy.

If the customers have that reason, then they will buy.

How bad can piracy be? A Case Study involving Protest The Hero, Iron Maiden and Digital Summer.

The MPAA and the RIAA are trying their best to stop all file-sharing services. They still don’t realise that the moment they shut one down through legal action, several more appear in its place. 

The RIAA has shut down Napster, Kazaa and Limewire. The MPAA has gone to the ISP level, first trying to get verdicts that ISP’s facilitate copyright infringement, then trying to get personal information of ISP customers for copyright trolling lawsuits. When that got complicated, they resorted to getting blockades against certain websites. They have even resorted to using law enforcement agencies to shut down “rogue” websites (MegaUpload comes to mind).

So with all the activity going on, has file sharing ceased? Nope. Sharing still happens. 

I just went onto The Pirate Bay and typed in “Iron Maiden”. The discography is available for downloading and it is free. There are 840 seeders and 290 leechers. So is this illegal sharing of Iron Maiden’s music bad? Is it harming the band?

Okay, so Iron Maiden is a “big” band and they broke through in the Eighties on the back of the dreaded “Record Label”. People can argue that the impact of piracy to a band of Iron Maiden’s stature is minimal. In 2011, Iron Maiden played 33 shows and had total gross earnings of $33,085,671. Yep, that’s right, they grossed $33MIL. The band is still signed to a major label and they have full control of their merchandising deals.

They are on Spotify and “Fear Of The Dark” is leading the way with 16.74 million streams.

What about bands that where on a major label and are now classed as independent? I typed in “Protest The Hero” into The Pirate Bay search engine. Their 2011 album, “Scurrilous” is available for downloading and it is free. There are 64 seeders and 3 leechers. Their 2008 album, “Fortress” is available for downloading and it is free. There are 48 seeders and 1 leecher. So is this illegal sharing of Protest The Hero’s music bad?

Between January and February, 2013, Protest The Hero had a Indiegogo campaign with the following slogan: “Protest The Hero – New Album. We have completed all of our obligations to record labels. It’s time to go it alone and take control of our careers. It’s now or never!”

The goal was $125,000. By the time funding finished, the band raised $341,146. Yep, that’s right. They almost tripled their funding goal. All up 8361 backers.

What about independent DIY bands? I typed in “Digital Summer” into The Pirate Bay search engine. The discography is available for downloading and it is free. There are 12 seeders and 3 leechers. So is this illegal sharing of Digital Summer’s music bad?

In 2012, Digital Summer had a Kickstarter campaign to give fans the opportunity to contribute to the release of their next album (which ended up becoming Breaking Point) in exchange for cool incentives and it also helped the band raise the money they need to finish the album and market it nationwide THE RIGHT WAY. They had a goal of $25,000. They got 340 backers and raised $51,080.

So is this illegal sharing (12 seeders = 12 people) of Digital Summer’s music bad? Is it harming the band?

The band released “Breaking Point”, toured behind it and are now prepping an acoustic album.

The unbelievers would say that the guys from Digital Summer all hold down day jobs, so the RIAA must be correct in their viewpoint as artists are not making enough money solely from the activities in the music business.

If you listen to the stories from the RIAA, you would believe that piracy is harming everything to do with music and this is so far from the truth, it hurts just to think it.

Shifting Thoughts with Evergrey, Dream Theater and Five Finger Death Punch – Are Corporate Deals the New Music Business?

The internet is flush with information about artists needing to do what is valuable to them. However what is valuable to them doesn’t always mean that it is valuable to everyone else.

So artists are always going back to square one. This is when artists will start to compromise their artistic vision and produce cookie cutter crap. However what an artist should be doing is to keep on writing. In the end, that valuable song will be written and it will translate to your audience. This is when the thing that you love to do, translates to an audience that loves what you do.

Evergrey is a Swedish progressive metal band. They are eight albums in so far. Their first album The Dark Discovery came out in 1998 and the most recent one Glorious Collision came out in 2011. The mainstay of the band is guitarist/vocalist Tom Englund, who also functions as the main songwriter in the band. Around him, band members come and go, with the most recent change happening in 2010.

Englund is remaining true to his artistic vision. He is not compromising on it and he is not changing his vision to chase any current trends. Drummer Jonas Ekdahl and guitarist Henrik Danhage left Evergrey in 2010 to form a metal core outfit called Death Destruction with the lead singer from another Swedish band called Dead By April. Chasing trends.

It all comes down to what the artist wants to achieve from their career. Englund is all about the art and to me it seems like he is happy with the level of success he has. Would he like to be bigger? I am sure the answer would be YES to that, however would he complain about his lot in life. I think not. Englund is doing the thing that he loves to do and he has found an audience that loves what he does.

Bands like Coheed and Cambria, Digital Summer and Protest The Hero all get it.

Digital Summer is all fan funded. They have been around since 2006. They have toured strategically since inception as all the band members hold down full time jobs. They are three albums and one EP in so far and based on their business model, they will be around for a long time.

Protest The Hero is also fan funded. Their recent Indiegogo campaign more than tripled their goal (and YES I am one of those fans that donated). They have even rewarded the super fans that have shared the contribution link and gotten other people to contribute with additional perks.

Coheed and Cambria are a very fan centric band. The way they have packaged The Afterman releases with the digital downloads available on the day of release, along with demos and back stories of each song, as well as an 80 odd page hard cover book is just brilliant. They did it their way and with a price that was just right.

Dream Theater is one band that is sitting on the fringe here. They are still doing it the old way as they know their fan base will lap up the new self-titled album. Their recent co-promotion with mainstream entity USA Today to launch their new single The Enemy Within is just another corporate deal in the same vein as Jay Z partnering with Samsung.

USA Today offer a certain amount of dollars so that they are the exclusive and first on line website to premier the new song. By doing this, Dream Theater, their label, their manager and whoever else has a stake in the band will get paid up front and USA Today will get traffic to their website which they can then use to get a higher ad revenue from their advertisers’.

Before all the DT Forum Elitists start jumping up in arms and start calling me an idiot, every band is entitled to earn money in any way they see fit. This is no different to Dire Straits and Phillips teaming up in the Eighties, to push the new CD format onto consumers. If that what Dream Theater’s business model needs them to do, good on them. In the end the fans will decide the fate of the band, as they have done for every band that came before and that will come after.

Five Finger Death Punch did something similar were they teamed/partnered with Loudwire to produce a track by track webisode series. The Five Finger Death Punch co-promotion was super cool as it focused on delivering back stories to each of the songs. As a fan, it is those little extra details that I really like. That could be the reason why Five Finger Death Punch have reached Gold status with each album release. Those little things, like a track by track webisode.
