Music Trends in Hard Rock and Heavy Metal – What’s On The Up and What’s On The Down

DAUGHTRY

The band leader, Chris Daughtry messed up big time chasing the crowds of “Train” and “Imagine Dragons”. He was a hard rocker from day dot and that is what gave him his legion of fans. For the ill-fated and recent “Baptized” album, he committed career suicide, throwing his lot with the hit songwriters. The songs are good, however they are not Daughtry songs. It would have been better for him as an artist to have given those songs to other artists that are more electronic pop rock minded. Daughtry needs more music right away and they need it to ROCK.

RECORD LABELS

The major metal and rock labels will continue to sign the bands and artists that had success in the Eighties and Nineties and get those bands to release forgeries of their greatest hits. It’s all about locking up the songs under copyright. “He who owns a lot of copyrights, will make a lot of money in the future, when said artists are dead and buried.”

In relation to new bands, they will sing fewer bands on even more shittier deals and shift their efforts to breaking them. It doesn’t mean that we will pay attention. It will be bands from certain niche’s that will break out and we will gravitate to them.

Also no one wants to pay. Look at the APP business. The highest downloaded APPS are all free ones. And they are still making money. We are happy to provide our private data to Apple and Google, as long as we get what we want, with no strings attached. If a record label has a business model that is dependent upon people paying, re-evaluate.

KIRK HAMMETT

He is out of touch. We live in a world right now that is connected 24/7. A lot of those connections happen because of social media. So his recent, “Ivory Tower” comments about social media show just how out of touch he is. Also from seeing him play live on three occasions, he has made a career on the coat tails of James Hetfield and Lars Ulrich. Don’t believe me, watch the making of the Black album, especially the scene when Bob Rock tells him that the solo he just put down for “The Unforgiven” is garbage.

HYPE

We can see through the hype and we hate it. So much hype was around Dream Theater’s self titled release and it disappeared from the conversation within six weeks. Megadeth’s “Super Collider” is being outsold by the Black album. Daughtry’s “Baptized” took forever to record and it did nothing. You can’t have a song called “Long Live Rock N Roll” and not have it sounding anything like ROCK. It sounds like that one hit wonder song “I Wish I Was A Punk Rocker With A Flower In My Hair.”

RESPONSE SYSTEMS FOR COPYRIGHT INFRINGEMENT

NAPSTER showed the music business and the entertainment business at large, how fans of music, movies and books want to consume content. They want to download it easily, free of DRM, use it in any way they want and they want to do it for free.

For all of the talentless CEO’s that flew in private jets off the hard work by the artists, this was a big NO NO. So off they went to their lobby group arms, the RIAA and MPAA and they started to lobby hard the governments. The various sister associations around the world started to do the same thing. The best thing they could come up with is a graduated response system, financed by the ISP’s. It failed in France. It failed in New Zealand. In the U.S it is hard to tell, especially when you have a copyright troll like Rightscorp shaking down IP addresses. So if Rightscorp is sending shake down notices to ISP’s, then why does the US have a graduated response scheme?

The bottom line is this, the people who the RIAA and MPAA want to catch are years ahead of them in INNOVATION. And INNOVATION is what they should be focusing on.

THE ALBUM FORMAT

We are challenged with time and we only want the best. Since we are allowed to cherry pick, we will. Heavy Metal and Hard Rock artists need to understand they are in the hit business. It doesn’t matter if they are radio-friendly or not. Each band in each metal and rock genre, needs to create that song that hits us on the first listen.

That is why bands like Five Finger Death Punch, Avenged Sevenfold and Shinedown are so successful. They get the game. That is why Killswitch Engage is successful. Adam Dutkiewicz understands the power of a massive chorus. That is why Trivium is having a career. Over the course of all of their albums, they always had a song that had “hit potential” for the genre they are in.

Making money is hard. Just because a band releases an album, it doesn’t mean that we want to pay for it in its entirety, especially if it has got a couple of crap songs on it. It’s better to release 8 songs that a “certifiable smashes” instead of 12 songs that have four crap ones. However, it turns out the public still has time for Metallica’s “Black” album. It is still moving two to three thousand units a week and it is expected to pass 16 million by May.

Artists need to think about the no limits that digital offers them. We want the good stuff. Artists need to think about how they can provide us the good stuff, without resorting to the album format. Don’t base your career on dropping an album every two years. An artist needs to base their career on constant events.

The artists are on their last legs. Motley Crue is ceasing to tour, however stand alone shows, plus new music are still in the works. They have hit the same markets over and over again since their 2004 comeback and in between they have released 3 new songs on a “Greatest Hits” album, 13 new songs on “Saints of Los Angeles” and 1 new song in 2012. The train is slowly coming to a halt.

Aerosmith released a DUD. The train is not a rolling anymore for them. All up, Classic Rock bands have maybe have another 10 years left.

A transition is happening. The younger acts are generating touring dollars, playing smaller venues and at affordable prices. It’s happening.

Not having to play second fiddle to Jon Bon Jovi, he is branching out again and this time, his roots are strong enough to balance his branches. The “Aftermath Of The Lowdown” is the best hard rock record from 2012 that went unnoticed because it was released so close to his Bon Jovi work.

Innovation V5.0 – It Just Keeps Getting Better from Liberation Music and Rightscorp

Each week, the technology industry and the sites that enable copyright infringing are innovating at a rapid rate to stay ahead of the curve.

YIFY is one of the more popular torrent sites out there. Instead of resting on their laurels they are innovation even more. Read this article. You will see all the development that YIFY carries out. These are the people who the recording industry need to employ, not shutdown. But when the entertainment industry only cares about dollars, sites like YIFY that facilitate sharing are seen as the bad guys.

The funny thing in all of this, is that Napster showed the entertainment industries what people want 15 years ago. So why haven’t they listened. Spotify is trying to compete however it is failing because people still want to download a song for free and be able to do anything they want with it. And they want to do it easy and with no strings attached.

This one has been going on for some time. Liberation Music sent a bogus take down notice to YouTube on a presentation that Larry Lessig posted back in June 2013. Now for those that don’t know, Larry Lessig is a famed professor and a copyright/fair use expert. So they picked the wrong guy to try to censor. Lessig then filed a counter-notice and Liberation threatened to sue for copyright infringement if Lessig didn’t retract his counter-notice.

So who is Liberation Music. Of course they have to be from the same country that I am from, good old Australian. So Liberation Music owns the Australian copyright for a song called “Lisztomania” by the band Phoenix. The Lessig presentation has a snippet of that music.

Let me get this straight. Liberation is an Australian label, who owns the copyright for a song in Australia only and then issues a bogus take down notice on an US presentation that has a tiny “fair use” snippet on it.

So in response, Lessig filed for declaratory judgment and sought damages for the bogus take down offer. Liberation finally came to its senses when it realised it was going to lose and agreed to settle the case with Lessig, paying him an undisclosed sum that Lessig then passed on to the EFF (Electronic Frontier Foundation) who worked on the case.

Moving on to some innovative news, we have the latest internet troll Rightscorp at it again. This time they are trolling the torrent public trackers for IP addresses that are linked to the torrenting of songs that are on the Billboard 100. Nice business model if people actually get scared by the threats and pay. If they send out 10 million notices a year and 1 million pay the $20 infringement tax, then that is a cool $20 million.

Surely some of that money will go back to the artist, songwriter, producer or the performers. Innovation has ceased/never began for the Record Labels. All in the name of the guaranteed dollar.

This Is How The Out Of Touch Music Business Innovates

The Music Business launches an Anti-Piracy App to educate young people on piracy while at the same time copyright infringement of music is declining each year due to decent legal options.

The game allows players to select an aspiring artist from a list of hopefuls, compose tracks from a roster of song-writers, producers and studio technicians and balance the books by keeping an eye on how radio play, streaming and piracy impact on profits. So maybe the game will show players how much an artist REALLY gets for a song.

However, if the recording industries want to be treated seriously, what about the income from live shows, merchandise deals, licensing, video games, YouTube, Kickstarter, Indiegogo, Pledge and the many other ways an artist can make money these days.

Then you have Paul McGuiness who wants Google to do more to protect the old business models of the recording industry. This is what Paul McGuiness had to say;

What needs to be done is simple, take the sites down and keep them down. If the pirates can manage to replace their sites instantly with legions of bots, Google, with their brilliant algorithm engineers can counter it.

Umm, can someone tell Paul McGuiness that Google is only a search engine. It is not their job to police the internet for the entertainment industries.

We need the technology giants like Google to do the things that labels, the publishers, the artists, the writers repeatedly ask them to do. They need to show corporate and social responsibility. Take down the illegal sites, keep them down and clear the way for the legal digital distributers like iTunes, Spotify, Deezer, the new Jimmy Iovine Beats service, which promises to be a very serious competitor. Those services now exist, it is no longer acceptable to say that the music industry is not available, not making its wares available online.

People have been downloading since the Napster days. So it’s pretty clear to the recording industry people that their customers want to download an albums worth of music, they want to do it for free, they want it DRM free and they want to do it anonymously. So why isn’t the recording industry offering this service to their customers.

They claim illegal pirate sites make money from the advertisements. So why can’t the recording industry offer the same service, via the BitTorrent protocol and make money from the Advertisements.

We’re all aware in this room that subscription is now replacing downloading — legal or illegal — but we do need those mega corporations to make a genuine effort to cooperate and feed the industry that has been so good to them.

Corporations exists to offer a service to their customers. They do not exist to prop up dated business models based on high profit margin CD’s.

Finally you have a company called Rightscorp who is accumulating Copyrights

I’ve posted previously about the whole shambles around Copyright and how their extended copyright terms are purely there to protect the interest of the Corporations that have paid the creator a sum to control their copyright or the Corporations that have paid the record label (who is the current holder of the Copyright) to control the record label right. In the metal and rock sphere, two record labels come to mind, where I feel that their intentions are motivated by having a copyright monopoly on certain songs.

One is Frontiers and the other is Rock Candy. Frontiers are getting a lot of the Eighties greats to create forgeries of their hits, while Rock Candy is buying up albums from the Eighties and re-releasing them with expanded packaging, so that all these forgeries and new versions of the Eighties albums fall under a new copyright term.

While the two labels deal with music, Rightscorp Inc, is otherwise known as a COPYRIGHT TROLL. Rightscorp claims that they have a “patent pending digital loss prevention technology” that focuses on the infringement of digital content such as music, movies, software, and games and ensures that owners and creators are rightfully paid for their IP.

The Wall Street Journal article also mentions that the following;

Rightscorp implements existing laws to solve copyright infringements by collecting payments from illegal file sharing activities via notifications sent through Internet Service Providers (ISPs). The Company’s technology identifies copyright infringers, who are offered a reasonable settlement option when compared to the legal liability defined in the Digital Millennium Copyrights Act (DMCA).

It is very interesting reading the above paragraph, especially when the Justice system in the U.S is waking up and realising that an IP address does not identify who the actual copyright infringer is.

While the music business innovates in their own litigious way, the so called “pirates” are innovating in a very different way by making it even easier for fans of music to download and even stream music.

Chaos + Disruption = The Music Business

It’s a chaotic and disruptive time in the music business and with chaos comes opportunity.

On one side you have COPYRIGHT. And that can be broken down into a lot of other little chaotic categories like infringement, the length of copyright terms, copyright monopolies, the lack of works entering the public domain and so on.

The public domain is culture. Keith Richards once said, ‘you can’t copyright the blues.’

Culture is built and expanded by sharing stories and building on the works of others. Led Zeppelin, The Beatles, The Rolling Stones and all of the sixties greats like Hendrix, Clapton and Beck used this concept. They built off the blues.

However copyright law and its real purpose got hijacked by corporations and everything changed. Instead of culture being built up in the works that the public creates and shares, the public is now faced with copyright corporations locking away works that should be in the public domain by now. These works that should be in the public domain do not benefit the original creators in any way, however they are beneficial for the few copyright monopoly gatekeepers.

For culture to thrive once again, it is important to respect the public domain.

Then on another side of the music business you have the RIAA who continually push lies out into the world, so that technology companies can do something to protect crap business models. Did you know that the global music industry sent it’s 100 million takedown notice to Google, to remove search links to certain sites. It looks like the RIAA doesn’t get it.

So if a person types in “free mp3” in Google Search what should Google return?

Sites that have free mp3’s or sites that the RIAA want Google to point to when that term is typed in. Maybe when that person types in free mp3, they want a free mp3 and have no interest in paying.

Then you have the ISP’s on another side that are caught up in the middle of all this as they offer the service that provides internet access to users. According to the RIAA and the record labels, the ISP’s allow “copyright infringement” to happen, therefore, they need to do something about it to help out the music industry. In Australia, this is heavily disputed, however in other parts of the world gradual response schemes are in place.

Then you have the technology companies trying to offer low cost services to fans of music. However, low cost to a fan means high costs to the RIAA and the record labels in licensing fees. This is before the new service is even allowed to trade. If the new service starts to trade without licensing in place, expect them to be litigated into submission.

Have you noticed that artists have not been mentioned anywhere as yet. That is how far the music business has come, where the actual music is only a small part of it, however it should be the major part of it. For the business to thrive, you need great music.

I was looking back to some of the releases in 2013 that I liked. Two of my favourites are “Protest The Hero” and “Coheed and Cambria”.

“Protest The Hero” and “Coheed and Cambria” are working to the “Keep your fan base close” mantra. Both of the bands moved from major labels into a DIY independent mindset, realising that their fans are king.

Exceptional fan service is the key driving force behind a bands success. I expect “Coheed and Cambria” will get a lot more fans purchasing the next super deluxe package for the new album because they did such a great job with “The Afterman” releases.

“Protest The Hero” on the other hand have fallen into the fan funded conundrum where the perks always arrive later than expected for international fans. I live in Australia and I am still waiting for the perks to arrive. The band have been clear with their information, advising that it will take 6 to 8 weeks.

It’s good old business 101, “treat your customers right and they’ll stay with you forever”.

Then you have bands like Five Finger Death Punch, Avenged Sevenfold, Dream Theater, Stone Sour, Killswitch Engage, Trivium, Volbeat, Alter Bridge and TesserAct that have label deals.

Should those bands go independent like Protest The Hero or Coheed and Cambria. It all depends on a person’s definition of success and hard work. Going independent means that you need to build a team around you like any business start-up.

What are the benefits of going independent?

The lesson is simple. Selling your artistic freedom and independence as a “success” strategy can bring lucrative rewards. But it’s not always the best move for your career, as you are also selling off important data to the record label. The record label doesn’t want to know your fans or connect with them. They want you to do it, so that the label can make money of that relationship and then pay you a percentage of it.

Coheed and Cambria moved over 100,000 units of their deluxe “Afterman” editions. At $60 (I think it was $68, however I will use $60 for the example) an edition, that comes to $6 million in revenue. If the band was on the label model, what percentage would the band see from that $6 million.

The music market/business is filled with acts trying to make it. It is going to take a huge effort to stand out amongst the rest. Music is a lifer game. It is a slow and steady approach that builds careers.

Artists should be looking at development. With each song release, artists should never be afraid to try things out. Even try out new technologies that make it very easy for their fans to interact with them and their music. In a company, this is called research and development. Investing in your career is never a mistake.

The artists have the power to make the record labels redundant, purely to be used as a distribution arm if needed, however with the rise of streaming technologies, even this arm can be in danger of disappearing. Bands like Coheed and Cambria, Protest The Hero and Digital Summer have seen the recorded business side of things and have decided, hey we can do it better. That’s what great businesses are made of.

So in all of this chaos, who will rise and who will fall? Time will tell, however if you compare music to technology, you will see only a select few rise to the top. Smartphones and tablets is all Apple and Samsung. Amazon has online shopping cornered. Google is the king of search. Spotify will win the streaming war. Facebook rules social media. iTunes rules the mp3 and app market. Will the same fate happen in the music business?

2019 Crystal ball predictions;

Coheed and Cambria – will get bigger and bigger. Their style is unique, so expect them to keep to that style, sort of like how AC/DC releases music in the same style or Iron Maiden.

Protest The Hero – proved to themselves that they still matter. Will get bigger and more crazier. The future of progressive metal.

Machine Head – will still be bigger then what they are. Robb Flynn understands the internet and understands the change that is coming. He will make sure that Machine Head rides the wave all the way to the shoreline, while Adam Duce circles in the undercurrent, ready to litigate the band into submission.

TesseracT – will become the next Pink Floyd.

Digital Summer – are one of the hardest working rock bands around like Twisted Sister and Dream Theater. They will get bigger as they are lifers.

Avenged Sevenfold – will become the new Metallica.

Five Finger Death Punch – I have a feeling that they will break up after one more album.

Shinedown – will be bigger than what Aerosmith ever was.

Volbeat – will remain relevant in their niche genre.

Metallica – will still be relevant in the same way the Seventies act remained relevant.

Dream Theater – will still tour and do a lot of side projects, however they will be replaced by TesseracT and Protest The Hero.

Black Veil Brides – will take over the void left by Motley Crue and Guns N Roses.

Trivium – will deliver an astounding progressive technical metal album.

Killswitch Engage – will remain relevant in their niche genre.

Alter Bridge – The world needs Led Zeppelin to continue. Expect Alter Bridge to fill this void. They have one of the best vocalists of the modern era in Myles Kennedy. Marc Tremonti is a prolific writer. Call his Creed project, “The Yardbirds” and Alter Bridge as “Led Zeppelin.”

Bullet For My Valentine – will deliver their own version of “Master Of Puppets” and “The Blackening”.

Lets see how it pans out.

Grammy Awards

It’s a gimmick. From when Jethro Tull won the first metal award at the Grammy’s, the whole awards night and nominations has been a joke when it comes to metal and hard rock music. Hell, even metal heads said “who is Jethro Tull” when his name was announced. Jethro Tull didn’t even turn up to the awards ceremony because their label told them they wouldn’t win.

I am all in for metal music to be recognised, however it’s time to call a spade a spade. The Grammy awards for metal doesn’t recognise anything. It is a dead set joke. The Revolver awards are a step in the right direction however they are not much better as they play up to the ‘PR’ companies who assist in writing their stories. You see, we live in a different world right now where we get to choose what we want to listen to from a plethora of choices. Does anybody really care who wins or is nominated?

Having Metallica win the “Best Metal Performance” in 1990 for “One” and then in 1991 for “Stone Cold Crazy” just added to the Grammy metal jokes.

“One’s” fate was tied with the “…And Justice For All” album and that was meant for the 1989 Grammy ceremony. And seriously, for the 1991 awards, a cover song was the best that was on offer in the metal world for releases released from October 1989 to September 1990. I don’t think so.

Even in 1999, Metallica won again for “Better Than You”. For which song, I hear you say. “Better Than You.” Does anyone know from which album it was on or how the riff goes or the vocal melody? I bet that most people will answer NO.

Fast forward to the 2014 nominations. The nominations are Anthrax – “T.N.T.”, Black Sabbath – “God Is Dead?”, Dream Theater – “The Enemy Inside”, Killswitch Engage – “In Due Time” and Volbeat – “Room 24” featuring King Diamond. Scott Ian has even said that he didn’t know that Anthrax could be nominated for their cover songs.

From an artist point of view a Grammy nomination can be trumpeted as a marketing success in future promotions however it means nothing if the music isn’t great. Even in movies, who cares if a new movie has Oscar nominated actors if the movie is a dud. Same deal with music. Who cares if Megadeth has been nominated for the most Grammy’s without a win? We only care if the music is great?

Yep, Motorhead won a Grammy in 2006, beating out acts like Cradle of Filth, Hatebreed, Killswitch Engage and Slipknot. Can anyone name the track and the album it is on without Googling it. Yep, Judas Priest won an award in 2010 for a live track of Dissident Aggressor. Seriously, a live track. That is the best that was on offer.

If the music is not repeatable and if people are not listening to it, it’s time to go back and write some more songs. To think that the Grammys’ are a reflection of heavy music today is akin to saying what Loudwire rights is gospel. Did anyone read their praising review of the first Red Dragon Cartel gig? It was a shock to the 99.9% of the audience in attendance who blasted the show on Facebook and other social media sites.

NARAS is beholden to the old major label structure. That structure is going through a chaotic time and for some of it is crumbling. So what does NARAS do? They nominate what the labels push and lobby. They get it wrong year after year as their membership is declining. In other words, the current music paradigm looks for people to lead and NARAS has none.

The old paradigm is gone. Entertainment and music are owned by the fans. The days of Producers, Record Label A&R’s and Publishing people voting for who should be nominated and who should win are over. If these people think they are above the audience, then they are in for a rude shock.

Musicmetrics has shown Iron Maiden where their pirate (copyright infringing) fans are and Iron Maiden rewarded them by doing concerts there. However apart from the websites that report critically on these issues, the rest of the media ignores the story, because they are beholden to the labels or to the old newspaper system. So of course, they cannot be trumpeting the virtues of copyright infringement.

What we should be awarding is music that managed to get their message out to people. In 2013 we are inundated with so much information, so we decide to invest time into music that interests us or really connects with us.

So what is important. The bottom line is this.

If a band is at decent “star” level, they will get traction because they have proven themselves. They do not need a Grammy nomination or a Grammy win to trumpet their next album. If Megadeth releases another stiff album, then they can expect to do even lower numbers on their next tour, because in the end ten tracks slapped together means nothing if nobody isn’t interested. Same for Dream Theater.

The plan today is back to selling songs. The record labels wish that is not the case, however that is just denying the inevitable. Music is a hit for a reason. It’s because its good. It’s not because it won a Grammy award or got nominated for a Grammy award.

Otherwise a Grammy nomination is near meaningless. A footnote. It doesn’t service the fans. That’s the music business right now. The fans have the power. They deserve the respect.

Imagine A World With Copyright Terms Reduced To 40 Years..

Should songs still be under Copyright forty years after they have been released?

In Australia (as well as a lot of other countries) a copyright for a sound recording or a film lasts for the life of the creator + 70 years.

In my opinion this is ridiculous.

Is this what Copyright has become? A pension fund for the creator and their family members. Also with large Corporations technically owning a lot of the copyrights of creators, it is safe to say that Copyright has become a weapon to stifle creativity.

It is common for people to see that the purpose of Copyright as a means to compensate the creator of the content. Hell, that is what Wikipedia states as well, along with the large labels and movie studios . In fact, Copyright was never designed solely for this purpose.

In Australia it was stated that the purpose of Copyright law was;
…to give to the author of a creative work his just reward for the benefit he has bestowed on the community and also to encourage the making of further creative works. On the other hand, as copyright in the nature of a monopoly, the law should ensure, as far as possible, that the rights conferred are not abused and that study, research and education are not unduly hampered.”

In the U.S, the Constitution’s clause on Copyright and patents states:
“To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries” (Article I, Section 8, Clause 8)

In today’s terms, both countries are saying that the purpose is to reward the creator and to ensure that maximum creativity is happening.

John Lennon didn’t sing imagine a world with reduced copyright terms however he should have.

Let’s just say that the copyright of a song is 40 years from when it was first released. To make the law even simpler, let’s just say that the 40 years starts from when the song is first released. So if the song is remastered 10 years later or released as a live version, it doesn’t matter. The 40 years starts from when the song is released.

That would mean that all songs from 1972 and before would have been in the public domain at the start of 2013.

That would mean albums from Led Zeppelin, Black Sabbath, Deep Purple, Eric Clapton, Cream, Rolling Stones, Yes, Pink Floyd and many others would be in the Public Domain.

Would that affect those bands in any way?

Would it affect the people who wrote the songs?

Lets look at Led Zeppelin. If copyright is 40 years from when the song was first released that would mean that Led Zeppelin I to Led Zeppelin IV would be copyright free. That means all of those songs are available to use.

Imagine all the music that would be created by building on the material. Image all the music that would be created by remixing, sampling and re-using the songs. All of those songs would available for people to re-record without any restrictions. It will not diminish the original songs in any way. It would give them a second life and a new audience.

Why should any creator in 2013 be stifled by over-reaching copyright laws when it comes to creating art?

The acts from the Sixties and Seventies, brazenly borrowed and built upon songs that already existed. Keith Richards even said that you can’t copyright the blues. All of those bands infringed heavily on other people’s copyright. However back then the Copyright monopolies didn’t exist, so it was okay.

Surely the 40 year monopoly that artists from the Sixties and Seventies have on the music they created is sufficient compensation for their creations. However copyright is still seen as a major profit line in the business model of artists. Since the Government and the large players have focused almost exclusively on monetizing via copyright, they will argue until they are black and blue any attempt to change copyright as they see change as an attack on their incomes.

Seriously, who do you think will be holding the copyright to the Led Zeppelin songs, 10 years after Jimmy Page and Robert Plant have passed. Trust me, it will not be the family members. It will be the corporations and the record labels. They will hold the monopoly on these songs. You can see it happening now with Disney and how they are stopping Mickey Mouse from entering the public domain by lobbying for longer copyright terms.

So what new songs would these corporations be creating by holding a monopoly on the copyright. The answer is simple. NOTHING.

Remember that Copyright was also designed so people are inspired to create more. So what has Jimmy Page created in the last 15 years. The answer is nothing. There is nothing wrong with that either, because he can rely on his copyright monopoly and issue box sets every 2 to 3 years. Since 1990, Jimmy Page has issued 13 box sets of Led Zeppelin’s seventies output. In 23 years, Jimmy Page has released the same music, over and over again 13 times.

Remember, copyright is to give to the author of a creative work his just reward for the benefit he has bestowed on the community and also to encourage the making of further creative works. So what happened to the further creative works.

I love Jimmy Page and he is a huge influence on me. However, apart from the excellent Coverdale/Page project and his reunion with Robert Plant, his creative output has been poor since the start of the Nineties. Even in the Eighties, Jimmy Page’s output pales in comparison to Robert Plant’s recorded output and work ethic.

By the way did you see that BitTorrent traffic is down in the U.S? How can that be, especially when the labels and the movie studios are still screaming piracy and copyright infringement.

It’s funny what some innovation can do. That is how you compete today. You innovate, not stagnate. NetFlix and YouTube account for 50% of all net traffic.

However in Europe and other parts of the world, access to the latest films and TV shows is not as instant so unauthorised BitTorrent users continue to grow there.

The labels and their back-handed politicians will argue that their six strike policy is the reason why BitTorrent traffic is down. I would argue back that all that has done is increase the use of Dark Nets.

This is what the article said on that;
“The use of “dark nets” such as Tor and encrypted digital lockers is growing in popularity. These can be harder to track.”

So get ready for the next round of b.s from the labels and their lobby groups. We need Google to do more to stop copyright infringement, we need dark nets to be busted to save our children, we need cloud services stopped because they encourage racketeering and copyright infringement on a grand scale.

They will complain about everything, except innovate. Spotify wasn’t created by the music industry. Pandora wasn’t created by the music industry. iTunes wasn’t created by the music industry. The iPod wasn’t created by the music industry. NetFlix wasn’t created by the movie industry. Napster wasn’t created by the music industry. YouTube wasn’t created by the music business.

But the entertainment industries spin it like it was them that created these legal alternatives. The truth is they where dragged kicking and screaming into these new technologies.

The Stealing Argument Again & How Copyright Infringement Leads To Renewed Interest

Bon Jovi’s “Livin On A Prayer” has had a revival of sorts thanks to a viral clip doing the rounds from a Boston Celtics fan dancing to “Livin On A Prayer” during a stoppage in play. This happened in 2009 and the actual YouTube clip from back then has been blocked in Australia on copyright grounds by Universal Music. That clip was sitting at 3.6 million views before Universal killed it. Isn’t it typical of the labels to kill something that could make them money in the long run?

However a fresh upload of the dance routine to the Utrend.tv website on Oct. 17 has gone viral with over 11 million worldwide views.

In turn this viral interest in the dance routine has led to a renewed interest in Bon Jovi’s “Livin’ On a Prayer.” But wait, copyright infringement is bad for the artist. Isn’t that the catch cry of the record labels, their lobby group and other misguided artists/organisations.

For example, there is the “Save the Music America” organisation (backed by Nashville Songwriters Association International and led by Mark Dreyer) that just doesn’t get it. They compare illegal downloading of a song with walking into a coffee shop and stealing a cup of coffee.

Remember the MPAA commercials from the early two thousands that equated copying movies the same as stealing a car. Seriously, are people still thinking like this in 2013.

For the hundredth time stealing means that Person A has taken a song that Mark Dreyer has written and Dreyer does not have that song anymore. It’s gone, stolen forever.

Copyright infringement means that Person A has taken a copy of a song that Mark Dreyer has written.

Stealing and copyright infringement are two very different things. Now if Dreyer is not getting paid for the success of his songs, then that is something that he needs to work out with the artist, publishing or label that is getting paid. Music piracy is a result of the record labels inability to innovate. Case closed. Of course, due to the one-sided contracts that artists and songwriters signed, they are the ones that are doing it tough.

Has Universal Music CEO Lucian Grange taken a pay cut recently? Of course not, as there is still a lot of money doing the rounds in music.

The whole clip of the dance routine infringes on the copyright that Universal Music holds on “Livin On The Prayer”. However is that such a bad thing.

According to Nielsen data, “Livin’ On a Prayer” has accumulated 5.1 million streams in the U.S. last week. That is an increase of 390%. But wait, streaming is bad for the artist.

The song also had up to 4,000 paid digital downloads.

But wait, piracy still exists. The song is available on all the pirate sites for free, however people still decided to pay for a legitimate version of the song. People still went and streamed a legitimate version of the song. People went on YouTube and watched the clip of the song on the various channels that host it. People still went and downloaded the song illegally. Basically, people will do what they want to do.

Even Tim Millar the guitarist from Protest the Hero is a recorded music pirate. This is what he had to say in a recent interview on the topic;
“I can’t say don’t download music. I think people should get to hear music before they buy it. Even if they just download it and come out to a show, that’s going to help the band more than it hurts them… What we were worried about was the Indiegogo campaign. We didn’t want the record to leak and then the [Indiegogo supporters] have to wait two weeks to get their copy. So as soon as the record leaked, we sent everyone a digital download code that night.”

Millar gets it. Doc Coyle gets it. Piracy is not that bad. There is an opinion piece called “GOD FORBID’S DOC COYLE: THE TIMES, THEY ARE A CHANGIN’”,

“…people that seem to hate this change are, obviously, the people who sell records, such musicians, record label people, managers, etc. Also, notice that the people most bothered are ones to tend to make the most money from music. No one ever cares about giving their demo away for free when they are unknown, but when you start make a living from music solely and record sales suddenly have an impact on your lifestyle and well-being, that stance changes. This is not a knock on those individuals — just the way it is.

At this point, you may be thinking, “Wait, isn’t Doc a musician? Shouldn’t he be pissed off that people download God Forbid records for free?”

I am not pissed off by illegal downloaders, even though I probably should be. If illegal downloading didn’t begin crushing the music industry in the early 2000’s, I would probably have made a much more lucrative living from making music. It’s affected all of us: Me, huge artists, basement bands, and even every other facets of the industry that used to see the rewards of more funding via the sales of actual physical albums, from photographers that did press shots, to the guy that directs your music video, to all of the writers for rock and metal magazines. The contraction of this industry has been devastating to the economy of music.

The only problem is, you can’t stop these changes from happening. Getting mad about it, or even worse, making someone feel bad for doing it, doesn’t really make a profound impact. Do I want people to buy my albums? Hell yeah! But I can’t stop those who download it, and the thing is, those people still may support the band in other ways, such as coming to a show or buying a t-shirt. The truth is, I buy some albums, but I also I do download some from torrents sites. The real question is, how does that affect me morally? Is it stealing in the traditional sense of the word?”

The internet changed the way people saw the world. Throughout history, industries and trades become obsolete or they evolve. I guarantee you that any musician that has tried to make it has pirated music. From taping music on cassettes to downloading mp3’s for their mp3 player. Show me one musician that says that they never pirated or infringed and I will show you a liar.

Basically the record labels, the RIAA, the book publishers and the movie studios seemed to think that people wanted the physical products to own and keep, however what the people wanted was the content. Streaming is on the scene, however it is 14 years too late. It should have been there from day one, before Napster. Now it needs to play catch up.

Going back to Protest The Hero and the interview with Tim Millar.

“I think if you (fans) can find avenues where you’re paying for music directly and you know where the money is going, you should do that. I know Bandcamp takes 10 percent, so you know that 90 percent of that money is going to the band. I’ve never bought anything on iTunes because I know artists aren’t making most of that money… But if it’s a matter of you spending $10 on the album or not hearing it at all, I’d rather you get to hear it, then come to the show and buy a T-shirt.”

The last line is the cold hard truth. As an artist, you want fans to hear your music and then to come to a show and buy some merchandise.

If that means a fan buys the album, then buys a concert ticket and then buys a T Shirt. Great.
If that means a fan streams the album, then buys a concert ticket and then buys a T Shirt. Great.
If that means a fan downloads the album for free, then buys a concert ticket and then buys a T shirt. Great as well.
If that means a fan hears the album for free and doesn’t buy a concert ticket or a T shirt, then that has to be great as well. Maybe they will commit on the next one. There are just so many variables out there, however the main variable that artists should be focusing on is getting the music heard.

In relation to the songwriters (the ones who write songs for other artists), then they should organise/negotiate a better payment deal for their contribution to the song and move on. Music was never designed to be a pension fund. But hey, people hate change and songwriters are still clueless.

Time Is Working Against The Artist

It’s 1992. The labels are signing Seattle bands, left, right and centre while at the same time they are dropping hard rock and heavy metal bands left, right and centre. That is the power the record label had. Not only could they make an artist famous, they could also destroy an artist. You see when you control all the points in the distribution and marketing chain, you more or less control everything.

With the massive power that the major labels had, we always saw artist/s as famous. We always thought that once an artist was signed to a label deal, they had it made. It was a big misconception.

Fame for an artist in most cases meant a large advance that had to be recouped by withholding royalty payments. That is why record label accounting gets messy and it cannot be trusted.

So in 2013, things have changed dramatically. With this change, the power is still with the major record labels. They gathered enough power during the Eighties and Nineties to be a force to be reckoned. Then in the Two Thousands the massive mergers and takeovers happened, further enhancing the power of the record labels. Then in order to allow digital start-ups, the record labels did one of three things; charge high licensing fees or litigate the start-up to bankruptcy or negotiate a large ownership stake in the start-up.

So even though the internet has lowered the barriers of entry, without the money and power of the label behind the artists, there is a pretty good chance, the artist would probably go unnoticed. Remember 4 million songs haven’t even been listened too on Spotify.

So when certain artists are complaining about a low royalty payment, maybe that is the royalty payment that is relevant to the niche the artist is in. Maybe it is a royalty payment that they have earned. You don’t see a current household name complaining. It’s because they worked hard at obtaining a certain thing called leverage.

Digital distribution offers an artist new audiences in places where brick-and-mortar stores would be impossible or unsustainable, like foreign countries or rural areas. The end result is growth across the board, both physical and digital provided that the artist gets noticed.

So is piracy that bad for an artist who is trying to get traction?

The majors and the mainstream journalists attached to news outlets operated by media moguls have done a great job selling the “one pirated item equals one lost sale” statistic and the “illegal downloading (piracy) is theft” argument. It is a statistic that rights holders, lobby groups and misguided artists exaggerate and it is a statistic they use to either kill off innovation or to stifle innovation.

Piracy (better known as copyright infringement) is basically one person (A) copying something of value that another person (B) owns. This leads to a situation that has both people (A and B) having a copy of the same item.

So it is safe to say that one pirated item is not theft. Theft is basically one person (A) taken something of value that another person (B) owns, which means that Person (B) no longer has the item.

So let’s assume that piracy spreads the artists’ material to places that are unknown to the artist and the people who download the music might become a fan and share their thoughts with others. They could even go to a show or they could go and purchase the next album or the artists back catalogue. There are a lot of could’s in the above theory. However the music business is all based on could’s.

For example, in the heyday of the record labels, this is how the above would have panned out.
Let’s assume that a record deal spreads the artists’ material to places that are unknown to the artist and the people who hear the music on radio or MTV might become a fan and share their thoughts with others. They could even go to a show or they could go and purchase the next album or the artists back catalogue. As you can see, the heyday theory also holds a lot of could’s.

Of course the difference is the money. The labels once upon a time threw money at artists and provided tour support. Today, the labels only go for the sure bet and 360 deals.

From a fan perspective, the main thing working against the artist today is time. Why would a music lover want to invest their time in an artist? I recently invested a lot of time in the TV show “Sons of Anarchy” because knowledge of the show was being shared at work and I wanted to be part of the conversation. I invested a lot of time in the show because fans of the show shared their thoughts with me. They convinced me that I needed to watch it.

One thing is certain in 2013. We move on fast. Look at the Top 10 lists of pirated movies that TorrentFreak publish each week. It’s always changing and very rare for the same movie to be at number one for two weeks in a row. Look at the Top 10 of the Charts published by each country. The artists in the list are always changing.

Talking About Riffs – Progress Is Derivative (The Non-Metal Version)

Okay so what do we know.

We know that Robin Thicke released a song called “Blurred Lines” that ended up going nuclear all over the world. That means a lot of dough to share around.

We know that the family of Marvin Gaye have lawyered up with King and Ballow to sue Robin Thicke and song publisher EMI April/Sony/ATV for copyright infringement.

They claim that Robin Thicke committed copyright infringement on Gaye’s “After the Dance” to create his song “Love After War.”

They also claim that Thicke’s “Make U Love Me” shares a similar bridge and identical lyrics to Marvin Gaye’s “I Want You.”

They also claim that “Blurred Lines” was stolen from Gaye’s “Got to Give It Up”. To muddle the waters even more, allegations also abound that “Blurred Lines” was also derived from Funkadelic’s “Sexy Ways.”

It is pretty obvious that the family of Marvin Gaye don’t care about derivative progress. All they care about is money. This is not about protecting Marvin Gaye and his legacy. A legacy is protected by people and fans of music. By simply having the conversation that “Blurred Lines” sounds similar is proof that Marvin Gaye’s legacy is protected.

Listening to “Blurred Lines” and reading the reviews of the song, you know it got me interested to check out Marvin Gaye and that is what matters in today’s times. Are people listening to the music?

Of course this lawsuit isn’t just about copyright infringement. There is an argument put forward against EMI, about how they strong armed the Gaye family, about how they planted false stories in the media, about conflicts of interest (due to EMI controlling both copyrights), about professional misconduct and breaches of contract

Of course the argument put forward by Thicke and EMI is that the genres of the songs are the same however the notes are different and as far as they are concerned no infringement occurred.

Regardless of how people view this argument. One thing is clear.

The family of Marvin Gaye have been ill-advised. Even if they win the lawsuit, they still lose “financially” in the long run.

The only financial winners here are the attorneys.

The Gaye family will lose out in the long run because artists will stop referencing Marvin Gaye. Once people stop referencing Marvin Gaye this will then lead to people not talking about him. He will be absent from the conversation. The only reason why this has all come up, is that people have talked about the similarities. The Gaye family even used those conversations as part of their counterclaim.

So once people stop talking about someone, in time that person/artist will be forgotten.

The shenanigans carried out by the Gaye family is a far cry to what happened to Bobby Parker. For those that don’t know, Bobby Parker was a blues rock guitarist that passed away recently at the age of 76. He wrote a song called “Watch Your Step” in 1961. The song was a hit on both sides of the Atlantic.

The Beatles hit, “I Feel Fine” released in 1964 had that riff. The influence of “Watch Your Step” also extended to “Day Tripper” as well. John Lennon even stated that “I Feel Fine” and “Day Tripper” were songs built on variations of the “Watch Your Step” riff.

Led Zeppelin used the riff in “Moby Dick” released in 1968.

However, in order to show the progress is derivative effect in action, the “Watch Your Step” riff evolved from the Afro-Cuban jazz composition “Manteca.” That is what music is all about. Evolution by derivatives.

However, Bobby Parker reaped few rewards from the song’s success as he sold the copyright to V-Tone records owner Ivan Mogull for next to nothing. In other words, he didn’t know enough about copyright and he got shafted. Sound familiar. Labels shafting artists.

So all you artists that sign record deals remember this. The label owns your copyright. And guess what the labels are pushing for. Long copyright terms. Look at the massive expansion of the “Duration of Copyright Term” between 1910 and 1998. Just at the time that movie studios and record labels started to appear. Just at the time that the RIAA and the MPAA started to appear and become lobby powerhouses.

At the moment, in the US it is sitting over 100 years due to the 1998 Sonny Bono Act. To top it all off, the Copyright monopolies want longer terms. Longer terms means that our culture is all locked up. The whole point of copyright was to serve and benefit the Public while giving creators a short-term monopoly on their creations. There is nothing that is coming off copyright because Corporations own the majority of the copyrights.

Talking about riffs, what about that riff in “I Want A New Drug from Huey Lewis and the News. It was a hit twice. Once for Huey Lewis and the News and another time for Ray Parker Jr., with “Ghostbusters”!

Deja-Vu. 2011 vs. 2013 with Dream Theater and Trivium – Random Thoughts on their new songs

It’s like déjà vu again. In 2011, I was listening to new songs from Trivium and Dream Theater. Trivium had just unleashed In Waves as its promotional single for the In Waves album and Dream Theater had unleashed On The Backs of Angels as its promotional single for the A Dramatic Turn of Events album.

I remember listening to both songs back then and taking into account both of the band’s position in the musical landscape. Dream Theater to me, had the most to prove, as this music would be their first without founder Mike Portnoy.

In my opinion In Waves is a stronger song than On The Backs of Angels. The song wins all the time. I was listening to Images and Words yesterday and the reason why that album is awesome 21 years after its release is the songs. Learning To Live, Metropolis and Take The Time are progressive as hell, but man, I can physically hum the whole songs to anyone including the progressive interludes.

Images and Words is Dream Theater. That album represented what Dream Theater are all about and it set in motion everything that was to come. This new album is self-titled, therefore it should represent what Dream Theater is all about.

Anyway I digress, going back to my 2011 experiences. In relation to the albums, both of them had a six week U.S sale run (physical sales) and then disappeared. Will history repeat itself? I think so.

Artists are so scared if an album under performs these days. WHY? The album sales figures quoted above is not the metric to judge success on. Dream Theater have hardly sold any music in South America, however they play to their biggest crowds there. I wonder how that came to be?

As Nicko McBrain said in Flight 666 The Movie, Iron Maiden hasn’t sold an album in Costa Rica, however they are playing a stadium show that is sold out with 30,000 people attending. Put it down to piracy, file sharing, Bit Torrent or copyright infringement. The bottom line is this, if what you create is great, expect it to be shared.

Before the Internet, before YouTube, before streaming services like Spotify, fans had to own the music to hear it. That is no longer the case. The history of recorded music is at our fingertips. Fans are participating in this new arena, while artists and labels are still banging their heads against the wall judging success by album sales.

Even Mike Portnoy asked fans to buy The Winery Dogs as a show of support to the label and to show to them that this project is viable. Why does he care about sales? Look at all his posts, show after show. He is blown away at the reaction they are getting. Isn’t that the validation he should be seeking?

So here we are in 2013. We have Trivium’s new song Brave This Storm and Dream Theater’s The Enemy Within.

So what is the verdict.

I can’t say that The Enemy Within is anything special. Some bits remind me of Scenes from a Memory, but really, I could see this song fitting on A Dramatic Turn of Events. It is not a great leap forward in musical terms. Let’s hope that the other songs make the “definite statement.”

Hopefully what we heard was their “Commercial” piece for the album, in the same way that Forsaken was seen as the “Commercial” piece in Systematic Chaos. If this new album turns out to just be ADToE part 2, then yeah I’ll be pretty disappointed, and everyone will know what a pivotal role Portnoy played in the band and how directionless they are without him.

On the other hand, I was very cautious as to how the Trivium and David Draiman collaboration would work. From hearing Brave This Storm, I would say they are on a definite winner. The song is heavy, it is a progression from what they started with In Waves, it is all math in the verses and it is very melodic. Let’s hope that the other Trivium songs are not Brave This Storm 1, 2, 3, 4, 5 and so on.

For some reason this got me thinking about a song from Tom Petty and the Heartbreakers called Rebels which is the lead off track on his 1985, Southern Accents album.

Are musicians/artists rebels in 2013? It seems that they all want to be winners. Seen any posts from a musician recently about what they think, what they feel, what they are going to do and it doesn’t relate to selling music. Our heroes are even beholden to the Corporations.

Randy Blythe is one artist that shows his humanity. He uses his photographs and puts stories around them, which always relate to a personal part of his life. We are all human. We win and we lose. Blythe focuses on his work, not the sales pitch.

There is new news every day, so if Dream Theater and Trivium want their story to survive, they need to keep it alive by making news every day
