Recording Industry Dumb and Dumber – The Sequel

So the Recording Industry in Australia is welcoming new anti-piracy legislation. High fives all around for site blocking laws. Add to those Recording Industry high fives, Movie industry high fives and any other legacy content owner.

The question I have is this;

  • With site blocking now becoming law, what does the Recording Industry believe would happen to their businesses profits?
  • Would people suddenly return to buying CD’s?
  • Would people suddenly buy an expensive Foxtel subscription to watch ten episodes of “Game of Thrones”?
  • Would people who normally don’t go to the movies, suddenly start going to the movies?
  • Would people suddenly go out and buy books, or e-books?

Site blocking laws are designed to stop people from accessing websites that film, TV and music companies say are hosting their content without permission. Surely, our government officials would have looked at the U.K before deciding if site-blocking was the right way forward.

In the UK, The Pirate Bay has been blocked since 2012 however people have found ways to get around that block. Even though site blocking laws exist in the U.K, sales of music are still declining. However, if the industry puts more emphasis into their streaming business, then some different results could appear. Lucky for the U.K, they have a lot of popular artists right now and these artists are really pushing the streaming side of their music.

So in return the U.K have more people streaming more music than ever before. By 2019, streaming is expected to account for 49 per cent of music revenue in the U.K, compared to 22 per cent in 2014.

Digital music downloading (both legal and illegal) is a thing of the past. It’s history. Why would we want to pay for an mp3, when the history of music is at our fingertips with streaming and we, the fans, like it.

It’s easy and uncomplicated.

So since streaming is king, can someone tell me why we need the Entertainment Industries going to the courts to block websites based on their own evidence?

I think the catch-cry put out by the government is “the laws will protect the viability and success of creative industries while restricting the profitability of sites that facilitate piracy.”

Yep, Mr Government, as long as you and your financiers know what that means, it’s okay, we believe the shit you say.

I would be interested to see the model they used to show how the laws would protect the creative industries especially since Australia is a huge market for DVD and Blu-ray sales.

How can the entertainment industries explain the HUGE profits they get from DVD/Blu-ray sales in Australia?

Let’s use Game Of Thrones.

The TV show is hidden behind an expensive Pay-tv paywall in Australia. The actual subscriber numbers for that Pay-tv provider are lower than the sale numbers of the DVD/Blu-ray season releases.

Where did all of these extra fans come from?

The content owners need to be talking about lowering their licensing fees so that the monthly streaming plans are cheaper and that all content is available in the one place.

I have a Netflix subscription and a Spotify subscription.

The content industries should be pushing more people to these services. In return, the money pie will get bigger. It’s simply economics. These industries cannot pretend anymore that the old business models are coming back.

Let’s use Game of Thrones for another example.

If HBO wants to stamp out piracy, ensure that the show is available to everyone globally from the one HBO source.

Not from a reseller.

HBO makes, it, so they should sell it, to the people who want to watch it, when they want to watch it. I cannot for the life of me understand why people need to pay another company who paid HBO a fee to re-broadcast it. It’s a business model that is doomed.

Why do you think Netflix started to make their own TV shows?

Hell, why do you think HBO started their own TV shows? Remember, HBO was once a Home Box Office re-broadcaster.

Because re-broadcasting is not a viable business models. Same deal for music streaming services.

Expect Spotify to start to sign bands and really shake up the streaming world.

P.S.T (Piracy, Streaming and Touring)

All the talk in the media from the old gatekeepers is that piracy is bad for the artists or that Spotify’s free music-tier is bad for artists.

So can someone tell me how Motley Crue is playing in Abu Dhabi?

If we lived in the world of the old gatekeepers, the record labels would be in control and Motley Crue would have sold hundreds of thousands of albums (on a consistent basis) in the UAE before it was even considered to tour there.

However, in the internet age, it is a much different world.

Motley Crue suddenly has an audience in the UAE.

Is this audience courtesy of piracy or legit sales or legit streams?

There is a strong indication that Motley Crue’s UAE audience is due to piracy.

Do you know the Middle East is a huge region when it comes to illegal P2P downloading?

The following statement found in the book “Introduction to Private Security” by John Dempsey sums it up perfectly;

In Europe, Middle East, and Australia, P2P traffic consumes anywhere between 49 percent and 89 percent of all Internet traffic in the day. At night, it can spike up to an astonishing 95 percent.

Even though it is from 2011, the data tells us a few things.

Eastern/Central Europe, South America, Asia, Australia and the Middle East have high rates of P2P piracy as regions.

When you break it up to countries, China, Colombia, India, Russia, Malaysia, Turkey, Taiwan, Brazil, Saudi Arabia and Italy lead the way.

So let’s look at some of the recent tours bands have undertaken.

Metallica in 2011 did the “2011 Vacation Tour” that focused on Europe, South America, Asia and for the first time ever, they took in India.

In 2012, Metallica undertook the “European Black Album Tour” that focused solely on Europe.

In 2013, Metallica undertook the “Summer Tour 2013” which took in again Asia, Europe, South America along with North America.

In 2014, Metallica did the “Metallica by Request” tour which again took in Europe and South America.

Is it coincidence or shrewd planning that Metallica has taken in those markets. Hell, India is known as a nation of P2P downloaders, however it hasn’t stopped Metallica or Iron Maiden touring there.

Iron Maiden’s “The Final Frontier” tour (2010/11)  took in Eastern Europe, along with Singapore, Indonesia, Australia, South Korea, Japan, Mexico, Colombia, Peru, Brazil, Argentina, Chile and Puerto Rico.

The “Maiden England World Tour” (2013), took in Mexico, Brazil, Argentina, Paraguay, Chile and Eastern Europe again.

The “Somewhere Back In Time” tour  (2008/09) took in (apart from the North American and European markets) India, Australia, Japan, Mexico, Costa Rica, Colombia, Brazil, Argentina, Chile and Puerto Rico. Then on the second leg it took in Dubai (UAE), New Zealand, India (again), Mexico (again), Costa Rica (again), Venezuela, Colombia (again), Ecuador, Brazil (again), Chile (again), Peru, Argentina (again).

The Bon Jovi “Because We Can” tour from 2013 took in Brazil, Chile, Argentina, South Africa, Mexico, Japan, Australia, China, Malaysia, Singapore, China (again), Abu Dhabi (UAE) and Israel.

This was on top of the normal European and North American markets.

The “Bon Jovi Live” tour set to kick off in September 2015, takes in China, Malaysia, Singapore, Macau, Abu Dhabi (UAE) and Israel.

Five Finger Death Punch haven’t been around as long as Metallica, Iron Maiden or Bon Jovi, however it still hasn’t stopped them from hitting Japan, Singapore, Australia and New Zealand on their recent “Wrong Side Of Heaven” tour.

Avenged Sevenfold’s “Far and Middle East Tour” from 2012, took in Japan, Taiwan, Thailand, Singapore, Philippines, Malaysia and UAE.

Their “Hail To The King” from 2014 took in Brazil, Australia, Mexico, Chile and Argentina on top of the normal European and North American markets.

Their “Asian Tour 2015” will cover China, Taiwan, Thailand, Singapore, Malaysia, South Korea, Indonesia and Hong Kong.

Again the question must be asked, is it coincidence or shrewd planning. Streaming services can tell the bands which countries or even cities are streaming their songs and at what rates. Other firms out there like Music Metrics can tell bands, which countries or even cities are illegally downloading their music.

All of this data, once in the hands of a person that knows what to do with it, is a marketers dream.

Articles always point out that “pirates” are the biggest spenders and after seeing large bands hit markets with high piracy rates and still sell out shows, I would agree with that assertion.

Piracy, Streaming and Touring go hand in hand.

Just Another Day In The World

Game Of Thrones

It looks like Piracy does pay. The sales of DVD/BluRay box sets for Season 4 of “Game Of Thrones” are going crazy. Season 3 also experienced the same craziness.

Meanwhile, an album from 40 years ago is back on the charts. Led Zeppelin, who was so late to the streaming party, is now fighting for a spot on top of the charts due to their fans streaming their music.

So the recording industries response to piracy is to have a global release day on Friday. Hello, its 2015. Every day is a good day to release new music because music when done right doesn’t need a blockbuster opening day. Last week, 36 Crazyfists released their album “Time and Trauma” with first week sales of 3,500.

Yeah, high fives all round. Let’s blame piracy.

Meanwhile, ageing rockers AC/DC moved another 8,000 units as they move closer to 500,000 sales. However, sales of 500,000 does not mean that the record is popular amongst their fans. Does anyone know if it’s continually getting played? It’s not on Spotify so we can’t use any data from there.

Meanwhile, the “Rock Or Bust” clip has over 7 million views on YouTube, while “Play Ball” has over 6 million views. However, if you compare those YouTube views to Slipknot’s “The Devil and I” 26 million plus views, it’s easy to see what fans of rock and metal are listening too.

But hang on a second, the media outlets give ink to the fact that AC/DC has almost sold 500,000 copies of their album, while Slipknot is closer to the 300,000 mark. Further evidence today, that sales don’t equate to the actual popularity of the album. Listening data does.

Sales are old school and they are not coming back. In Norway, piracy is non-existent however revenues from recorded music haven’t increased. Goes to show that people never really wanted to own music, they just wanted access to it.

American Sniper

However if an entertainment product is done right, people will still spend their money. “American Sniper” is a perfect example of that. The movie is all over the piracy sites, and it is also approaching the $500 million mark on Box Office Returns. Compare that to the “The Expendables 3” which bombed big time. One movie hit the mark with the audiences while the other didn’t.

So when something does well, piracy is not mentioned at all as maybe a possible reason for its success, while when something does not do well, piracy is always blamed.

Performing Live

For musicians, piracy is exposure. Machine Head grossed $33,000 for one show in front of 850 Head Cases. If they play 100 shows with the same return, that would mean, they would have grossed $3.3 million. It sure sounds like a decent take home.

On a larger scale, Slash Feat. Myles Kennedy & The Conspirators grossed $316,696 for a show in Dublin.

Music is all about people listening and if we listen and we like it, we will spend our dollars.

Don’t You Just Love What Copyright Has Become?

Remember the original intention of Copyright was to promote learning. It was conceived that if creators of works would have a 14 year monopoly on their creations (with the option to renew for another 14 years provided they were still alive), they had enough incentives to create new works and when the copyright expired on their older works, they would fall into the public domain so that others can use and build on these older works.

200 plus years later, we have a lot of stupidity around in the name of Copyright.

A German based association called, Total Wipes Music Group is using Google’s anti-piracy system to censor everything it doesn’t like. Read the article and be amazed at how Copyright is abused. In order to stop the infringement on an album they own the copyright  for,  Total Wipes Music Group tried to censor a legitimate article on how to download anonymously. Since then, they have targeted legitimate articles from the Electronic Frontiers Foundation (EFF), AVG, Dropbox and Opera, just to name a few. And guess what, not one of those sites listed contained any infringing links or even mentioned the music that Total Wipes Music Group administers or holds the copyrights to. What Total Wipes attempted to do was to censor legitimate articles that provided users with information on downloading and anonymous VPN’s under the disguise of Copyright.

And the laughable thing is that the Group is now claiming that it was a bug in their automated takedown system. Well, I guess that bug just keeps on resurfacing each year.

Then you have a powerful organisation like the MPAA trying to censor a website called Open Culture. Open Culture offers Public Domain movies however according to a takedown notice that the MPAA sent to Google, Open Culture’s list of 700 free public domain movies contains copyright infringing material.

Remember that Copyright’s intent was to promote learning and this was done by ensuring that each country has a rich public domain. Well it looks like in the U.S, the rich wealthy copyright monopolies want to control that as well and put those works back under Copyright protection.

Remember the good old days when the copyright monopolies lobbied hard against radio, television, the introduction of blank cassette tapes and those advertisements that “Home Taping Is Killing the Music Business”, then blank CD’s, then mp3’s and piracy sites. They did that all in the name of the artist. That same artist that they exploited and signed to a deal that was stacked in the favour of the record label.

It’s pretty easy to read between the lines and see that the record labels and their lobby groups did all of this lobbying to protect their business models and to ensure that their copyright monopoly remains in place. And this leads to more lobby groups that want to have a say.

Now we have the Grammy Creators Alliance. On the face of it, they proclaim that they are backed by artists like Steven Tyler and their intention is to lobby Spotify, so that Spotify pays them fairly for their works. However, the organisation is run by agents and managers whose only interest is securing a big pay-day for themselves. Hell, these types of people don’t even create anything of value that people consume, however they now have a voice on copyright disputes because they have money behind them to give them that voice.

For the record Spotify does pay fairly to the Copyright Holders of the works. So maybe this new Alliance should lobby their record label to pay them fairly.

And then on certain occasions you have some excellent innovation that happens when people don’t allow Copyright to influence their creations. iFlix is another torrent client that streams any magnet link in an instant. It’s easy to use, it’s available on Android and it uses material that has been infringed on.

It’s created by a Romanian software engineer. Romania is one of the poorer countries in the EU and it also has the highest rates of software piracy. And from all of this piracy, you wouldn’t believe what happened. It made Romania a powerhouse in software development. Romania now has the most techies in Europe. Google and Microsoft employ a lot of IT workers from Romania. All of this was made possible by infringing on the rights of others.

And going back to iFlix, the ecosystem all came about because the developer was hired to offer a service to parents to watch their kindergarten kids on their mobile.

Saints (Winners) and Sinners (Losers)

WINNER
Machine Head are doing the opposite of what all the other bands are doing. Playing smaller venues, selling them out and doing “An Evening With..” extravaganza. The prices of tickets are affordable and not extravagant. This is one band that realizes their niche place in the metal music business and they play to their core audience, the Headcases.

In Robb Flynn, they have one of the best frontmen in thrash/metal circles that is not afraid to take a stance on an issue. He speaks to his core audience via his journals. He controls his own narrative and not the press, which is the downfall of a lot of other artists.

Flynn, along with Monte Conner from Nuclear Blast have realized that music is all about the souvenirs. The “Killers and Kings” single release for Record Store Day with the four different tarot covers proved once again that if people believe in the artists, they will spend their money. Machine Head weren’t selling music, they were selling collectibles. I purchased all four and I still haven’t opened them.

WINNER
Megadeth. As a guitarist I didn’t really dig Broderick’s uninspired lead breaks so I am pretty happy that he has left. Just because a person is super technical it doesn’t mean they are good songwriters. Seriously put those lead breaks up against the jazzy shred work of Chris Poland, the neo – classical shred metal of Marty Friedman, the tasteful phrasing of Al Pitrelli and the pentatonic chaos of Dave Mustaine and you will see where Broderick stacks up. Drummers are plentiful so I am sure that Megadeth will have no issues here finding one that will suit.

LOSERS
Chris Broderick and Shaun Drover.

The history of guitarists and drummers that have departed Megadeth is vast. The real good ones have had stellar careers pre and post Megadeth. Marty Friedman had a fan base before he joined and then he became a Japanese musical icon post Megadeth. Al Pitrelli also had an established fan base prior to joining and he was already in demand as a session guy and touring guitarist for various projects. Chris Poland did “Damn The Machine” which was an unbelievable album/band that wasn’t embraced by the waves of change that happened to metal in 1993 and Poland’s instrumental album “Return To Metalopolis” was also a favourite back in the day.

WINNER
Streaming. Fans of music didn’t care at all that The Pirate Bay got raided or that Kickass Torrents got taken down. Those raids/takedowns are all pure PR stunts by the associations and a waste of money/legal resources because copyright for the last 15 years has been hijacked and used purely for criminal pursuits and nothing to do with aiding the artist.

LOSERS
Artists and entities that compare the streaming dollars earned today to those pre 1999 sales dollars without understanding that streaming is all about scale. The more people using the platform, the higher the payments will be in the future. But no one can look that far, when everyone thinks about “right now”. The ones complaining about streaming royalties just don’t have enough fans interested in listening to their music consistently.

WINNER
Slash. He has shown that he is more Guns N Roses than Axl Rose is. His output has been solid via his many projects, like Slash’s Snakepit, Velvet Revolver, Slash (the guest vocalist album) and now Slash featuring Myles Kennedy and The Conspirators. He is doing what every other musician should be doing, which is releasing product and touring.

LOSER
Duff McKagan. His views on piracy/copyright infringement are restricting him from doing what he needs to do, which is, to create music.

WINNER
Dee Snider. His views on Doug Aldrich are spot on.

LOSER
Doug Aldrich. He’s a good guitar player but nowhere in the league of the Eighties guitarist he was competing against when he was with “Lion”. For the years he has been involved in music, there is not one definitive song/riff that can be attributed to Doug Aldrich.

WINNER
Data. The era of feeling it or rorting the charts is over. It’s all about the fans and what they listen too.

LOSER
Sales. Just because Spotify is killing off piracy, it doesn’t mean that people will start to buy physical CD’s, vinyls or pay to download MP3’s again. Seriously there is a lot of rubbish reporting out there stating something like “sales are worse now since Spotify has entered the market”. Well, hello genius, Spotify and streaming for that matter are also competing with sales.

WINNER
George Lynch. He realizes it’s all about the music and without making new music, he has no career. That’s why people come back. Lynch Mob, his solo career, KXM, Sweet and Lynch and now the announcement of a new project called “The Infidels” which is another pseudo-supergroup.

LOSER
Don Dokken. Without the involvement of Lynch and Pilson in the songwriting department, the band Dokken is a shadow of its former self.

WINNER
Indegoot Entertainment. They have a roster of bands that make up a very large portion of the U.S Hard Rock market, that have proven to be consistent sellers in a recorded music sales market that is contracting instead of expanding. Shinedown, In This Moment, Halestorm, Chevelle, Adelitas Way, Black Stone Cherry, Theory of A Deadman and Story of The Year.

Rock is far from dead when you have rock artists like these. And with a good roster of talent comes power on the live circuit. That is why Indegoot is a winner.

LOSER
Any metal or rock band that is spending months upon months creating their new album and being out of the public consciousness. The modern way is to be in our head space every day. If an artist today takes a break then they are on their way to being forgotten. And you don’t want to be in the news if it is not about your music. No one can forget what their core business is.

Slipknot took almost seven years to release their new album, only to have “The Devil In I” rack up 9.6 million streams. What about the other songs?

Yngwie Malmsteen has delivered a lot of dud albums in the last ten years and he still takes his time before issuing the next one.

WHY?

You would think after one crap album, he would get going with delivering a better song quickly to make amends. Malmsteen can be doing much more to keep in touch with his fan base which doesn’t revolve around issuing ten to twelve songs every two years under his own name.

Take a leaf out of George Lynch’s or Michael Sweets or Marc Tremonit’s or Russell Allen’s playbook.

WINNER
Kevin Churko. Everyone wants to work with him. He is the modern-day version of Tom Werman or Keith Olsen. Five Finger Death Punch, In This Moment, Hellyeah, Papa Roach are all bands that have used the might Churko as producer and on some occasions as songwriter. If you want to use sales as a statistic of reach, then bands produced by Kevin Churko are some of the best sellers in the genre.

LOSER
EVH.

My EVH Peavey 5150 Combo that I purchased back in 1995 is still my favourite amp to record with. So it is a shame that the greatest and most innovative guitarist cannot get it together to deliver new music worthy of his stature. Reading Sammy Hagar’s bio recently cemented my views on EVH who has become a person that is so out of touch with reality and a victim of his own vices. His future without any doubt is with Sammy Hagar as the front man.
WINNER
Allen Kovac’s move from management to the label business has paid off. Eleven Seven Music is another label doing their bit in bringing hard rock back to the masses. Artists involve Hellyeah, Mötley Crüe, Papa Roach, Pop Evil, Sixx:A.M, Nothing More, Art Of Dying, Apocalyptica, Escape The Fate and Drowning Pool.

LOSER
AC/DC without Malcolm Young have lost their foundation. Don’t get me wrong, I love AC/DC and always will. They will make a killing on the live circuit however no one cares for their new music. On top of all that their views about withholding their music from certain digital outlets (while it is available for free on pirate sites) shows how out of touch they are. They are leaving money on the table.

WINNER
Marc Tremonti. He showed the world that he was the brains and driving force behind Creed. He kept his career going with Alter Bridge. He started his own solo band. He went away and mastered the art of shred. His PRS guitars are state of the art and brilliant to play. Trust me on that one as I have one. The PRS through the 5150 is the perfect sound for me.

LOSER
Metallica. They are trying to replicate the corporate deals of U2 and the product saturation of Kiss. This in turn leaves the hard-core fan base squeamish. Meanwhile it has been seven years since they released “Death Magnetic” and music is the very reason why Metallica is in the powerful position they are in right now. However it seems they have forgotten that part of their career. “Lords Of Summer” will most probably be turned into a totally different song however if it doesn’t, then it doesn’t bode well for Metallica as they sit down to write the next album.

Trying Something New and Creative To Engage With Fans

This whole buying shares in a song has been going around for decades, especially in the heyday of record label monopolies. The basic premise at that time was that people would buy shares in a song and then any earnings the song makes goes back to the shareholders.

Fast forward to today and Testament is offering up a chance for the fans to purchase shares in the song “Native Blood”. If they sell every single offering they will have raised $57,000 in capital.

However, while the offering is promoted like a Company IPO Share Offer, it is nothing of the sort. It’s all smoke and mirrors. The fans of the band are buying memorabilia. The band is using the connection that a fan might have with the song as its selling point. Being a shareholder on the “Native Blood” song will not entitle you to any royalty payments (provided that a thrash band with a cult status who make their money from touring would get any) however it will give you a chance to buy limited edition merchandise later on.

An artist music and career is a brand and brands aren’t built in a day. Testament has been at for a while. In the beginning they had some growth initially however that didn’t mean that they made it. Music is a competitive industry and consumers are becoming harder to reach. Every business brand is faced with the same problem. Bands and artist are no different to small businesses.

The difference is if the artist is NOT prepared to find creative ways to reach their fans than complacency will bring about the end. So Testament is trying new creative ways to engage with fans, but it’s still based on the one way model of selling something. But by always going back to the old product selling paradigm is precisely the way to go out of business today.

Markets are always changing and fans of music are always changing. What we value as important is changing and what we want to own is changing. I grew up with the focus to have a house and a car. My kids are growing up with the focus to have the latest tech and live at home.

The fans of music spoke out loud with Napster 15 years ago.

WE WANT ACCESS TO MUSIC.

And what does the recording industry and bands do? They fail to keep pace with the changing demands, values and needs of their fans. They chose to hang onto the past and in 2014 they are left wondering where their fans and profits went.

If we want more proof about the sales model for music slowly fading, look no further than all the MP3 stores that are either being killed off or reporting losses. In Australia, BigPond music was operated by our largest ISP, Telstra and they have now shut it down, focusing on MOG, their streaming service which is trying to compete against Spotify. They get it, consumer behaviour is changing, and Spotify has led the way in providing a service that responds to this shift and has had much success doing so to date.

For bands and artists to prosper they need to do things differently. They need to be genuine and willing to connect with their fans. The fans in the end want transparency, not smoke and mirrors. James Hetfield might cringe at the “Some Kind Of Monster” documentary, however that visual and transparent footage of a massive act breaking apart was touching and moving. Hell, there are people at Metallica shows today that have never purchased a Metallica album.

The value of the recorded music product is not the value that it once was. What is valuable is the service and the partnership. That is why we are living in the era of sharing and access. Sharing provided the service that the fans of music wanted. Which was access all along.

And when will artists learn that partnerships are absolutely key to ensure sustainable growth. If small businesses do it, why can’t artists do it. But everybody lives by selling something. So even though I don’t agree with Testament’s song share plan offer and the lack of transparency around it, they are trying something different which for a metal band that goes back into the era of Eighties is good to see.

Piracy, Lost Sales and Profits

I am sure that everyone has come across the “Minecraft” game in some form or way. My exposure to this game was when my kids asked me last year if they are allowed to download the free version of the game, which I agreed. After playing it for months and unable to save their progress, they kept on asking me to download the full version, which cost $6.99AU.

I said NO.

They kept on playing the game and as they did new features kept on getting added to the game that made it better. However they still couldn’t save their progress and they kept on asking me to allow them to download the full version.

Eventually after a stellar week of good behaviour I couldn’t say NO to them and they got the full version at the beginning of the year.

For the uninitiated, Minecraft is one of the biggest games in the world right now. It debuted on Mac and Windows PC in May 2009. By February, 2014, it had sold 15 million copies of the PC version. Also in the same month, Mojang (the makers of Minecraft) had sold more than 21 million copies of Minecraft: Pocket Edition on Android and iOS; more than 12 million copies of the Xbox 360 Edition; and more than 1.5 million copies of the PlayStation 3 Edition — making for a sum very close to the 50 million mark. They have over 100 million registered users.

Just imagine if a streaming service had those numbers. However, the argument would still be the same. Artists are not getting paid. We all know why this is so. Talk to your record label.

And they did all of this with piracy being rampant on the game. However, Minecraft’s developer Notch (Markus Persson) has been on record in saying that worrying about piracy was a waste of time, and it was much more important to focus on giving people a reason to buy.

“Piracy is not theft. If you steal a car, the original is lost. If you copy a game, there are simply more of them in the world. If you just make your game and keep adding to it, the people who copyright infringed would buy it the next week.”

Persson adds features to the game based on conversations he has on Twitter with random people and he fixes bugs based on the Minecraft community voting on the priorities. He is engaging with the users and a majority of those users are people who said that they copied the game initially, but then bought a copy for both themselves and a friend. Or they are people who didn’t ever buy a copy, but had friends who learned about it through them who then went on to buy copies.

There is a clear indicator here for any artist.

Make sure that everyone has access to your music.

I remember a time when I went to Utopia Records and I purchased four CD’s. They were “Subhuman Race” from Skid Row, “It’s Five O’Clock Somewhere” from Slash’s Snakepit, “Balance” from Van Halen and “Waiting For The Punchline” from Extreme. I hand over my cash and a sale goes onto their chart record.

The fact that “Subhuman Race” and “Waiting For The Punchline” gathered dust on the shelves, while I played the hell out of “Balance” and “It’s Five O’Clock Somewhere” didn’t even come into the equation. All of those bands got a “SALE” or a “COUNT” from me. The fact that two albums connected with me more than the other didn’t even come into the equation. Probably the reason why SLASH is still such a force to be reckoned with in the music business, while Skid Row and Extreme, not so much.

That is why a lot of the Eighties bands couldn’t understand or get a handle on their decline in popularity. Everything under the sun got blamed, however the real reason was ignored.

WHAT DOES A SALE OF A PIECE OF PLASTIC/VINYL REALLY MEAN?

Everyone saw a sale as a fan number, a unit to add up, however the fact that the real fans listened to the music non stop and due to playing it to death they had to re-purchase the album.

In my music collection, anyone will see that for bands like Motley Crue, Dokken, Megadeth, Van Halen, Ozzy Osbourne, Metallica, Twisted Sister, Bon Jovi, Whitesnake, Stryper, Ratt and many more, that I would have an LP, plus a CD, plus for a select few, remastered releases and remastered releases with bonus tracks. That means that I have re-purchased the bands whole catalogue over 4 times. And I am sure I am not alone in that.

In other words, a sale of an album never reflected what we (the fans of music) did with the albums after we purchased them. The second-hand music market thrived for a reason as music consumers got rid of those albums that gathered dust. However, was this stat shown.

But what about all the tons of money, lawsuits, lobbying, education campaigns, advertising, threats, news reports and the like from the recording industry, all telling people who unauthorized downloading was unquestionably morally wrong and that each download is a lost sale.

The developers of Minecraft (who struck even bigger when they got acquired by Microsoft in 2014) showed that you can compete with free and that you can get people to commit if you focus on the art. Making money was always a byproduct and in the end they made a bunch of it.

Music Is Art, However The Price Point For That Art Ranges from $0 to ????? For Each Fan

The tech industry is excited about the music industry in the current day while others see it as a bad time for artists.

Which side is right or wrong is for another post. What I am getting out of it all are two very different arguments and experiences.

The techies see opportunities on a grand scale. They have introduced new revenue streams into the recording industry that did not exist previously due to the way fans started to accessed/get their music online.

The techies celebrate that they have created a direct to fan connection for the artists. People can now participate in the recording industry that previously couldn’t. Artists don’t need a record label however it can be argued that without the record label machine the artist more or less remains part of a niche. Their music can be up on all digital outlets without the need of a record label.

However, the artists, see a decline in revenue. I am sure everyone has heard the following comments;

“We made good money selling CD’s” or “Our music is worth nothing because of streaming” or “Music is art, and art is important and rare. Important, rare things are valuable. Valuable things should be paid for.” The last one is from Taylor Swift in her Wall Street Journal Op-Ed.

Spotify is talking about competing and killing off piracy. Spotify is talking about adding a monetary value to the recording industry that was not there before. At no point do they state that Spotify is a substitute for selling CDs.

“Piracy doesn’t pay artists a penny – nothing, zilch, zero. Spotify has paid more than two billion dollars to labels, publishers and collecting societies for distribution to songwriters and recording artists.” Yep, that is what Daniel Ek said in his blog post response to Taylor Swift.

So what we have is the recording industry and misguided artists thinking about the “loss” and they keep doing what they did before which in the long run would end up hurting them more. What they forget is that without the public and the fans, they have no industry. So, yes I agree that music is art, however the price of that art differs from person to person and if an artist cannot cover all different price points then they are failing to service their customers/fans.

Seriously we are 15 years after Napster changed the rules of the game and we are still having the same conversation. The recording industry and misguided artists want us all to buy CDs again.

FAN: “But we only like one track.”
MISGUIDED ARTIST: “I’m sorry, but music is art, and art is important and rare. Important, rare things are valuable. Valuable things should be paid for, so hand over your one of payment of $10.”
FAN: “But I don’t want the whole album.”
MISGUIDED ARTIST: “How do you expect me to make a living if you don’t buy my CD’s. You fans are killing the music industry and the artists by not supporting us.”
FAN: “But I don’t want to own music, I want access to it. And all I am trying to change is the recording industry viewpoints. ”
MISGUIDED ARTIST: “I put my blood, sweat and tears into making this music and its important and rare and since rare things are valuable, you WILL pay for it.”
FAN: “No thanks, I will go elsewhere.”
MISGUIDED ARTIST: “But, wait a minute, I have my own download store available where I am selling MP3’s”.
FAN: “Are you serious, Apple stopped making the iPod and you are still pushing MP3’s.”
MISGUIDED ARTIST: “But”
FAN: “What stuns me is that you have failed to see that the game has changed. The past is gone, it is never coming back. You want me to buy CD’s and Apple doesn’t even have a CD/DVD/BluRay Drive on any of their computers. You want me to buy MP3’s when all I want to do is listen. No one wakes up in the morning and goes to themselves, gee, I wish I bought an MP3 or a CD today. We wake up in the morning thinking, gee, I would love to hear “King Of Errors” from Evergrey.”
MISGUIDED ARTIST: “But music is art, and art is important and rare. Important, rare things are valuable. Valuable things should be paid for.”
FAN: “Your job as a musician is to make music.”

The New World

The new world is hard. I don’t know about you, but I just cant figure it out. We all complain that no one is asking hard questions for fear of being left outside alone and then when we get into a similar position we also succumb to those vices. It’s like we sell out our ideals to go mainstream.

But is anybody paying attention?

Did you see that Sixx AM put out a new album? They did something with iHeart Radio and the usual press interviews. But is anyone really paying attention. The youngsters have so much going on, they sit out unless it crosses over. And for the old Motley Crue fans, well albums require so much dedication of our time that unless it’s great and everyone is talking about it, we all just move along. “Modern Vintage” is a good album. For the record if I had to rate them, then the order the albums came out in is the way I would rate them.

And the tour will be a success, because the Crue fans have shown that they love to watch a live show more than buying an album. So expect Sixx AM to do well on the live circuit.

And just when you think that no one is paying attention, you hear that Shinedown chalked up another certification to their arsenal. While debates can be had on sales and certifications, what is impressive is that they kept on selling while out of the mainstream press. What is impressive is that they kept on selling while all of their music was available on Spotify, The Pirate Bay, Pandora, YouTube and so on.

Which goes to support what I have been saying all along?

The fans are the ones that make or break you.

For some artists, a thousand hard core fans is enough incentive to keep on making music, while for others it’s not. But you need to know where they are and you need to connect with them. In Shinedown’s example that connection happened when they asked their fans what songs they would like to see the band cover acoustically.

While no one seems to be paying attention to all the music coming out, it looks like streaming services are in a league of their own. Each day brings about another story on streaming services. In my view streaming services are the solution, not the enemy.

Spotify was always designed to compete with piracy, to monetise those users that pirated and it’s doing a pretty good job at it. They have put some serious money back into the recording industry. Prior to Spotify, the recording labels got nothing. It’s just a shame that those same labels don’t feed those monies back to their artists. Because if wasn’t for the artists the recording labels would not be in the position of power they are in right now.

But, as with everything, there are still misguided artists and labels who keep blaming theft and all kinds of bogeymen for their reduced sales. Take Spotify, YouTube and Pandora out of the industry and then what kind of state will we have. If they think that everyone is going to start buying CD’s again then they must think that the telegram will return.

But they fail to notice that we the fans have a) other interests, b) don’t like what they put out or only want the best, which means we cherry pick, c) don’t care about what they’re talking about or d) like to exercise choice.

It looks like people know “Shepherd Of Fire” and “Hail To The King” and don’t care much about the rest of Avenged Sevenfold’s album. And Five Finger Death Punch released a double album, but it looks like the fans care about a few select songs like “Lift Me Up”, “The Wrong Side Of Heaven”, “Watch It Bleed” and “Battleborn”. Which is a shame as those albums do have a lot of other good songs that deserve attention.

But that is the new world.

Everyone Is Trying To Twist The Narrative To Their Own Advantage.

So Desmond Child is telling the world that Jon Bon Jovi, Richie Sambora and himself had to split a total of $110 in 2012 for the 6.5 million streams of Bon Jovi’s “Livin’ on a Prayer” on Pandora during a three-month span in 2012. Pandora’s published rate is about .0013 cents per stream. So doing the math, that means that “Livin On A Prayer” actually earned $8,450 for that three-month spell on Pandora. If that is true, that means that the songwriters are getting about 1.3% of the monies paid to the record labels.

Daniel Ek claims that Spotify will pay $6 million to Taylor Swift from worldwide streams. Swift’s label, claims that is a lie and that they received less than $500,000 for the streams. However what the label is forgetting to say is that the amount is for US streams only.

And Spotify argues that it is competing with free/piracy, while the artists side argue about Spotify not paying enough. They are two different arguments that have no correlation with each other whatsoever. When are people going to realise that Spotify doesn’t sell music, it provides access to it. And consumers like it, otherwise Spotify wouldn’t be starting to overtake iTunes in some markets.

Rob Zombie once upon a time hated copyright infringement and now he reckons it makes him more creative as he doesn’t have to write songs that fit a sales metric.

Lars Ulrich is now reserved and diplomatic in his responses to music piracy or copyright infringement. Maybe it is because he knows that if it wasn’t for music piracy, Metallica wouldn’t be playing sold out shows in China or the Middle East and some South East Asian countries.

Scott Ian wanted the people who downloaded the “Worship Music” album to be disconnected from the internet, even though they could have been fans who ended up purchasing a concert ticket and an over-priced T-shirt.

Gene Simmons famously said that downloaders/fans should be sued and also have their houses taken from them. He said that rock is dead because of piracy. Yngwie Malmsteen, Paul Stanley, Joe Perry and others agreed with him. Many others didn’t.

Internet Radio station Sirius XM is going to lose its case over pre-1972 sound recordings by the band The Turtles. The shameful part here is that the recording industry fought hard against making pre-1972 recordings fought hard against this. The hypocrisy here is huge. While the recording industry has fought so hard against making pre-1972 sound recordings subject to federal copyright laws, now they suddenly want aspects of federal copyright law (like public performance rights which did not exist under previous laws) to apply to those very same works. If Congress made it so those works were under federal copyright, there wouldn’t be an issue and all these works would be treated identically. But the truth is that the RIAA wants to keep these works out of federal copyright law to use them as a weapon against internet innovation.

Sony is re-evaluating it’s support for free streaming, however as a part owner of Spotify, I find it hard to believe that they will pull their catalogue from the free-tier.

Everyone is trying to twist the narrative to their own advantage.

Everybody has an angle.

And what about the musicians.

The hardest challenge facing musicians is getting people to listen to their new music and then getting them to stick around once the album because those big marketing awareness campaigns are goneski. It’s proven that they don’t work if the music is shit and the narrative is shit.
