It’s Always Been About The Songs

It is pretty well-known how long and hard Twisted Sister worked at getting their sound and image out to the masses. It is also pretty well-known how short their fame was in the Eighties and how quickly they faded from the conversation.

You see, the biggest untold story in music is that when an artist hits a high with one album/song, it doesn’t mean that the next album/song will also hit that same high.

“Stay Hungry” sold over 2 million copies when “Come Out And Play” was released in 1985. At that point in time, “Under The Blade” was still selling, “You Can’t Stop Rock ‘N’ Roll” was still selling and so was “Stay Hungry”. Because when an album crosses over into the mainstream, the back catalogue of the artists suddenly become popular.

Then a new album drops and suddenly the sales are not as high as the previous album. It doesn’t mean the band is not famous or popular anymore, it just meant that a re-adjustment was going on with the fans.

A lot of fans were still digesting the back catalogue and a lot of fans moved on to the next flavour of the year.

So instead of Twisted Sister’s management team booking a normal theatre and shed tour, they booked an arena tour for “Come Out And Play”. And when the arena shows failed to sell out, the tour got canned which cost the band money. The merchandise agreement for the tour became null and void which cost the band money.

“The reality is that rock and roll, in the mainstream, it’s in a difficult place right now. People don’t buy music, and they certainly don’t buy rock bands’ music in the way that they used to. And so, for our genre, it’s kind of… We’re limping along when it comes to public appeal. I believe that rock and roll is alive and well. I just think that people need to show their support and let the genre keep thriving.”

People never wanted to buy music. I know I never did. I wanted to listen to music. However, corporations got involved with music, and a big business was born from it. Guess how many records Kiss sold from their first album, before they started to record their second album.

If you answered 70,000 units, then you are correct. If you don’t believe me, read Paul Stanley’s “Face The Music”. Metallica’s “Kill Em All” didn’t set any sales records when it came out either. Nine months after the album’s release, Metallica went back into the studio to record “Ride The Lightning”.

But today, bands want instant success. They want their first album to sell like Metallica’s “Black” album or Bon Jovi’s “Slippery When Wet”.

“Metal was really strong in the 80s and kind of had hard times in the 90s. I think we treaded water and kept alive and kept focused on being Testament, and writing songs that we wrote without thinking or trying to change and play with what’s current at the time. It really hurt a lot of bands trying to do that. Fortunately, we didn’t do that. We went opposite. We went a little darker and heavier at that time. Then the metal got healthy again, and coming out the other end, we were in the right spot with the direction we were going, and the history we had, it just carried through. Metal has been real strong since the early 2000s. It’s been gradually picking up. I see the generation changing with a lot more younger fans coming to shows now over the last ten years.”

The crux of longevity is the replenishing of your fan base, year after year. And you do that by being in the game. Each album release will do some of the following;

  • Pick up new fans and keep all of the old fans
  • Pick up new fans and lose some of the old fans
  • Pick up new fans and lose all of the old fans
  • Keep all of the old fans
  • Lose some of the old fans

It’s just the way it is. You see for me, I lost interest in Testament after Alex Skolnick left. My cousin Mega, still purchased their albums, I heard them and forgot them. It was just part of getting older. Musical tastes changed for a while. That is why in 2015, my music collection has everything from folk, blues, classic rock, metal, hard rock, glam rock, thrash metal, death metal, metalcore, progressive rock, etc…

So in 2015, the album is just not as important as it was once was. With streaming it is all about the songs. For all the artists that complain about sales, the truth is if you’re popular, people want to listen to your music and they want more of it, if it is good. My kids don’t even care if the songs all came from the same album.

Today, the artists get paid every time we listen.

Elektra sold Metallica’s self-titled album and the band only got paid once for the sale. Today, Metallica is cleaning up, as fans are streaming their tracks over and over again. They are getting paid continuously. And right now payments are low, but they will grow as more people subscribe. And if we are listening to our favourites music, they will get paid forever.

So it all comes down to listens and good songs have a long listening life, a long time to make money.

And it’s always been about good songs.

Metallica did not break big until “Enter Sandman” crossed over. Twisted Sister did not break big until “We’re Not Gonna Take It” crossed over.

We all want more if the artists are great and the hard truth is that very few are.

It’s “2015 Chaos AD” and People Are Seeking Filters

A common question today is “How do musicians make money?”

Depending on which side of the argument you are, you either focus on the positives of today’s music market or on the negatives of today’s music market. Artists like Paul Stanley, Yngwie Malmsteen, Joe Perry, Scott Ian, Gene Simmons and Kirk Hammett focus on the headlines that read;

  • Album sales are down
  • iTunes single downloads are down
  • Streaming services are decimating artists incomes
  • Technology and the internet has killed the rock star

But it’s not gloom and doom. The old ways are not coming back. You don’t see people going back to dial up internet, three TV channels and landline telephones. So why do you expect them to start buying albums again on vinyl and plastic.

So what do artists do?

Well you can complain like others for the old ways to come back or you can look at new ways and models to increase your brand and exposure.

In the link, there is a story about Linkin Park. In 2013, they decided that they needed to change their business model to accommodate the changing recorded music market. They restructured their organisation to run like a tech start-up. They parted ways with outside management and brought everything in-house

Prior to that they released music consistently, did video games, art and they licensed their grassroots marketing service to other bands, film studios, TV stations and brands.

They studied other successful artists who diversified. They studied other brands from different markets. They formed a new strategy where creating and selling music plays a supporting role instead of being the main role.

So what about someone just starting off?

A lot of people would say “Linkin Park is huge so they have the power to do things differently.” Read the article. Everything that they have going for them started with the team that was assembled to pack and send CD’s before they made it big.

For anyone starting off, the product is first. If you have no product, you have no publicity. And publicity comes from word of mouth. It’s 2015 Chaos AD and people are seeking filters. And the cold hard truth is that in order to be heard above the noise, you still need someone to promote you and your product.

I remember reading an article about word of mouth and it stated that Google, Facebook and Amazon grew because of word of mouth. Motley Crue and even Metallica had people spreading the word for them. And people will always listen to their friends.

Look at “Phish”. Their business thrives without any media attention and their career is decades deep.

And for the ones whinging about streaming profits, the goal is to get people to stream for years. Instant payola is gone.

There is another story over at the Times called “The Creative Apocalypse That Wasn’t”.

The article states, creative artists are thriving “in complicated and unexpected ways.”

Remember the words of Lars Ulrich on July 11, 2000, in front of the Senate Judiciary Committee,

‘‘We typically employ a record producer, recording engineers, programmers, assistants and, occasionally, other musicians. We rent time for months at recording studios, which are owned by small-­business men who have risked their own capital to buy, maintain and constantly upgrade very expensive equipment and facilities. Our record releases are supported by hundreds of record companies’ employees and provide programming for numerous radio and television stations. … It’s clear, then, that if music is free for downloading, the music industry is not viable. All the jobs I just talked about will be lost, and the diverse voices of the artists will disappear.’’

So 15 years have passed.

Have artists disappeared? NO

Has the music industry died? NO

But what we have are artists using a business model from the 1950’s. Spend time in a studio, record an albums worth of songs and release it. Hope that it penetrates the market and you go on a continuous victory lap celebrating the fact.

Look at any band in the history of music and they all have the definitive crossover album.

Bon Jovi has “Slippery When Wet”, Led Zeppelin has “IV”, Metallica has the “Black” album, Motley Crue has “Dr Feelgood”, Judas Priest has “Screaming For Vengeance”, Eagles have “Hotel California”, AC/DC has “Back In Black”, Kiss has “Destroyer”, Poison has “Open Up and Say Ahh..” and so on. You get the hint.

What we do know is that any record that gains traction will last longer than ever before in the current climate.

Metallica spent close to 18 months on the “Black” album and over a million dollars on it. Depending on which side of the debate you are on, it was either totally worth it or not worth it. From a band perspective, it was totally worth it. The “Black” album explosion also increased awareness in their back catalogue, which if you read my posts, you will note that even in 2015, “Master Of Puppets” is outselling the “Black” album.

But do the fans of 205 want their favourite artists to spend so much time out of the market?

While artists complain about technology changing their income streams from sales of recorded music, they seem to forget that technology has also changed the cost of recording an album/song?

If your main gig is to write songs for others, then we will be hearing your depressing stories in the press, unless you’re a Max Martin. However, if you like to play live, then the new world is for you. It’s simply economics. Recorded music is a product and performing live is also a product. Once upon a time both products were limited. Now recorded music is in infinite supply and live music is still limited. So when one product experiences a price decline, the other product which is limited, experiences an increase.

We don’t care about the corporations when it comes to music. We care about the music and the artist?

And it is unfortunate that the corporations attached the sales metric of record music as f fans caring for artists. So of course, if sales are reduced and music is illegally obtained, the same corporations with some dumb artists toe the line that fans don’t care. However, the fans do care, they just show it in different ways. But the same corporations don’t know how to make sense of the data and the artists are too poor or too far down the chain to obtain any substantial data.

Maybe that is why the direct to fan relationship has become such a focus lately. It means a leaner artist with less handlers. As the Times article states, more people are involved in music today than the glory years of the Nineties.

They are just doing it very different to what artists of yesteryear did.

INTERESTING: In A World Of Free, Metal and Rock Music Still Continues To Sell

There is a great article over at the Metal Insider website.

If you are too lazy to click on the link, the article covers the biggest selling metal and rock albums for 2015.

From the results, it’s pretty obvious that metal and rock fans like to purchase music. There is still a collectors mindset there. What’s even more fascinating is that a lot of the albums that have sold a decent amount in 2015 were not even released in 2015.

NOTE: The figures are based on U.S sales.

“Master of Puppets” was released in 1986 and in 2015 it sold 107,800 units. The self-titled “Metallica” album released in 1991 has sold another 77,100 units in 2015. It is well on its way to 17 million units sold in total.

Now think about for a second.

All of Metallica’s music is available on streaming services for paid subscriptions and for free. All of their music is available for downloading via legal options and illegal options. And they still continue to sell.

A band’s longevity is based around the need to replenish their fan base year after year. If you are not doing that then expect to play smaller venues. Dokken and Ratt are two bands that come to mind who haven’t replenished their fan bases from the Eighties. Both bands in the Eighties had platinum sales and played arenas. Today, they have almost no sales and play clubs.  Of course, not having the main creative forces in the current version of the band plays a part, however, even if Lynch and Pilson or Pearcy and Croucier did rejoin Dokken and Ratt respectively, it doesn’t mean that millions of people would be interested.

Metallica,  however is doing a good job at replenishing their fan base based on their selected live performances in new markets and in markets that have high rates of piracy.  They basically have a whole new generation of music fans who more or less consumed the music of Metallica for free and in most cases illegally. However, that still hasn’t stopped them from selling music and concert tickets.

As business people, the move to their own label “Blackened Recordings” was a no-brainer.

The record is how it all starts. It hooks the audience in. Anyone born in the Nineties, will know Metallica as the conformist poster artist for the labels in the Napster case. Anyone born in the Seventies and early Eighties know Metallica as a non-conformist band that pushed boundaries.

The whole Napster kerfuffle in the end just showed why it was not a good idea for Metallica to get in the way of people experiencing their music. However, they have learnt that by making their music available everywhere, they see better returns in other areas.

As an artist, it is a privilege for people to listen to your music. Respect that.

“Back In Black” from AC/DC was released in 1980. In 2015 so far, it has sold 110,000 units in the U.S.  The new album, “Rock Or Bust”, released in 2014, has sold 143,400 units in 2015.  Put it down to the band being on the road and building awareness of the new album. It just goes to show that the blanket marketing campaigns before the album release date, the Grammy appearance and all of the other medical issues/jail issues in the media meant nothing in 2015.

You see, when the music eco system was controlled by the record labels, the marketing blitz by the labels meant something. In 2015, it means nothing.

From the 2015 releases, Breaking Benjamin’s “Dark Before Dawn” has sold 209,000 units so far, Marilyn Manson’s “The Pale Emperor” has sold 124,200 units so far and Halestorm’s “Into The Wild Life” has sold 114,500 units so far.

From the 2014 releases, Foo Fighters “Sonic Highways” album has sold 87,800 in 2015, for total sales in 480,000 so far. Slipknot’s “5: The Gray Chapter” has sold 84,000 units in 2015, for total sales of 344,000 units. Nickelback’s “No Fixed Address” album has sold 101,000 units in 2015. Like the Foo Fighters it is approaching Gold status.

Led Zeppelin continues to be a selling machine, so why would they create new music when Copyright grants them and the owners of their songs, rights for the next 110 years to exploit the works.

In case you are wondering “Led Zeppelin 4” sold 75,000 units and “Physical Graffiti” sold 112,400 units in 2015.

Kid Rock’s debut “Devil Without A Cause” is still selling. For 2015 alone, it has moved 86,000 units. Add that to the other 10 million units it has sold so far.

So what is all of the above telling us.

Eventually people will pay, however if a piece of music that people want to check out is not available for free, they will turn away until it becomes convenient. Don’t expect people to pay just because you want them too.

And for all of those critics saying the new bands cannot attain the same level of success as their Seventies and Eighties counterparts, well have a look at some other stats.

 

As influential as Black Sabbath was to metal music, they are being outsold by Linkin Park, Korn and even Limp Bizkit.

Also for all of Gene Simmons and Paul Stanley’s comments about rock being dead because no one is buying recorded music, well, Kiss has never really been a big seller of recorded music anyway. Their 21 million is pretty tame compared to Metallica’s 62 million. In the end, the live show is where it’s at. Deliver there and make that show a cultural event, the sky is the limit.

In Copyright Corporations Trust

I have a Google Alert set up called “Copyright Music”. Each day, I get five to ten alerts about Copyright stories.

Let’s not kid ourselves about Copyright in 2015. It is a monopoly that is controlled by greedy corporations who contribute nothing of value to the public domain or to the music industry.

A lost Beatles concert film from February 1964 (51 years ago) has been stopped from getting released because Sony and Apple Corps (The Beatles label) took the film makers to court screaming copyright breaches.

The breach is due to the film containing eight songs out of twelve that are still under Copyright.

So who is Copyright benefiting here?

You need to remember that it was due to a lack of copyright on standard blues and folk classics that benefited the British Rock invasion in the Sixties and Seventies. I can tell you that between 1955 and 1975, no song recorded 51 years ago, in other words from 1904 to 1924 was still under copyright. And look at the music we got.

It is due to copyrights expiring that we have a song from the 19th-century by a little known guitarist called Francisco Tartego now known as “The ‘Nokia tune”.

Who knew back in the 19th century that when he wrote the song called “Gran Vals” would end up being one of the most-played songs in music history.

So what we have here is a situation where corporations who hold the copyrights to old songs, fighting tooth and nail to keep these copyrights. And these greedy corporations are changing laws to suit their business models.

Copyright exists to create incentives for artists to make new works. Extending the rights for recordings made in the 1970s and earlier doesn’t encourage new music. At best, it might generate some income for the small number of “oldies” labels and rights holders whose recordings still have commercial value.

There is no greater Copyright sin than the case against Men At Work. The band lost a court case in 2010 because a judge found that a 10 second flute riff in the 1981 song “Down Under” copied parts of a song called “Kookaburra Sits in the Old Gumtree” from 1934.

As the article states;

“Kookaburra is a simple, four-bar tune. Men at Work were found liable for copying two of these bars. The Court found that this copying was sufficient to award Larrikin Music Publishing – the current owners of Kookaburra Sits in the Old Gumtree – 5% of Down Under’s royalties from 2002 onwards.”

The disconnect here is that people/company who didn’t even write the song “Kookaburra Sits In The Old Gumtree” suing the Men At Work writers almost 30 years after the release of their song and 67 years after the “Kookaburra” song was released.

So who is Copyright benefiting here?

Remember copyright is designed to promote creativity. The writer of the song has passed away. On death, all copyright used to cease and the works would fall into the Public Domain. It hasn’t been that way for at least 60 years.

Led Zeppelin who are no strangers to infringement lawsuits have another one on their hands, albeit 43 years later from when “Stairway To Heaven” was released.

Expect Metallica to cop a few lawsuits in the future once the copyrights to some obscure NWOBHM songs end up with Corporations. Just think of the songs “Welcome Home” and “Enter Sandman”. If i was Metallica Inc, I would be the ones purchasing the rights to the NWOBHM songs they copied otherwise a lawsuit will eventuate.

If you need further evidence about how important Copyright is to corporations (instead of artists) look no further than the donations these corporations give to politicians.

Since Copyright became a financial windfall for the Corporations that hold the rights to songs, we have those same corporate entities via their lobby groups donating to political parties in the name of Copyright.

Being a MetalHead

Heavy metal bands have the most loyal listeners. All of us metal heads know it, and Spotify recently proved it.

So where are all the metal heads when it comes to streaming service launches. Apple walked out Jimmy Iovine and Drake. Tidal walked out the Pop Stars. So, where the fuck are the metal heads?

If you want to look at sales of music, then look no further than metal and rock bands. In 1989, heavy metal and hard rock was the largest selling musical genre. In 2015, these genres are still selling. Even though the marketing budget of Breaking Benjamin was tiny compared to the bigger marketing campaigns the mainstream pop acts had, Breaking Benjamin still managed to beat other higher profile mainstream acts in sales recently.

Five Finger Death Punch, Avenged Sevenfold, Volbeat, Shinedown, Halestorm, In This Moment, Godsmack, Foo Fighters, Disturbed, Metallica, AC/DC and Of Mice and Men are consistent sellers these days.

I know it must sound strange to a lot of people. All of the music from the above bands is available for free on the internet, via streaming, illegal P2P, YouTube, etc. However they still manage to sell a lot of recorded music.

So what gives?

Which brings me back to the Metalhead and Rockhead loyalty.

Did you know that Motley Crue, Twisted Sister, Metallica, Megadeth, Judas Priest, Ozzy Osbourne, Night Ranger, Quiet Riot, Judas Priest, Europe, Bon Jovi, Poison and any Eighties metal band made me the great tax paying and law-abiding citizen I am today.

Who would have known that my degenerate adolescent mind and devil horn fingers would put me onto a road of happiness. If you don’t believe me, give the research a read.

The take away from the research is that being a metal head “served as a protective factor against negative outcomes.”

From Judas Priest, I learned about big brother watching (“Electric Eye”) and about life in a restrictive era (“Breaking the Law”).

From Twisted Sister, I learned about the brotherhood (“S.M.F”), the price of fame (“The Price”), standing up for yourself (“We’re Not Gonna Take It”, “I Wanna Rock”) and about looking out for yourself (“Lookin Out For Number 1”).

From Motley Crue, I learned about voicing your opinions against the establishment (“Shout At The Devil”), about premature ejaculation (“Too Fast For Love” and “Ten Seconds To Love”) , about being a pest at school (“Smokin In the Boys Room”) and just about everything else to do with drugs and sex.

From Iron Maiden, I learned about nuclear war (‘2 Minutes To Midnight”), World War II (“Aces High”, “Tailgunner”, “Where Eagles Dare”), ancient history (“Alexander The Great”, “Powerslave”), English literature (“Phantom Of The Opera”, “The Rime Of The Ancient Mariner”), mythology (“Flight Of Icarus”), the meaning of deja vu (“Deja-Vu”), the bible (“Revelations”), the 666 number (“The Number of The Beast”), samurai (“Sun And Steel”) and the 1854 Crimean War (“The Trooper”).

From Metallica, I learned about banging my head super-fast (“Whiplash”), about capital punishment (“Ride The Lightning”), about drug abuse (“Master Of Puppets”), about literature (“For Whom The Bells Toll”, “The Thing That Should Not Be”), about war (“Fight Fire With Fire”, “One”, “Disposable Heroes”) and about corruption (“Justice For All”, “Eye Of The Beholder”, “Leper Messiah”).

Remember the hysterics about subliminal messages. Court cases followed from parents who lost children tragically to suicide. Ozzy Osbourne and Judas Priest both had to front the courts over subliminal messages. It was easy to blame the music.

I guess in the end, those subliminal messages told me to study hard, read a lot, be critical, be sociable, have an opinion, be a good citizen and earn my way in life. It sure goes against all of the mainstream media’s comments and Tipper Gore’s stupid Parents Group burning albums and screaming that “metalheads” are bad for society and at risk of poor development.

In the end, Metalheads and hard rockers have proven to be resilient and diverse. We wear our skins proud and we are loyal to the end.

P.S.T (Piracy, Streaming and Touring)

All the talk in the media from the old gatekeepers is that piracy is bad for the artists or that Spotify’s free music-tier is bad for artists.

So can someone tell me how Motley Crue is playing in Abu Dhabi?

If we lived in the world of the old gatekeepers, the record labels would be in control and Motley Crue would have sold hundreds of thousands of albums (on a consistent basis) in the UAE before it was even considered to tour there.

However, in the internet age, it is a much different world.

Motley Crue suddenly has an audience in the UAE.

Is this audience courtesy of piracy or legit sales or legit streams?

There is a strong indication that Motley Crue’s UAE audience is due to piracy.

Do you know the Middle East is a huge region when it comes to illegal P2P downloading?

The following statement found in the book “Introduction to Private Security” by John Dempsey sums it up perfectly;

In Europe, Middle East, and Australia, P2P traffic consumes anywhere between 49 percent and 89 percent of all Internet traffic in the day. At night, it can spike up to an astonishing 95 percent.

Even though it is from 2011, the data tells us a few things.

Eastern/Central Europe, South America, Asia, Australia and the Middle East have high rates of P2P piracy as regions.

When you break it up to countries, China, Colombia, India, Russia, Malaysia, Turkey, Taiwan, Brazil, Saudi Arabia and Italy lead the way.

So let’s look at some of the recent tours bands have undertaken.

Metallica in 2011 did the “2011 Vacation Tour” that focused on Europe, South America, Asia and for the first time ever, they took in India.

In 2012, Metallica undertook the “European Black Album Tour” that focused solely on Europe.

In 2013, Metallica undertook the “Summer Tour 2013” which took in again Asia, Europe, South America along with North America.

In 2014, Metallica did the “Metallica by Request” tour which again took in Europe and South America.

Is it coincidence or shrewd planning that Metallica has taken in those markets. Hell, India is known as a nation of P2P downloaders, however it hasn’t stopped Metallica or Iron Maiden touring there.

Iron Maiden’s “The Final Frontier” tour (2010/11)  took in Eastern Europe, along with Singapore, Indonesia, Australia, South Korea, Japan, Mexico, Colombia, Peru, Brazil, Argentina, Chile and Puerto Rico.

The “Maiden England World Tour” (2013), took in Mexico, Brazil, Argentina, Paraguay, Chile and Eastern Europe again.

The “Somewhere Back In Time” tour  (2008/09) took in (apart from the North American and European markets) India, Australia, Japan, Mexico, Costa Rica, Colombia, Brazil, Argentina, Chile and Puerto Rico. Then on the second leg it took in Dubai (UAE), New Zealand, India (again), Mexico (again), Costa Rica (again), Venezuela, Colombia (again), Ecuador, Brazil (again), Chile (again), Peru, Argentina (again).

The Bon Jovi “Because We Can” tour from 2013 took in Brazil, Chile, Argentina, South Africa, Mexico, Japan, Australia, China, Malaysia, Singapore, China (again), Abu Dhabi (UAE) and Israel.

This was on top of the normal European and North American markets.

The “Bon Jovi Live” tour set to kick off in September 2015, takes in China, Malaysia, Singapore, Macau, Abu Dhabi (UAE) and Israel.

Five Finger Death Punch haven’t been around as long as Metallica, Iron Maiden or Bon Jovi, however it still hasn’t stopped them from hitting Japan, Singapore, Australia and New Zealand on their recent “Wrong Side Of Heaven” tour.

Avenged Sevenfold’s “Far and Middle East Tour” from 2012, took in Japan, Taiwan, Thailand, Singapore, Philippines, Malaysia and UAE.

Their “Hail To The King” from 2014 took in Brazil, Australia, Mexico, Chile and Argentina on top of the normal European and North American markets.

Their “Asian Tour 2015” will cover China, Taiwan, Thailand, Singapore, Malaysia, South Korea, Indonesia and Hong Kong.

Again the question must be asked, is it coincidence or shrewd planning. Streaming services can tell the bands which countries or even cities are streaming their songs and at what rates. Other firms out there like Music Metrics can tell bands, which countries or even cities are illegally downloading their music.

All of this data, once in the hands of a person that knows what to do with it, is a marketers dream.

Articles always point out that “pirates” are the biggest spenders and after seeing large bands hit markets with high piracy rates and still sell out shows, I would agree with that assertion.

Piracy, Streaming and Touring go hand in hand.

Being A Musician Means ….

I still have the debate with people about the economics of being a musician vs earning money and the debate always ends with me asking the question;

Would a musician prefer to have their song or album shared/copyright infringed on/pirated (use whatever word you want, depending on what side of the debate you are on) 100,000 times or ignored and not shared at all?

The same conversations come up over and over again.

Musicians are either complaining about streaming payouts, copyright infringement/piracy of their music or jumping in with the corporations or the lobby groups looking for stronger copyright laws and enforcement. However, the music business wouldn’t be a business if it wasn’t for the fans. The customer. The consumer.

So what value is there to the consumer?

You see once upon a time, the musician and the consumer met with the RECORD. The record was an attempt by the musician to make something unique and likeable that it could be purchased.

A musician and a listener met with a performance via Radio, a TV spot or some other form of promotion.

This kind of listener might not end up as a consumer of the recorded product however there was always a good chance that this listener might end up at a concert hence making them a consumer in a way. From buying the record or from buying a ticket to the show, all of the exchanges are very one-sided. It is all about money leaving the consumer and going to the musician. The musician believes that the value comes in the music they provide.

With so much competition in the entertainment industry these days, surely obscurity is a much larger threat to a musician than copyright infringement will ever be. The more a musicians’ music spreads, the more true fans they will find that will end up becoming consumers. It doesn’t mean that all of those people will become consumers.

There is tons of music available that I will listen to. I enjoy doing that, however it doesn’t mean I like it enough to become a true fan and invest in the artist. However with Spotify I am investing in them by listening to them. In the past, I could listen to an artist from a taped copy or a mix CD and the artist got nothing from those listens. In the end each consumer has so much money to spend on entertainment products.

I like drinking wine and one thing I have learned from all the drinking I have done is that the price of the wine is not always indicative of the quality. So with all of the discussions about taking away Spotify’s free tier, it doesn’t mean that people will suddenly start to pay for a subscription. Just because music has a price, it doesn’t mean that it is something of quality that needs to be paid for.

There are other similarities between the winemaking business and the music business. Even in the wine making business, there are brilliant wine makers from around the world trying to break through the monopolies that control different markets.

Just like artists starting off, young wine makers invest a lot of time and money in their craft/product without knowing if that investment will pay off. They do it because they love it. The weather could be that severe/extreme that years could go by with so little yield and zero income. And once they produce that wine, it doesn’t mean that they have a consumer base to market it too.

Anyone gone wine tasting. You are physically at the door of the wine maker’s house where they open up bottles of wine and allow you to sample them. That is how wine makers form their tribe. By their cellar doors.

Metallica are kings of the hill because they formed a tribe around the people who heard their music and those fans followed the band everywhere. It didn’t mean that all of those fans purchased their music. And then Lars Ulrich did his best to divorce the band from its fan base with the Napster shenanigans. However the boat already sailed, with a lot of free music from Metallica doing the rounds. All of this copyright infringement established a whole new tribe for Metallica that is still sustaining them to this day. Yep those free loaders from Eastern Europe, the Middle East, South East Asia and Central/South America have become consumers to their sold out shows.

The fans are all a musician has.

Warren Buffet (investor) has an investment rule that rings true here when I think about the current status of some of my favourite artists;

“Be fearful when others are greedy, and be greedy when others are fearful.”

Tidal is all about greed. Taking away Spotify’s free tier is all about greed. Destroying the public domain by hijacking copyrights true intent is all about greed. The whole music business is about income inequality.

So can anyone blame us when we, the consumers became fearful of greedy people.

I support what is in my opinion the best music. I know other people’s opinions differ from mine. That’s just life.

As a musician I would be happy if my music was downloaded illegally 100,000 times and I am not one of those deluded people that equates those illegal downloads to 100,000 missed sales.

Do the math.

With no downloads a musician has no fans/listeners/future consumers and no cash.

With a 100,000 downloads via cyber lockers or torrents, the musician has possibly 100,000 fans and no cash at this point in time. I know what I would prefer.

There is a reason why Metallica and Iron Maiden have played to large audiences in Eastern Europe, the Middle East, China and South/Central America respectively and it has nothing to do with sales of recorded music.

Fame always came after however MTV made everyone believe that fame comes first.

And musicians in most cases are ignored for long periods of time before they break through.

Five Finger Death Punch is a band that sells a decent amount of recorded music right now and they have been doing those numbers since 2007. However the musicians in the band didn’t just come from out of nowhere. If you look at the individual band members careers before FFDP, you will see musicians who have been ignored. Their previous bands did not set the world on fire, however it was all stepping-stones. And the musicians that have that mindset end up reaching the top. The ones that want only the fame and the money end up in the rear view mirror.

Europe is a band that I have followed since “The Final Countdown” days. I purchased their back catalogue once that album broke through. I purchased John Norum’s solo output and I hold the “Face The Truth” album (with Glenn Hughes doing vocals on quite a few songs) in high regard. I followed Joey Tempest solo albums and with pleasure I took in their comeback from 2004 and onwards.

The first version of the band came together in 1979 and was named Force. Via a song writing contest they got a recording deal in 1982 with a Swedish label. By 1985, they had some songs in a movie that gave me some more traction. Joey Tempest wrote a song for aid in Ethiopia however at this stage the band was still largely ignored. That all changed in 1986 with “The Final Countdown” album. The journey was seven years long. Compare that to some of the ideals today of musicians. They believe that by putting up a video or a song on YouTube, we should all pay attention.

Michael Poulsen from Volbeat was in a death metal band called Dominus from 1991 to 2000. Then he formed Volbeat in 2001. Their first album came out in 2005. For the next seven years they kept on building on their following and it wasn’t until Metallica took them out as an opening band that American success came knocking. By 2012, Volbeat was a big business.

Do the math on the years in between. Poulsen became an overnight success however that success was 21 years in the making and a large part of those years dealt with being ignored.

That is what being a musician is.

Death, Money, Consistency and Originality

DEATH

AJ Pero died a few days ago. That iconic drum beat at the start of “We’re Not Gonna Take It” that was him. A.J Pero wasn’t the pretty boy in the band that is for sure. He was the street dog that could groove. Dee Snider might have grabbed all the fame but that doesn’t mean that A.J Pero wasn’t a star. If he didn’t roll, the Twisted machine didn’t rock. And man he was a perfect fit for Adrenaline Mob as well.

Remember that it is tough being in the music business. A.J Pero from what I know didn’t write not one song however he had a career that spanned 40 plus years. It’s because he didn’t get into music for the riches and the fame. He got into music because he loved it and he kept that love going for his whole career. He even died while on tour.

RIP.

And the piece d’resistance A.J. Pero song for me is “The Fire Still Burns” from the “Come Out And Play”.

MONEY

I really enjoyed Revolution Saints and when I looked at the song writing credits, it’s all Alessandro Del Vecchio. There is not ONE Doug Aldrich credit. Maybe the money incentive to do Revolution Saints from Sergio Perufino was too good compared to what Whitesnake had on offer.

Speaking of money, everyone reckons Metallica is losing it. Maybe its true and maybe it’s not. But what I do know is that in every business as soon as you forget about the tasks that bring in the bread and butter, two things begin to happen. Stagnation and bankruptcy. Leave the festivals to the promoters and leave the movies to Hollywood. Metallica’s bread and butter is music and it has been now 7 years since we had any new tunes from them.

Continuing with the money topic, the recording industry wants to rip apart Spotify’s freemium model.

Which is typical?

Instead of working with Spotify to make the premium option super enticing that fans of music feel the need to purchase a subscription, they want to make the premium option the freemium option and place restrictions on the freemium option. What’s even worse, studies are coming out showing that the spending on streaming music is outperforming CD sales. And in countries that adopted streaming much earlier than the U.S and Australia, streaming is even outperforming digital sales.

I had this debate with others. A lot of people would be happy to pay an annual subscription amount to listen to music of their favourite artists, provided that they KNOW that the money would be divided among those artists and not others.

This is typical of the recording business, trying to be paid multiple times for the same product. That is why all of the record labels had class action suits brought against them from artists. The label is applying the same vinyl math to digital music and the artists don’t like it.

CONSISTENCY

Getting people to pay attention just once is not enough. The ones that have a music career have done it over again and again and again. Quiet Riot got me hooked with “Metal Health” and then disappointed the fans with “Condition Critical”. Then they disappointed the fans even more with the one after “Condition Critical”. So guess what happened to them. They started a steep downhill slide.

Meanwhile, Motley Crue hooked people in with “Too Fast For Love” and then blew them away with “Shout At The Devil”.  Then, even though they kept on making albums, they became a video/singles band, with “Smokin In The Boys Room”, “Home Sweet Home”, “Girls, Girls, Girls” and “Wild Side” making decent inroads into our head spaces. There was still enough consistency there, that when “Dr Feelgood” came out, it blew us away.

Metallica was the same. “Kill Em All” was different and energetic however it was a tribute album to the NWOBHM. “Ride The Lightning” kept that energy and started to make it technical. “Master Of Puppets” refined the “Ride The Lightning” format and then “And Justice For All” took it to a whole new progressive technical thrash level. Then the paradigm shift happened and groove was back in with the self-titled “Black” album.

Currently, bands like Five Finger Death Punch, Volbeat, Avenged Sevenfold and Shinedown are showing that they are no one album/hit wonders. Machine Head was a bit inconsistent after “Burn My Eyes”, but since “Through The Ashes of Empires” they have been on song and in the process, Robb Flynn re-established the Machine Head brand.

ORIGINALITY

I am a great believer that original music is a sum of the creator’s influences. That craziness over a stupid Marvin Gaye song and his greedy heirs has reinforced my views.

For the last time YOU CANT COPY A FEEL OF THE SONG.

In other words, all music is derivative. The aim is to make it sound fresh. Look at the biggest albums or biggest songs of any bands career and you will hear similarities to other works.

Metallica’s piece d’resistance album amongst fans is “Master Of Puppets”.

We all know that “Welcome Home” is an amalgamation of songs from an obscure NWOBHM band and Rush. The format/flow of the album is based on “Ride The Lightning”. The songs are also constructed in the same way. Even their biggest selling album led off with a riff that was taken from another obscure skate punk metal band albeit this one being from California instead of England.

“The Unforgiven” had the same chords in the Chorus as the “Fade To Black” verses. “One” had an intro that was taken from “Fade To Black” and “Fade To Black” had an intro taken from “Goodbye Blue Sky” from Pink Floyd. And it goes on and on.

The Copyright Pension/Annuity

When I started to write my own songs back in the late Eighties, copyright was not even in my mindset. You see, when you start to do something creative you do it because there is a sense of fulfillment and a desire to create.

From my own experiences, I never sat down with my guitar and said to myself, “Gee, lucky for me, there is a copyright law in place that lasts my whole lifetime, plus another seventy years after I die, to give me an incentive to create”.

Those kinds of thoughts never enter the mindset.

Which brings me to today and how the very nature of what Copyright is has been hijacked by large corporations and greedy next of kins.

The whole “Blurred Lines” case is a joke. For the record, it is a crap song that made a lot of cash. So what we have is a jury deciding if a song sounds similar to another song and for them to decide that it does sound similar, it more or less indirectly infers that Marvin Gaye was so original that his song “Got To Give It Up” came out of some celestial vacuumed place that only Marvin Gaye had access to. However, everyone knows that is not the case. All artists are the sum of their influences.

And what a said state of affairs for Copyright. You have the heirs of Marvin Gaye, who haven’t contributed anything to the arts and are living off the proceeds of a stupid law that extends Copyright 70 plus years after death. There are millions upon millions of songs out there that sound similar, however once a song makes some serious cash, the knives come out.

What I took out of the court case and what bodes well for music in general is the amount of money the track made.

$5.6 million in profits went to Robin Thicke while $5.2 million to Pharrell Williams, $700,000 to the other writer T.I. and the rest of the $16.7 million in overall profits went to the  record companies Interscope, UMG Distribution and Star Trak. Since Napster, we have been hearing the same rhetoric from the recording industry and out of touch artists.

Gene Simmons and Paul Stanley are renowned for their viewpoints on rock being dead and piracy killing off any chance a new artist has of making some money. Scott Ian wanted to disconnect people from the Internet. Nuclear Blast want to shakedown people who downloaded the music from “All Shall Perish”.

Meanwhile the record labels kept the propaganda machine going that they just can’t make any money because of piracy. So here is just one song that has made close to $17 million dollars in profits. One song, remember that.

So it goes back to the same old saying, create something that people gravitate too and watch it make you money. There is a shitload of money out there if artists can create a great song that people gravitate to.

Actually speaking of plagiarism, listen to the “Funky Town” vocal melody and then listen to the verse vocal melody in Kiss’s “Lick It Up”. They are identical. Hell, the whole “Sonic Highways” album from Foo Fighters is a case of influences. Same goes for the whole “Hail To The King” album from Avenged Sevenfold. Let’s add  “Kill Em All” from Metallica which was more or less a rip off the NWOBHM movement. Subsequent Metallica songs afterwards would further borrow from other cult/unknown artists.

Recently Five Finger Death Punch lifted “The Ultimate Sin” verse vocal melody and used it for the “Lift Me Up” verse. Dave Mustaine did the same both musically and vocally by lifting “Children Of The Grave” and using it for “Kingmaker.”

Thank god that Dave Grohl, A7X, Five Finger Death Punch, Dave Mustaine or Metallica didn’t decide to let a Marvin Gaye song influence them, otherwise they would be in the courts as the well.

I think it is pretty safe to say a lot of songs sound the same regardless of genre. I see it more as a tribute than a rip off and to be honest in no way does the new composition take away from the original. For example, there is no way that “Something From Nothing” from the Foo Fighters takes away from Dio’s “Holy Diver”.

But when you have a whole copyright industry that makes money of the works created by others, you get a lot of bullshit happening, especially when a song makes a lot of money.

Living Under The Laws That Corporations Wrote And A Bit Of Metallica For Old Times Sake

“Alice In Wonderland” turned 150 years old recently and it is still in the public imagination.

Hell, it has been in the public domain since 1907 (42 years from when it was originally published) and that still hasn’t stopped the story from making money. By having the work in the public domain it has allowed other people to create derivative versions of the story and the characters. “Alice In Wonderland” is a perfect example of how adaptions of the original story has ensured that the story gets passed on to multiple generations.

So next time you hear of someone calling for longer copyright terms, tell them about “Alice In Wonderland”.  The incentive of a 42 year copyright monopoly was a sufficient motivator for Lewis Carroll (real name Charles Lutwidge Dodgson) to create more works.

Carroll didn’t need a copyright to last 70 to 90 years after his death as an incentive to write stories. Sort of like the heirs of Marvin Gaye. Seriously, what the hell have they contributed to the arts. Copyright was never about being a lifetime pension that carries over to the children or the next of kin. The rule is simply, if the artist passes away, their music falls into the public domain.

As much as I love Hendrix, I don’t agree with his relatives holding a copyright monopoly on his works.

However a lot of people (with a large corporation or corporations attached) stand to profit from long-term copyrights.

Anyone heard of Wu-Tang-Clans single album that has an 88 year copyright caveat. What this means is that the person who paid something like $5 million dollars for has to wait 88 years to hear it. This is what happens when music is turned into something that is not music. The fans that made the group popular are not able to hear it, because greedy people attached to the group want to profit from it.

For those that do read my posts, you will note that I have mentioned a lot of times that fans of artists are not purchasing music anymore. They are purchasing art packaged as a must have for collectors. I always use Machine Head’s “Killers and Kings” Record Store Day single release with four different covers. Yep, I purchased all four singles and guess what, they are still in the shrink-wrap.

So if you need anymore proof that sales of music is all about collectables then look no further than Metallica’s “No Life Til Leather” cassette release for Record Store Day.

You see, releasing music should never be about the new album only. Music was never designed to be about locking yourself away for a year or for months in a studio while you record your new master opus. Music was never designed to be about spending months and months on promotion and marketing. Music was never designed to give rise to large copyright monopolistic corporations. However that is where music has come to.

Because it is these large copyright monopolies that have lobbied hard for internet service providers (ISP’s) around the world to store and then hand out the personal information of their users to these greedy corporations.

All in the name of copyright infringement.

What the large copyright groups have done, via their cashed up lobby groups is bypass legal process. If an internet user has been falsely accused, well, too bad. The burden (and a costly one at that) to prove that you are innocent is on the user, as the way the anti-piracy laws are written, there are basically no consequences for a copyright monopoly business from making false accusations.

I guess this is what it means to live under the laws written by corporations.
