What Do Artists Need? Stronger Copyright Laws or Better Business Models

I absolutely support that musicians should be paid for their work.

What I don’t get is how the record labels and misguided artists feel entitled to push for stronger copyright enforcement as a way to guarantee an income which is contrary to the foundations of what copyright was designed to do.

As we all know, Copyright laws have been hijacked by Corporations that at this point in time, copyright is contrary to freedom, and in particular freedom of speech, to a degree where it is illegal to sing “Happy Birthday” at a birthday party.

The “Happy Birthday” song goes all the way back to 1893 and right now it is “protected” by copyright until 2030 because someone decided to retroactively place it back under copyright. If that doesn’t tell everybody that something is very wrong with Copyright then I really don’t know what will.

Because people who really believe in stronger copyright laws believe that if those extra enforcement laws do not exist then musicians will cease to create. Those same people believe that if people are not paid upfront to write an album, then musicians will cease to create.

The maximalist viewpoint doesn’t seem to be supported.

Look at Sweden, the birth place of Spotify and The Pirate Bay. Guess what, the country has a thriving culture around music. Sweden to me is the scene to be at right now. Other policy changes by the Swedish Government around making medical care free has also contributed to this vibrant music scene. And all of this has been achieved with the threat of copyright infringement.

Remember all of the lies that have come out from the entertainment industries.

“Home taping killed music” was a good one. Guess that is why the music business and as a by-product the recording business grew exponentially once cassettes came into the market. I guess that is why no popular music has been made since cassettes came into the market.

The point is that copyright protectionism is purely about protecting old business models. Stronger Copyright has nothing to do about supporting thriving new industries. Stronger Copyright has nothing to do about finding new ways of doing things. The thing is the Copyright cartels have had a big win in successfully skewing the argument that file sharing is “theft”.

Remember all of those commercials about stealing that seemed to appear on a legally purchased DVD. The irony. I purchase a DVD and then I get blasted with ads that links copyright infringement to theft. BUT, if file sharing was actually “stealing”, then file-sharers could no doubt be prosecuted under existing theft law.

But they don’t. Because file sharing is not theft of property. It is a violation of copyright. That’s an important difference.

Duplicating a pile of 1’s and 0’s does not deprive anybody of the original content. What all of this copying does is drive down the value of the product. What is the price of a song when the internet is littered with millions of copies of the same song and they are free.

That right there is a market with a customer base in the billions and it needed to be satisfied. And that is where YouTube, Spotify, Pandora and other streaming services come into play. They are there to monetize that market by competing with free through ad-supported business models. Hey, if it is good enough for the free to air TV networks, why can’t it be good enough for music networks.

But this “free market” has a big problem when it runs up against Government protected monopolies.

And the thing is, people do also pay for music. Many studies are actually showing that the biggest consumers of illegal media are also the biggest purchasers of legal media. Ultimately this seems to show that people are more than happy to pay for content they enjoy.

Metallica’s self-titled Black album is still moving on average 2000 units a week. And it is doing this even though millions of copies of the album are available to be downloaded for free. It is doing this even though it is available for streaming on Spotify and YouTube.

Volbeat has been selling records on a weekly basis in the U.S since 2011. They are doing these numbers even though their album/s are available to be downloaded on peer-to-peer networks. They are doing these numbers even though their albums are available for streaming.

Same deal with Five Finger Death Punch, Avenged Sevenfold and Skillet. Still selling, regardless of the state of piracy.

So what is it. Do artists need stronger copyright laws or better business models and terms that pay them a fair days pay for a fair days work?

Invasion Of The Swedes – The First To Embrace Streaming and Guess What… Their Scene Is Flourishing

What do all of these bands have in common?

They are all from Sweden. And it was “Tearing Down The Walls” the fourth album from the band H.E.A.T that got me thinking about this invasion.

And the thing is they have always been producing so many good bands and great music. But when the record labels controlled the market, we didn’t know of the bands unless they broke big like Europe, Roxette, Yngwie Malmsteen and so on. Now with the internet, we know a lot more.

“Address The Nation” from 2012 was the first piece of music I heard from H.E.A.T and then I went back and heard their 2008 self-titled debut and it’s 2010 follow-up “Freedom Rock”. I liked them all, so I had high hopes for the fourth album. Going in blind, “Point of No Return” didnt disappoint. After listening to Bonfire a few days ago, I can honestly say that H.E.A.T reminds me of a cross between Europe and Bonfire. And that is a good thing.

Which melodic hard rock band these days isn’t from Sweden. It’s a Viking musical invasion in so many ways.

Max Martin is rocking the Billboard Top 10 charts with his pop formula. Other artists are also breaking through. Avicii and Swedish House Mafia are the big EDM artists that have crossed over recently.

And a lot of the hard rock and metal bands that I mentioned earlier would probably not tour the Americas or Australia on a frequent basis however they have a career touring around Europe and Japan. And trust me, they are big markets to hit.

H.E.A.T for example have shows all over the continent. And you know their name is built on the backs of song number 14 on album number 1. Yep, “1000 Miles” almost has 3 million streams on Spotify.

And for a Swedish band, H.E.A.T’s new album is not even available to be streamed.

Which is a big contrast to say the band called “Takida”. Yep, they are another Swedish band and their song “You Learn” from their 2011 album “Burning Heart” has 21,853,323 streams on Spotify. WTF.

I can tell you that a lot of American major label acts do not have those stats. I just checked Five Finger Death Punch and they are nowhere near this figure. To prove that it is not a one-off fluke I checked out some of their newer material from 2014 and the song “One Lie” is sitting at 900,000 plus streams. I went deeper and the song “Curly Sue” from their 2007 album is sitting at 7,677,597 streams. Bands would kill to have these stats and I bet a lot of people reading this would be saying, who the fuck is Takida?

The same could be said for the band “Mustasch”. Their song “Double Nature” from 2007 has 8,627,129 streams. Yep they are another rock band from Sweden. If you want to compare streams, Dream Theater’s “On The Backs Of Angels” has 1,419,649 streams.

Then what about the band called Sabaton? Their song “Ghost Division” has 7,817,664 streams. Or the Swedish band “Dream Evil” that features Gus G. Their song “The Chosen Ones” has 1,161,146 streams. Or the band “Dead By April” and their song “Mystery” that has 11,643,378 streams.

Isn’t it funny how the home country of Spotify also has one of the most vibrant rock and metal scenes in the world. But wait a second. I am sure I have heard the RIAA and their proponents scream that because music has been devalued, no one will create anymore.

Well it looks like someone forgot to tell the Swedes.

But, the RIAA and their proponents still screams piracy and the copyright industry still screams for stronger copyright enforcement. But the truth of the matter is that all eyes should be on Sweden. Here is a country that has embraced streaming and guess what, their musical scene is flourishing.

Once you add in all of the crossover artists like Swedish House Mafia and Avicii, along with songwriting king Max Martin (aka Martin Sandberg) it is safe to say that free music to a consumer DOES NOT MEAN THAT CREATORS HAVE NO INCENTIVE TO CREATE.

What I Am Over Reading …..

Metallica’s New Album

Seriously it has been six years since Death Magnetic was released. For the last six months, the band has been working on songs. They have mentioned in press interviews that they have thousands of riffs stockpiled. The hype means nothing in 2014. Do people want a full Metallica album every six or seven years? I know what I would prefer, more quality frequent releases.

In relation to new music, “The Lords Of Summer” is the only new offering, while “Beyond Magnetic” broke the cobwebs on some old Death Magnetic demos. And the less said about “Lulu” the better.

However the Metallica live show sells out.

Seriously. How many times can someone own the original three albums or the songs contained within those albums.

The fans want you to write music and play for them. Instead we get our heroes become owners in football clubs, technology start ups and so forth.

Piracy

Seriously. Is this still an issue in 2014?

YouTube and Spotify more or less have everything that a person would want. However the labels along with the RIAA still use piracy as a means to get more laws written. In Australia, our Attorney General is talking up a three strikes policy as a means to combat piracy even though evidence from all over the world has shown that these policies have done nothing to stop copyright infringement.

It’s because the people have no respect for copyright law anymore and the corporations that abuse it. Music survived for centuries upon centuries because there was no copyright. Artists copied each other. Music and melodies got passed on from family members to family members via copying each other.

Google Needs To Do More

People like U2 manager Paul McGuinness or the RIAA or the MPAA or the various bots they employ to issue takedowns need to get a life because Google is not to blame for copyright infringement. Google is not to blame for the THEFT of music. I believe the latest comment from McGuinness is that “Google is the greatest theft enabler on the internet”.

Seriously McGuinness should look up what THEFT means because as far as I know, U2 still has their music on iTunes. No one has stolen the mp3 that exists there. However if millions of copies of that same mp3 exist all over the internet, is that Google’s fault.

Streaming Doesn’t Pay

It does pay. If you are not getting any of the pie speak to the label or the organisation that is getting the pie. But according to Paul McGuinness again, bands should gate their releases like the good old days.

Seriously,they are irrelevant. All they do is give the old guard a way to measure something that is irrelevant because the new way to measure an artists reach is just too hard to fathom for them.

Are people listening to the album? That is the question. Instead of focusing on Soundscan numbers, what is happening on the live front?

People can see through the hype and bullshit. In other words, we don’t care about what the bands say about “how great this new album is” or “how it is a definitive statement of the band right now”. All we care about is if we like it. If it is great we will push it. If it is crap, expect it to disappear.

Because if publicity does increase sales, then bands should be selling by the millions and selling out their shows. But they don’t.

How Do You Know If An Album Is Successful?

You are an artist performing solo or within a band.

You decide to record an album.

You spend time and effort writing, recording, producing, mixing and mastering your latest opus.

You do some promo and release it.

Then what do you do.

It doesn’t sell what you expected. Once upon a time, the definition of a successful act was based on how many records they sold.

Sebastian Bach still can’t get his head around why he has 800,000 Facebook Followers and only 6000 people in the U.S purchased his new album “Give Em Hell” in the opening week. For the record, it is a great album. I have heard the album, but I didn’t purchase it. I went to Spotify and streamed it.

So if it doesn’t sell as expected, it doesn’t that mean the album didn’t do well. What it means is that fans of music have consumed it in many different ways. I actually liked it enough to go onto Amazon and add it to my shopping cart. I haven’t purchased it yet. I will wait until the price drops below $10 before I do. And then it will go on the shelve in its wrapper.

In this day and age sales can never be used a metric for success. However, if there are songs there that are undeniable and an audience starts to resonate with those songs, then expect to sell.

Five Finger Death Punch came out in the piracy era. In the same era that has greedy corporations telling politicians that piracy is decimating the music industry.

Well, this piracy era hasn’t stopped Five Finger Death Punch from moving over 500,000 units in the U.S alone for each album. Yep that’s right, Five Finger Death Punch have been selling records since their debut album came out in 2007. Even the recent “Wrong Side of Heaven” Volumes 1 and 2 are moving close to the 500,000 mark for each of them. Combined these two albums have moved over 700,000 units.

So I am really over bands or artists who lament that no one buys their music. People do buy music. People do stream music. People do download music without paying for it.

And all of those people who access an artists music both legally and illegal will also invest in concert tickets and merchandise. They will even invest in REAL limited/deluxe edition perks. Not the kind of perks that just come with a DVD or a T Shirt.

Artists should take a leaf out of RatPak Records. They have various packages available with each release and at a price that isn’t extortion.

In my opinion, an album can be defined as a success if people are coming to the shows and singing the songs of the album.

WASP released “The Crimson Idol” in the early nineties. Commercially it didn’t do anything however if you talk to any WASP fan and I bet you they can sing the songs from that album. In 2014, it is seen as Blackie Lawless’s finest achievement.

Machine Head released “The Blackening” in 2007. It didn’t sell in the millions, however it allowed Machine Head to go on a three-year victory lap on the back of it, touring the world over and over and over again. It was hailed by Metal Hammer as the album of the decade. It is also seen as Machine Head’s definitive masterpiece.

One of my favourite independent bands “Digital Summer” have been managing their own career and their own releases with great success. Recently they just had a run of dates with Volbeat and Trivium. Prior to that, they have done tours with Shinedown, Three Days Grace, Three Doors Down and many other acts. They have done shows on their own. And they manage themselves. They finance their own recordings. They ask their fans to help out via fan funding campaigns. So big deal if their albums haven’t sold in the millions. They are over 10 years deep and still rocking.

So how do you know if an album is successful in 2014?

If people are listening to it, coming out to the shows and singing the songs.

Price, Piracy And “The Stealing vs Copyright Infringement” Argument Again

Australia (where I reside) is always mentioned as a leading country that specialises in copyright infringement.

So it comes as no surprise that the latest Attorney General, George Brandis flush with lobbying dollars from Village Roadshow (Village was part of a failed court case two years ago against iiNet, in which the High Court ruled that iiNet as an ISP had not authorised copyright infringements) is pledging to do something about these “pirates”.

You see, Brandis and Village Roadshow are two such entities that have grown up with the notion that because they have made a profit out of the public for a number of years, that it is the duty of the government and the courts to guarantee that such profit remains the same in the future even in the face of changing circumstances and contrary to public interest.

If Australia does have a massive problem with piracy, one way to solve it would be to provide a legal alternative that is like “The Pirate Bay”. The evidence is right there in front of the content industries. People like to download content. So why don’t they run ads and allow people to download content for free.

Instead Village Roadshow chief Graham Burke just keeps on lashing out against Google for not doing enough to curb piracy. He lashes out at Google for not doing enough to protect his profits. He keeps on emailing the Attorney General for a graduated response scheme funded by the ISP’s even though evidence from all over the world clearly show that these schemes do not work.

On the point of prices, there is a war going on in Australia right now in relation to the prices that Australian audiences need to pay for movies, software, mp3’s, ebooks and devices. Our consumer watchdog even took the drastic step to tell Australian consumers to use a VPN so that they could alter their IP address.

The main talking point doing the rounds the last few weeks is the price of a movie ticket. In Australia, the main cinemas charge $16 to $20 a ticket while Independent cinemas are charging between the $8 to $12 price range.

Graham Burke (yep that same person mentioned above from Village Roadshow) is on fire. Check out some of his quotes;

“In Australia we pay approximately $23 an hour for our people; in America, where we operate cinemas, it’s $8 an hour.”

Umm, the last time I was at the cinema I was served by 16-year-old workers, who are earning nowhere near the $23 an hour figure. More like $15 an hour.

“It’s like going into a bookshop through the back door, and taking all the books out. It’s something that needs to be addressed and is being addressed in democracies throughout the world.”

No, copyright infringement is nowhere near the same as taking all the books out of a book store. Once the book is taken out of the book store, it is gone forever and no one can use it again. When music is infringed, the copy is still there for others to download and share. No one has taken anything away. All they have done is made a copy.

To put Burke’s argument misleading quote in context, Copyright Infringement is going into a bookstore, copying the book you want and then walking out, leaving the original book still there for others to use, share and copy.

The problem with recorded music is the supply vs demand argument.

Let’s use 30 Seconds To Mars as an example.

Their music is available for downloading, both legally and illegally. Their music is available on YouTube, on official channels and unofficial channels. Their music is available on streaming sites like Pandora, Spotify, Beats, iTunes Radio, Rdio and many others. Their music is available on vinyl and CD.

There is a large supply chain there and the demand is not centered in the one place anymore.

Streaming is the future because consumers want music to be free. This is the cold reality and artists need to accept that.

If You Want To Succeed In 2014

I was listening to Fuel’s new album “Puppet Strings” today.

Fuel was one of those rock bands I latched onto in the late nineties, early two thousands.

Why call it Fuel without Carl Bell?

Why did Carl Bell call it Fuel without Brett Scallions for the “Angels and Demons” album cycle?

Keeping a band together is a job in itself. No one tells you how hard it is. Read about the making of “The Wall” from Pink Floyd. Watch, “The History Of The Eagles” documentary. Read, “The Dirt” or “Face The Music” or “Lifting Shadows” or “Enter Night” and you will see countless examples of bands trying to hold it together.

Listening to the Fuel album got me thinking about the current state of the music business.

We live in an age where only blockbuster albums make serious money.

The income gap divide between the bands that release blockbuster albums and the ones that don’t is growing wider and wider.

The days of paying your dues and breaking through are over.

Now it is all about being great 24/7.

The internet noise has made it almost impossible for messages to rise above it and new releases come out one week and if they are not great, they are forgotten the next.

It’s a cold hard truth. In 2014, you have to be great.

Five Finger Death Punch. Great.

Volbeat. Great.

Avenged Sevenfold. Great.

Skillet. Great.

Gemini Syndrome. Great.

Halestorm. Great.

In This Moment. Great.

All of the bands mentioned above have had albums out for at least 10 months and more, and they are still part of the social conversation.

If you are one of those people who uses sales as a metric of success then all of the above bands are still moving units. However sales are not the only measures of success these days.

If you want to succeed and make money from recorded music in 2014, understand how streaming royalties work.

If you want to succeed and make money from recorded music in 2014, stop bitching about streaming royalties and re-negotiate with the record label.

Ever heard the story of Loreena McKennitt, who is a Canadian Folk/Celtic/World music artist.

She couldn’t get a record deal. She spent a long time networking and building a connection with her audience. Eventually she created a substantial fan base that started to purchase her music and she was getting 70% of it. When Warner Bros. came knocking, she showed the label what she was making and the “crap contract” that the label came with got torn up and she negotiated a new deal with the label that benefited her as well as the label.

In the end a harp playing harpist had enough bargaining chips on her side that she was able to negotiate a real deal. And then you have people like Scott Ian and other metal heads complaining about piracy and the state of the industry.

If you want to succeed and make money from recorded music in 2014, know that it is a relationships business with the fans first and foremost.

If you want to succeed and make money from recorded music in 2014, know that the press doesn’t matter. It might make you feel great and it might please your vanity, however it is the fans that break acts.

If you want to succeed and make money from recorded music in 2014, you only get ONE SHOT to make a first impression.

If you want to succeed and make money from recorded music in 2014, you need to know how to write, play and sing.

If you want to succeed and make money from recorded music in 2014, take a note from the Dave Matthews band. They are huge because they have fostered an audience that is more or less a cultural movement.

If you want to succeed and make money from recorded music in 2014, you need to keep creating hits. The biggest songs of a band’s career are the ones that didn’t rise up the charts. The fans made them hits in their cultural universe. Seen a recent set list of Metallica or Megadeth. None of the songs ended up as Chart Hits, but they are still hits.

If you want to succeed and make money from recorded music in 2014, know that streaming revenue is just going to keep on rising. If you are on a label and an old contract start re-negotiating right now. Otherwise you will be left behind.

What Happened to The Guitar Riff?

The mighty Guitar is still in the forefront of all the main hard rock and metal music. Regardless of what music style came and regardless what technological new medium came to kill it off, (like the Eighties midi craze), the mighty guitar has fought its way back time and time again.

Like a true champion it rises up from the canvas. That sound through glass tubes and cones made from paper. What can beat it?

To quote Dark Helmet, “Absolutely Nothing”.

Try as the trend setters might to eliminate distortion, the power chord and it’s many different versions remain unique. The human feel of a guitar is the essential element that makes a song unique and intimate enough to form a connection with a listener. You don’t see people growing up wanting to be clarinet and flute players.

It is an integral part of culture, both past and present. Think of Jimi Hendrix burning one or Pete Townsend smashing one or Randy Rhoads playing that immortal polka dot guitar or Eddie Van Halen’s Frankenstein guitar.

Think of all of the album covers that featured a guitar;

Dire Straits – “Brothers In Arms”
Stryper – “To Hell With The Devil”
Def Leppard – “On Through The Night”
AC/DC – Take your pick of the many classic album covers that involve Angus and his trusty Gibson SG.
The Cult – “Sonic Temple”
Van Halen – “Women And Children First”
Bruce Springsteen – “Born To Run”
Jeff Beck – “Guitar Shop”
MSG – “Built To Destroy”
Boston – The self titled debut and “Dont Look Back” covers are iconic.

At the moment, the number 1 hits around the world are “The Monster” by Eminem/Rihanna, “Timber” by Pitbull/Keisha and Happy by Pharrell Williams. Not a lot of guitar in those songs and if there is guitar, it is in the background, relegated to a support act.

It is not the main instrument in popular culture anymore.

The guitar is disappearing from popular culture.

So what happened.

So what happened to that riff that connects. The one that we can play air guitar to.

Commercial sensibilities are trumping artistic sensibilities.

Rock and Metal bands are churning out songs. Good songs. Great choruses. But no definitive riff. We hum the melodies, we tap the groove, but we don’t do the der, der, derr on the riff. For those who don’t know what the “der, der der” is, it is “Smoke On The Water” from Deep Purple.

Avenged Sevenfold came close with the “Hail To The King” album. Pissed off a lot of people in the process. They called them copycats. But they had the balls to create a classic rock album. And Classic Rock albums are created from influences.

Machine Head nailed it with “Be Still and Know” and “Unto The Locust”. But because of their niche, popular culture would never even know about it. Too ignorant to care.

Maybe it is the downtuning. Maybe it is the speed. Maybe it is the focus on the melody to be catchy.

One thing is certain, there are no riff driven songs, with a great hook doing 100,000,000 streams on Spotify. All of those numbers belong to Imagine Dragons, Avici, Daft Punk and a whole host of EDM artist and pop artists that have songs written by Max Martin.

And one last thing, for all the doubters that Spotify is hurting artists.

Yep an independent artist that uses Tunecore as its digital distributor has earned from September 2010 to November 2013, $334,636 for over 57 million plays. It’s easy money earned by people listening to his music on a consistent basis. It’s that simple. It’s that pure. We create music so people can listen to it. First and foremost. And Spotify along with YouTube are here, telling the creators which songs are being listened too.

Isn’t that a great thing.

But hey, Spotify doesn’t pay artists said the old guard. Bullshit I say.

Spotify pays. It pays well. It is the record labels that don’t filter it down to the artists. It is the same old argument like before of Record labels not paying artists.

Demonoid. As the single largest semi-private BitTorrent tracker that ever existed, Demonoid offered a home to millions of file-sharers. Throughout it’s history it has been taken offline a few times and the most recent one occurred last year. However, the site is known as the “COMEBACK KID” and it is back again. Never underestimate innovation. It always trump corruption and money.

As expected and predicted by everybody, the Entertainment Industries/Hollywood Studios are now suing MegaUpload. The fact that they conspired with the Government to take a cyberlocker off-line was not enough. The fact that they made a lot of people lose personal content like photos, papers and videos is not enough. Let’s spend more money and sue the organisation. I suppose the catchcry is going to be the whole “WE NEED TO SEND A MESSAGE”.

Apple’s got no streaming solution. iTunes Radio is no match for Pandora so Apple/Cook making a billion dollar deal with Beats Music (which was losing money) so that they could have a streaming solution. And Trent Reznor (who was an investor in Beats) cashed in with the Beats sale to Apple by making way more money than he ever made in music.

Independent bands that come up with creative ways to engage their fans. “The Airborne Toxic Event” a few years back released a series of stripped-down, single-shot videos for every song on their album. Check out their Spotify and YouTube numbers today. A lot of the established rock bands do not have those numbers. The lesson here is that the artists in today’s world have way more opportunities to reach out to their fans and share content with them. It’s a lifer game.

MUSO (a takedown service) is the Entertainment Industries answer to piracy. And the UK Government is providing funding.

If you are an artist, you need to keep on creating so that you can stay ahead of the game. If you are a label, you need to be finding talent and innovating to stay ahead of the game. Otherwise, you will be behind the eight ball and blaming everyone else for your shortcomings.

Is Spotify Suffering From The “Newness Wears Off” Syndrome?

You know the drill. A new technology comes out and eventually it will start to get some traction. Then the word will spread about and everybody flocks to it. It’s new, it’s cool, it’s hip and its innovative. Then when it is at its peak, the people who testified for the new tech, will abandon it, looking for something new and better.

Look at the history of technology innovations and you will see a pattern.

MySpace, Facebook, Twitter are three such platforms that came, peaked and right now are suffering an identity crisis.

MySpace is finished.

Facebook got traction because it connected people in a way that MySpace couldn’t. Now, all of these connected people need to deal with the marketing of products, advertisers, like requests, fake friend requests and spam.

Twitter is well, Twitter. With so many people tweeting or having their tweets connected to their Facebook Posts or their blog posts, everything is getting lost in the mix. When a big news item hits, Twitter is the platform to go to, because people who are directly involved in these big events are the ones that are tweeting.

So what about Spotify. It has been around for a while now and in the last 3 years it set up base in a number of large music markets like Australia, Canada and of course the US.

The people tried it. Some have stuck to it. Some have abandoned it. The ones that speak out against it have never used it.

With the rise of Beats Music, expect the young ones (kids born from 1991 onwards) to go off and explore it. They will give it traction. Then the mainstream will talk about it, trump it up and the young ones will go into something else while the old guard moves in. Like Neil Young who seems to think that people really want large music files taking up large amount of space. Sort of like Facebook. It was the mecca for the youth. Then their parents joined and the youth bailed. No one wants to be friends with their parents on Facebook.

In relation to music, bands on record deals were real slow in adopting Facebook, while the independent bands started using it ASAP. I don’t even have a Facebook account anymore and when I go onto it, it is purely to see what my favourite bands are up to and what people are talking about. In a way it has become like a go to website.

Spotify however needs a game changer. Sort of like how the move to APPS changed the iTunes store. And it’s all about the FREE. Fans of music showed the world that they want FREE music to listen to. And don’t say that FREE doesn’t work. How the hell did Free To Air TV exist and grow over the last 60 years.

Beats Music needs people to vouch for it, promote it. And when people finally get around to using it, it needs to deliver. However, for the kids, YouTube does the job. And that’s the world we live in. One that has all the information that we require at our fingertips and its FREE. Notice the emphasis on FREE again. The public spoke out big time when Napster crashed the party. Our friends testified about it and then we testified about it to others. No one even raised the question of copyright infringement because it was so damn cool.

So what is cool today?

I am all over the shop when it comes to music. I still purchase CD’s from the bands I like. This is more or less done from Amazon and I get the AutoRip feature with it, so then I download the mp3 version of the album to place on my iPhone. I stream music on Spotify. I refer to YouTube. My kids are YouTube fanatics.

And the funny thing is that I don’t use iTunes anymore. Who would have thought that day would have come. And that is what Spotify needs to think about it. Now that the newness has rubbed off, what’s next. Consolidation. How can you consolidate when the modern paradigm is DISRUPTION?

The Labels Want To Be The Good Guys

The labels want to be the good guys. They really do. However their lobby group the RIAA does not carry itself it in public in a manner that is acceptable. They put across an image that all the labels are focused solely on the now and what money can be made now. They put across an image that all the labels have no interest in planning for the future. Then the labels follow suit, flying the bullshit flag from the RIAA.

Regardless of the labels motives and business sense, they will survive.

Read the financial reports on Universal Music Group. Spotify has propped up their bottom line and that bottom line will get better each year. And with money, comes power and relationships. So how do the major metal and rock labels rate in relation to influence and relationships.

Century Media Records and Nuclear Blast are still independent labels. While Century Records lost their cash cow “In This Moment” to Atlantic, Nuclear Blast gained a new cash cow in “Machine Head”. Looking at the rosters, Nuclear Blast has surrounded themselves with a stronger group of artists however Century Media are the ones out there trying to identify new talent. Both labels will be around for a long time.

Frontiers have become a major player in the classic rock, melodic rock and hard rock scene. Frontiers kept the flag of melodic rock flying high since 1996, when all of the other major labels put their monies into grunge first and then industrial rock/metal and then nu-metal. Now that they have traction, I am just confused as to what their business model is.

Let’s sign up all the classic popular artists from the Eighties and get them to re-record some of their classics along with new music. CHECK.
Let’s get artists from different bands together to do a super group project. CHECK.
Let’s get female singers to re-record melodic rock songs that the label president likes. CHECK.

What about identifying new talent and breaking that new talent to the masses with creative and innovative ideas? NOT CHECKED.

Metal Blade is still independent however with strong ties to Sony Music and Warner Music Group in relation to distribution while Roadrunner used to be owned by Universal between the years, 2000 and 2006 and after that, they are under the control of Warner Music Group.

Roadrunner is still the major player here, however with ties to Warner, expect them to be “RIGHT NOW” profit driven and be all about the HYPE. With all the corporate deals they organised on the new Dream Theater album, they would have made up the advanced money plus the recording costs and more.

Spinefarm Records is part of Universal Music Group, with a lot of power to operate independently. They are getting out there and signing new talent. However, like all of the above labels, they are stuck in the old way. And that is the ALBUM.

They just need to realise that it is not about the sales anymore. While Steaming numbers and revenue are still small today, in the long term the labels will be able to reap the benefits.

Why?

Because streaming is a regular recurring revenue business.

For example, I have been streaming “Strife” from Trivium non-stop. Each stream is regularly producing revenue for that song. If I purchased that same song as a download, the revenue produced would be at the time it was sold. Every time that I would have listened to “Strife” at home or on my iPod or on my smartphone would not have produced a cent. All that the band or label would have made from me is the sale of the downloaded song. However with streaming they will continue to make money long after the album is released.

So if anyone believes that streaming is bad for music and that it is going to kill the incentive to create new music, tell them they are uneducated. If bands or artists are complaining about their payments, then they need to negotiate better deals with their labels or get back their Copyrights.

Let’s put it this way, if Metallica is on Spotify, then the rates paid back to the COPYRIGHT HOLDERS (and Metallica do own their Copyright) must be good, because Lars Ulrich and Cliff Burnstein would not allow Metallica to enter a business arrangement that is not in their favour.

The real truth is that there is much more music out there than there has ever been, so the issues that are present to artist and labels is how do they get people’s attention directed towards that new music.

Personally, I don’t even know anybody who pirates music anymore. There is no reason to pirate and legitimate customers/fans would always turn to legal alternatives.

In relation to sales figures and charts. Goneski. No longer relevant. Sales (as a stand-alone measure) no longer means anything. Focusing on recording sales is old school thinking. It’s all about everything else today.

“Recording Sales Revenue” plus “Streaming Revenue” plus “YouTube Ad Revenue” plus “Ticket Revenue” plus “Merchandise Revenue” plus “Corporate Deals Revenue” plus “Sponsorship Revenue” plus “Publishing Revenue” plus “Licensing Revenue” and then decide if you are winning or not.

Again, if you are not seeing a lot of revenue, then you need to be speaking to your label, because if you have numbers in all of the above Revenue streams then something is a-miss contractually.

Another thing that the metal and hard rock labels need to understand is that they reside in a niche. The heyday of when that niche was mainstream is long gone. Today, certain artists might have a crossover song that many people will latch onto and then it is back to the niche.

“Adrenaline Mob” released “Men of Honor” last week and by the end of the second week it will be forgotten. The songs are great, the musicianship is great, so what is the problem. The hard core fans picked it up and everyone else doesn’t know about it. It’s a twenty four seven job staying in the public eye and it’s god damn hard. It’s the labels job to figure out it out, however the labels don’t want to spend the money to innovate, so what they do is get most of the hate directed towards them because of their monopolistic extortion like practices from back in the day.

If the labels want to be the good guys, they need to be more transparent. They need to call out the RIAA when they spin shit. They need to do be realists and sensible. And the main thing they need to understand is that the days of when they had control of the distribution channel are long gone. The profit margins from the CD sales are never coming back. So don’t dwell on the past and start to move forward.
