Where Should An Artist Be?

Megadeth’s “Dystopia” has 1,529,342 streams on Spotify. On YouTube, the audio clip has 1 million views and the video clip has 722K.

“Symphony Of Destruction” has 14,728,297 streams on Spotify. On YouTube there are a few fan created uploads that have around 4 million views, proving, once again, that fan uploads are good for the artist. They get paid from these videos as well. And the cumulative number on YouTube is close to the streams on Spotify, but it’s fragmented and quality varies.

“Hate By Design” from Killswitch Engage has 1,375,919 streams on Spotify. On YouTube 1,386,177 views.

Meanwhile, “My Curse” uploaded back in November 2006 has 14,730,324 views on YouTube and on Spotify it has 21,940,706 streams. Remember that Spotify launched in the US in July 2011 and it was first launched in September 2008. So on a service that has been operating for a shorter period and even shorter in the main US music market, it has racked up more streams.

This is telling me that once the promotion marketing run of a new song for Killswitch is over, the fans of the band gravitate to Spotify to consume their catalogue.

Now let’s go to Dream Theater’s “The Gift Of Music”. It’s got 938,792 streams on Spotify. On YouTube, the Official Video clip has 595,906 views and the Official Audio clip has 1,249,834 views.

However, an older song like “Pull Me Under” has 5,543,276 streams on Spotify and on YouTube, the official video has 4,193,933 views, the “Live At Luna Park” has 2,449,343 views and a fan upload has 1,591,017 views.

Dream Theater is a band with a small but highly profitable hard-core fan base that purchase the music of the band in CD, Vinyl or MP3 format. So the streaming stats of Dream Theater would always be lower than others because of that ownership perspective.

Bullet For My Valentine new single, “You Want A Battle” has 8,698,284 streams on Spotify and an older song like “Your Betrayel” has 21,322,709 streams on Spotify.

Meanwhile on YouTube, “You Want A Battle” has 4,166,841 views on the VEVO video clip and 1,009,159 views on the VEVO audio clip. “Your Betrayal” on the other hand has 30,619,555 views on the VEVO video clip.

Trivium’s new single “Until The World Goes Cold” has 5,249,262 streams on Spotify and the title track of the album has 3,055,965 streams. Meanwhile on YouTube, “Until The World Goes Cold” has 4,311,064 views on the VEVO video clip and “Silence In The Snow: has 3,533,303 views on the VEVO video clip.

Five Finger Death Punch’s new single “Wash It All Away” has 8,796,100 streams on Spotify. The lead off single from the new album “Jekyll and Hyde” has 19,147,912 streams and an older song like “Far From Home” has 24,575,975 streams.

Meanwhile on YouTube, “Wash It All Away” has 10,711,212 views on the VEVO video, “Jekyll and Hyde” has 17,718,384 views on the VEVO video and “Far From Home” doesn’t even rate a mention apart from some fan uploaded clips.

It just goes to show the artist and their label how the fans can take a song and make it as big as a single. All by listening.

One track that is killing it on YouTube is the clip to “The Wrong Side Of Heaven” which has 66,552,910 views.

Shinedown’s “Cut The Cord” has 9,251,338 streams on Spotify and their big hit “Second Chance” has 32,160,803 streams. Meanwhile on YouTube, “Second Chance” has 12,967,621 views on the video clip and “Cut The Cord” has 13,346,588 views.

So…

For an artist, you have no idea how your fans like to listen to music. You might want them to purchase a CD, but the truth is, each fan is different and you need to cater for it. The beauty of Spotify and YouTube is that songs that are not singles become as big as singles based on the listening patterns of the fans. Artists should take note of what the fans like.

And metal and rock fans are still loyal enough to purchase music when they like it but the days of purchasing blindly are over. I’ve streamed the new Killswitch Engage album to death. Eventually I will purchase it to add to my collection. but there is a higher chance that I would purchase a concert ticket first before I purchase the album. That’s just the way it is.

Cinderella – It’s Been A Long Cold Winter Without Your Music

In my weekly Spotify Discover list, it had “Gypsy Road” from Cinderella. I own all the two 80’s albums on LP and “Heartbreak Station” on CD, however I can’t say I have really listened to them over the last 20 years. So let’s call the Spotify Discovery selection a Re-Discovery.

I went straight to the “Long Cold Winter” album. The bluesy feel and the rawness was excellent for 1988, plus it was a good chance to hear Cozy Powell play drums again. For the ones that don’t know, Fred Coury was still very young and green, plus he was a new addition to the band. For “Night Songs”, Cinderella had a session drummer and Coury came in for the tour. Coury’s time would come on the next record “Heartbreak Station”. In addition, producer Andy Johns was notorious for being tough on drummers.

“Bad Seamstress Blue/Falling Apart” sets the blues groove from the outset.

“Look at the winner who hit the ground,
It comes around and then it goes back down”

How good is that lyric!! It’s like the saying goes, what goes up must come down. But hey, life is all about highs and lows.

“Gypsy Road” is up next and it’s probably the closest the band get to the sounds of their debut “Night Songs”.

Life of a rock n roll touring band. The whole “Long Cold Winter” album was written on the road in, while touring on “Night Songs”.

“Don’t Know What You Got Till Its Gone” is a great power ballad and Keifers voice was so unique and gravelly, it made a cliched song sound original. It’s funny, I thought when Hinder came out, the vocalist was Tom Keifer. And of course his vocal style would lead to surgery.

Another brilliant lyric from Keifer.

“The Last Mile” is upmarket AC/DC. Keifer sounds like a polished up Brian Johnson.

The catchphrase used by David Coverdale in “Here I Go Again”.

“Long Cold Winter” is ahead of its time. A few years later Gary Moore went to number 1 with “Still Got The Blues” which wasn’t a far departure from the feel of  “Long Cold Winter”. Jeff LeBar goes to town on the solo section. Underrated guitar hero in my mind.

“Coming Home” is classic seventies.

2015 – Part IV: My Horns To The Sky

NUMBER 13:
Halestorm – Into The Wild Life
Adele might get all the press, but Lzzy Hale is the one that will outlast them all. This is a pretty solid album and each week it’s still selling units and it’s being streamed. Spotify tells me that 3 million unique listeners streamed 330 years worth of Halestorm music. As an artist, that is all you can ask for.

The truth is; we do have time for the doubters, haters and fakers. Initially, their spite; upsets us. In time, we harden up and are able to shrug it off.

It’s a brilliant play on words.

I dig the reference to Lemmy instead of Motorhead. His legend is bigger than that of his band.

Europe – War Of Kings
Europe had massive success back in the 80’s. You could tell that while they had fun, they just weren’t comfortable being in a pop world. You could hear in their music that they wanted to explore more territory creatively. And they did just that with their reunion in 2004. Five albums later they are making more money now than what they did in the Eighties. They have their own company, own their music and license it to people who want to work with the band. They plan their tours and merchandise. They work really hard on social media.

Spotify tells me that 6 million listeners played 240 years worth of Europe music in 2015.

I’m a big fan of Europe’s return to mysticism in the lyrics and personal reflection. They have re-invented themselves. And for lovers of the seventies Euro Rock influences, then “War Of Kings” is the album. Dave Cobb who produced “Rival Sons” is on hand to produce.

“Hit” songs on this album are “Days Of Rock N Roll” (how good is that riff), “War Of Kings”, “Children Of The Mind” (what a groove), “Angels (With Broken Hearts) and “Rainbow Bridge” (for the exoticism groove).

I remember reading interviews with Europe during the writing and recording of “Prisoners Of Paradise” and how the record company asked them for “hits”. Eventually the album comes out; in a marketplace that was changing and morphing into an anti-rock movement. You can just imagine the record heads then telling Europe, “your career is over, your style of music is finished and there is a new style replacing the old style”. Sort of like “Ten Thousand Fists” from Disturbed.

A decision was forthcoming for one of my kids, that as a parent I had to make for him. The road he will be on next year is a decision that was made solely by me, as a parent. Based on the information at hand right now, it feels like the right decision. Years into the future, hindsight might prove otherwise. And that is life in a nutshell. Born into this world, the main decisions are made by our parents. They set a course for our lives and hopefully it is not too far detached from the life we want to live when we get older.

NUMBER 15:
Periphery – Alpha / Omega
I saw Periphery at a small pub in Sydney called the Annandale Hotel. Impressive was the fact that six of them fitted onto that tiny stage that my three piece band once upon a time couldn’t fit on. It was a sold out show and Periphery didn’t disappoint.

I must say that I am a fan of their songs when they have more clean tone and melodic vocals instead of the screaming/growling vocals. In saying that some of their songs like “Ragnarok” have a mixture of both and a song like that needs that style.

I have seen some websites call them the modern face of metal. Periphery is a band that is technical. Nowadays, the odds are stacked against most bands that deviate from the basic verse-chorus formula. In my view, bands like Periphery and TesseracT always need to innovate with each release. Their style is such that they can borrow/be influenced from any musical style, culture/genre and fans expect that innovation.

And they are a band that is from the people, being formed via forums, blogs and other social media websites. Fans of the band ended up in the band. And they are realistic in their goals. They know they will not be as big as Metallica. So they play to their core and their core sustains them.

Spotify tells me that Periphery have 694,000 listeners, who have streamed 130 years worth of Periphery music in 2015. But if you look at their sales record, it is anemic compared to their streams.

Which brings me to the double album; Alpha and Omega. A concept story, albeit a pretty scary one if you read the lyrics. Check it out.

Victory Records Saga

It’s been almost three weeks since Spotify pulled Victory Records catalogue of songs in a dispute over $23,000 in royalty payments to Another Victory, the Publishing Arm of Victory Records.

The Victory Records founder has stated in an email that somehow “found its way to the press” that if Victory’s catalogue of songs is not placed back on Spotify soon, with their histories and stream counts as they were, he would be forced to lay off staff and drop artists.

You see, it’s no longer about sales, but streams.

Did you see how Metallica, once anti-digital are on iTunes and Spotify? Did you see how Pink Floyd and Led Zeppelin also caved? It’s just a matter of time before the Beatles are there as well as the imitators of Beatles music are raking in due to holdout.

All the action is in streaming and that is where the artists need to be. The music business has undergone a revolution where a “hit song” is something people listen to forever and ever, not something which they buy once.

Forget about how the media trumpets Adele’s “25” as a music industry (it should be recording industry instead of music industry) saviour.

Adele’s figures of 1.1 million first week sales for her new single are impressive and news worthy. There is a limited supply of Adele music and she has a universal “mainstream” appeal (by the way all of the Eighties Hard Rock bands had this mainstream appeal with the backing of a cultural juggernaut in MTV). This in turn makes demand for her music very high.

As appealing as the first week numbers are, they are just numbers. A lot of the times the real hits are “slow burners”.

To use books as an example, Dan Brown’s “Angels and Demons” his second book, sold only 98 copies in its first week. It wasn’t until his fourth book “The DaVinci Code” which sold hundreds of millions that “Angels and Demons” got a second wind to the tune of about 40 million copies.

Five Finger Death Punch’s debut album only moved a couple of hundred copies when it came out. Within a few years it was certified “Gold” and it is still selling, almost 8 years later.

Def Leppard’s “Hysteria” was out for 12 months before it got a second wind on the backs of “Love Bites” and “Pour Some Sugar On Me”.

However, the tides of change set forth by the customer show that streaming is the way forward. Labels like Victory Records collect between 25 and 50 percent of their digital income from streaming services.

This whole saga highlights so many wrongs with the music business;

  • Lack of transparency
  • Bad data collection
  • The length of copyright terms means that heirs of the artists (kids, grandkids, step kids, business partners, lawyers, accountants, etc.) are “songwriters” of the song and they should be paid.
  • Who actually should be paid?
  • Missing money (about 25%) to songwriters due to all of the above not being met.
  • Artists selling away their copyrights to the labels for an instant pay-day (advance) and then the record label keeps all monies earned as “recoup costs” (charged expenses like recording costs, marketing budgets, advances) that the artist needs to pay back.
  • Who is the rights holder? The artist or the record label and/or publisher? Because it is the rights holder who is receiving the 70%. If a writer or artist isn’t seeing the money, the answer to their question can probably be found within their label or publisher contract.

But when artists are in control of their own copyrights with a lot fewer people in between, guess what happens. They actually make money if their music is listened too.

One song can earn a decent amount to the songwriter if there are fewer hands in the cookie jar. In the link, the take away line is that 10,929,203 streams on Spotify has resulted in royalty payments of $56,329.35 to the rights holder, which in this case is the artist and songwriter. If one song has been streamed that many times, by default, other songs from the artist will be streamed and the article talks about another song earning $37,000 from 11 million streams.

The consumers have made their choice that streaming has a future.

It’s time for artists to wake up and be smart about their choices when it comes to signing away their most valuable asset, their “COPYRIGHT”.

Royalties

What happens to the pool of money when more people start to adopt a streaming service?

You see, when more people are listening (either to ad-supported free or subscription services), more money is generated. The higher the amount of money generated, the better the payouts.

What did the music industry have before streaming?

They had the iTunes store and the record labels were still hoping that people would go back to buying CD’s. Otherwise, there was a lot of copyright infringement which led to $0 in income.

So in comes streaming via YouTube at the lowest entry point.

Free for the customer.

The aim of the service is easy. Get millions upon millions of people to use it.

Streaming is a disruptive technology. YouTube demonstrated this and in its early beginnings it didn’t care about copyrights at first. Remember back in 2007 when Viacom sued YouTube for $1 billion, because they claimed that YouTube was nothing more than a piracy site. Sort of like how the VCR was nothing but a piracy tool by the MPAA, or the MP3 player. Yet, all of these services, once they had a chance to grow proved to be a profitable tool for the entertainment industries.

So from YouTube, other streaming services enter the market. They all pay the record labels a license to have music on their service. Freemium was enabled to compete and kill off piracy.

Every stream (regardless if it’s on the free platform or the subscription platform) generates a royalty payment back to the labels. The more people who stream, the bigger the dollars going back to the record labels, copyright collection agencies and the publishers.

If freemium goes away, it doesn’t mean that people will start to pay again. Sort of like how people stopped to pay $18 for CD after Napster and in the process, killed off Tower Records and other brick and mortar shops.

The recording business side of music has already hit rock bottom.

Now the only way is up.

Recorded music revenues are increasing due to the monies coming in from streaming services.

Our move to an on demand culture means that streaming has won.

There will always be the 10% who will never pay for anything. But 90% would. Sometimes they will pay more, sometimes less, sometimes none.

And the artists complaining of getting screwed need to re-negotiate with their labels, who are using the artist catalogue as leverage to;

  • obtain high license fees from the streaming service
  • obtain a share/stake of the streaming service, so when it goes public the labels cash in
  • be paid the 70% royalties from the streaming service

So it’s no surprise that a Publishing company owned by a record label is up in arms over royalty payments that haven’t come to them.

Especially when the record label and publishing company in question, Victory Records are well-known for not paying artists their royalties. I am sure there are accounting issues with the royalty payment system and there are many reasons for that.

Did you know that a lot of money just goes missing in the music industry?

A report from Berklee College of Music estimates that 20 to 50 % of royalty payments get lost in transition and do not make it to the ones who created the songs. The same report puts a $45 billion value to the music industry. When you do the math, you realise that is a pretty big sum that just goes missing.

As the Fusion article states;
“Companies that stream music—like Spotify, Pandora or Apple—pay artists in exchange for playing their songs. Somewhere between the company cutting a check to cover the music and the artist— be they a performer, a songwriter, a sound engineer, or a producer— depositing money into a checking account, dollars are disappearing.”

It’s a well-known fact that the record labels are very creative when it comes to their accounting, and until the industry increases its transparency, there will always be misuse of royalties.

Which leads to stories like this?

In case you don’t want to click on the link, it is the story of James Blunt, who claimed via Twitter that he gets paid £00.0004499368 per stream (converted to dollars he’s getting $0.0006968992 per stream). If it relates to Spotify streams only, then the final payment that Blunt is finally getting is pretty low and is further evidence of the record label and collection agencies skimming a lot from the initial payment.

And where does all of this leave the music fan, cranky as hell as they hear over and over again how they need to pay for music, when in fact we overpay for concert tickets and merchandise. A successful act today is making more dollars than they’ve ever made, however it is less from recordings. And we are looking for ease of use first and foremost. That’s how Spotify killed P2P to begin with, through convenience. And convenience is going to generate a lot of money for the recording industry. Let’s hope they put that money back to the people who deserve it, the creators.

Recording Industry Dumb and Dumber – The Sequel

So the Recording Industry in Australia is welcoming new anti-piracy legislation. High fives all around for site blocking laws. Add to those Recording Industry high fives, Movie industry high fives and any other legacy content owner.

The question I have is this;

  • With site blocking now becoming law, what does the Recording Industry believe would happen to their businesses profits?
  • Would people suddenly return to buying CD’s?
  • Would people suddenly buy an expensive Foxtel subscription to watch ten episodes of “Game of Thrones”?
  • Would people who normally don’t go to the movies, suddenly start going to the movies?
  • Would people suddenly go out and buy books, or e-books?

Site blocking laws are designed to stop people from accessing websites that film, TV and music companies say are hosting their content without permission. Surely, our government officials would have looked at the U.K before deciding if site-blocking was the right way forward.

In the UK, The Pirate Bay has been blocked since 2012 however people have found ways to get around that block. Even though site blocking laws exist in the U.K, sales of music are still declining. However, if the industry puts more emphasis into their streaming business, then some different results could appear. Lucky for the U.K, they have a lot of popular artists right now and these artists are really pushing the streaming side of their music.

So in return the U.K have more people streaming more music than ever before. By 2019, streaming is expected to account for 49 per cent of music revenue in the U.K, compared to 22 per cent in 2014.

Digital music downloading (both legal and illegal) is a thing of the past. It’s history. Why would we want to pay for an mp3, when the history of music is at our fingertips with streaming and we, the fans, like it.

It’s easy and uncomplicated.

So since streaming is king, can someone tell me why we need the Entertainment Industries going to the courts to block websites based on their own evidence?

I think the catch-cry put out by the government is “the laws will protect the viability and success of creative industries while restricting the profitability of sites that facilitate piracy.”

Yep, Mr Government, as long as you and your financiers know what that means, it’s okay, we believe the shit you say.

I would be interested to see the model they used to show how the laws would protect the creative industries especially since Australia is a huge market for DVD and Blu-ray sales.

How can the entertainment industries explain the HUGE profits they get from DVD/Blu-ray sales in Australia?

Let’s use Game Of Thrones.

The TV show is hidden behind an expensive Pay-tv paywall in Australia. The actual subscriber numbers for that Pay-tv provider are lower than the sale numbers of the DVD/Blu-ray season releases.

Where did all of these extra fans come from?

The content owners need to be talking about lowering their licensing fees so that the monthly streaming plans are cheaper and that all content is available in the one place.

I have a Netflix subscription and a Spotify subscription.

The content industries should be pushing more people to these services. In return, the money pie will get bigger. It’s simply economics. These industries cannot pretend anymore that the old business models are coming back.

Let’s use Game of Thrones for another example.

If HBO wants to stamp out piracy, ensure that the show is available to everyone globally from the one HBO source.

Not from a reseller.

HBO makes, it, so they should sell it, to the people who want to watch it, when they want to watch it. I cannot for the life of me understand why people need to pay another company who paid HBO a fee to re-broadcast it. It’s a business model that is doomed.

Why do you think Netflix started to make their own TV shows?

Hell, why do you think HBO started their own TV shows? Remember, HBO was once a Home Box Office re-broadcaster.

Because re-broadcasting is not a viable business models. Same deal for music streaming services.

Expect Spotify to start to sign bands and really shake up the streaming world.

Metal Loyalty

Why is it a surprise to people that heavy metal or hard rock fans are the most loyal fans?

There is a pretty good chance that every metal fan has purchased the same album, from acts they like, more than three times.

I am talking from my own experience here. I have the Crue’s Eighties albums on Cassette, LP and on CD.

In the Nineties, these albums got remastered and had some bonus tracks added to them. So I purchased them again. The same albums then got repackaged into Box Sets and guess what I did? I purchased them again.

All up, I purchased each Eighties Motley Crue album five times. Just typing it all out makes me sound silly. Now apply the same counts to Metallica, Iron Maiden, Twisted Sister, Van Halen, Ozzy Osbourne, Megadeth, Bon Jovi, Europe, Cinderella, Kiss, Whitesnake, Def Leppared, Guns N Roses, Skid Row and so on.

Others call it dumb, others call it silly, however I call it loyalty. And guess what? There are millions more people out there the same as me.

Talking about the Eighties, let’s look at the year 1987. The biggest hit singles for that year according to Wikipedia are “La Bamba” from Los Lobos, “Never Gonna Give You Up” from Rick Astley, “I Wanna Dance With Somebody” from Whitney Houston, “It’s A Sin” from Pet Shop Boys and “Who’s That Girl” from Madonna.

However during the year, Guns N Roses unleashed their record-breaking “Appetite For Destruction” album and Def Leppard also unleashed their own record-breaking album in “Hysteria”. Both albums are known as slow-burners, meaning that they took their time to hit it big. Something today’s know it all musicians fail to understand.

For Guns N Roses, it wasn’t until “Sweet Child O’Mine” came out as a single in August 1988 that the album really started to sell. And that was 14 months after it was released. Using the RIAA certification system as a metric for success, by August 1988, Appetite For Destruction was certified three times multi-platinum. Not bad, hey. Then “Sweet Child O’Mine” came out as a single in the same month. By December 1988, (four months later) the album was six times multi-platinum.

You see what happens when one song connects.

Continuing on, by July 1989, almost 12 months since “Sweet Child O’Mine” was released as a single and two years since the album came out, the album was certified eight times multi-platinum. Five million units were sold after “Sweet Child O’ Mine”.

For Def Leppard, it wasn’t until the “Love Bites” single came out in 1988 that the “Hysteria” album started to sell by the truckloads.

Also in 1987, Bon Jovi was still riding high from 1986’s “Slippery When Wet” album. Meanwhile, Motley Crue came out with “Girls, Girls, Girls” and U2 released “The Joshua Tree”. All three bands proved massive drawcards on the live circuit.

White Lion came out with “Pride” and surprised everyone with “Wait”. Suddenly Vito Bratta was in everyone’s lounge rooms courtesy of MTV. And because of MTV, White Lion also became a multi-platinum act.

Ozzy Osbourne paid a “Tribute” to Randy Rhoads while Kiss jumped on the Bon Jovi band wagon with “Crazy Nights”. Blues rockers Great White took the charts by storm with their “Once Bitten” album.

1987 also saw Whitesnake released their mega selling self – titled album, Heart released “Bad Animals” and the single “Alone” and Gary Moore released “Wild Frontier”.

Aerosmith also released “Permanent Vacation” signalling that their comeback was complete, while Pink Floyd did the same with “A Momentary Lapse Of Reason”.

Marillion released “Clutching at Straws”, Y&T released “Contagious” and Rush released “Hold Your Fire”.

Savatage started to make a dent in the metal world with “Hall of the Mountain King” and Alice Cooper’s comeback was picking up steam with “Raise Your Fist and Yell”.

I own all of the above albums, more than once.

Metal and Rock music is a lifestyle. Metal and rock bands appealed to my belief systems. It is that lifestyle and belief system that inspires loyalty. Cultural movements have happened on the backs of metal music.

The term heavy metal in the Eighties was used a lot. A record store lumped bands with very different styles into one Metal category. I could walk into a heavy metal section of a record shop and find Bon Jovi, Metallica, Twisted Sister, Slayer, Iron Maiden, Motley Crue, Poison, Van Halen and even Boston.

Judging by how big metal became, I guess I was not the only one that had the same belief systems. One thing that metal and rock bands did better than every other genre is the branding. Once we connected with the artists, we wanted to become to a member of the gang. We wanted to be patched in and sworn in. It was a tribe mentality.

You don’t need Spotify to know that metal fans are loyal. Looking at the releases in 1987, artists like Kiss, Ozzy Osbourne, Pink Floyd, Whitesnake, Heart, Rush, Y&T and Aerosmith had been around since the early Seventies. Yep, 17 years later, they still had loyal fans waiting for new music. Almost twenty years later, those same bands still have millions of fans waiting for a tour or new music. Can’t say much for Rick Astley.

Other artists like Def Leppard, Gary Moore, U2, Marillion, Great White and Motley Crue had been around since the late Seventies or early Eighties.

The reason why the loyalty of metal heads becomes part of the conversation is that us metal heads/rock heads are stereotyped as antisocial who contribute nothing to society. So how does that explain the numbers that metal and rock bands do on the live circuit, sales circuit, streaming numbers and merchandise sales. That is a lot of money that the anti-social misfits are putting into society.

As the saying goes, pop artists come and go, but metal artists remain forever. Once we are a fan of a band, we are fans for life.

I strongly believe that this metal global audience was achieved because of piracy. Illegal P2P in the early days led to bands like Metallica, Iron Maiden and Motley Crue earning a whole new audience. Suddenly their music was available to people who couldn’t get it. Suddenly these bands who had waning careers, had new markets to hit.

Nicko from Iron Maiden summed it up the best in the Flight 666 documentary. In the documentary, Nicko was mentioning that Iron Maiden hasn’t sold any recorded music in Costa Rica, however they had a sold out show that night.

There is an article over at Mashable that is quoting from Vince Edwards, the head of publicity for Metal Blade Records.

Edwards says that to book live shows, bands need to be able to demonstrate sales, which means using Nielsen’s SoundScan. Spotify streams don’t factor into SoundScan, so any streams that take away from sales also take away from touring. Touring, he says, is “mission critical” for bands. Streams, he says, just aren’t yet incorporated into the system. “It’s such a new metric that people aren’t really sure how to measure that yet,” Edwards said.

Spotify does have some data that can be used to inform bands where it might be best to tour, but Edwards says that doesn’t help metal artists much, since they tend to play smaller venues.

“I think that’s kind of the big disconnect between our world and the mainstream world,” he said.

Seriously, you would think in this day and age that the label bosses would have figured out how to incorporate streaming or even piracy data into their analysis. Online piracy has been around since 1999 and Spotify streaming has been around since 2008. To rely on SoundScan data in 2015 is ridiculous.

Lucky for these clueless label heads that the metal fans are loyal and generate dollars for them.

The Age Old Problem Of Music

The recorded music industry has finally stabilised and it is competing with free. Whatever arguments are put forward for recorded music to go behind paywalls, the world we live in demands that music be free. Piracy of music is no more.

Why would people bother?

My kids are happy with free and putting up with a few commercials. I am happy with it as well, and on the occasions that some of my favourite artists release an album that has a super deluxe edition, I purchase it.

All of this low price points does lead to a mathematical outcome. Profits are tighter, which in turn means  large recording budgets go down. Who cares, right? With pro-studio equipment so cheap, 95% of musicians are DIY’ers’

But, are profits really tighter for the record labels. The whole Spotify/Sony contract highlights just how much money Sony is getting from being the holders of so many copyrights. Sony’s negotiating power is strong because of the artists that create musical works.

Unions have negotiating power because they have the workers behind them. Sony has negotiating power because they have accumulated the copyrights from artists that signed contracts with terms stacked against them. The unions fight for workers’ rights and better wages. Sony fights for a higher fee to their music catalogue and then fails to pass on the monies to its artists, both old and new.

The power of the labels has been accumulated by paying low dollars for a song. Take “Louie, Louie”. The song was written on toilet paper in 1955, recorded in 1957 as a B side and it did nothing. In 1959, Berry sold the rights to the song for $750. In 1963, the song became a hit. By 1987, Berry was living on welfare at his mother’s house. However, Berry did have some luck in a lawyer friend who managed to get his rights back just in time for the song to be licensed to an alcoholic drink commercial. Berry in this instance is part of the rare 1% that do have some luck. For the other 99%, no dice.

You know what the funny thing is, someone like Frank Zappa back in the early Eighties had the foresight to offer a proposal to the record labels to replace the LP model. Zappa proposed that the labels should store their recorded music vaults in a central location and offer the music via phone or cable TV straight to the user stereos via a subscription model. In Zappa’s words “providing material in such quantity at a reduced cost could actually diminish the desire to duplicate and store it, since it will be available any time day or night.”

The reason why Zappa was thinking outside the square back in 1982 was that the recording business was already in a state of bother, that the Internet and Napster brought to the forefront, 20 years later.

Change is constant. News used to be slow, we had three TV channels, music, books and films had gated/window releases, fewer people travelled and fewer people finished school. Not anymore.

You see, change for one side of the debate is always better and for the other side not so much. For the music consumer, the shift to access models over ownership models with lower price points is for the better. But it is far from perfect for the record labels and other gatekeepers. Even old school artists don’t like these changes. People have argued that it has led to unemployment or that creators have no incentive to create new music.

The age-old problem of music was always access. How do people hear it?

MTV broke down a lot of those access problems and made musicians into global superstars. MTV, P2P downloading and streaming are new approaches to age-old problems. While the record labels ignored the volcanic ash of Napster, the techies escaped the volcano blast and thrived.

The error of the record labels was in believing that what was familiar would not change. They got used to the high profit margins of the CD, so they found it hard to believe that in the space of a few years, those profits could disappear. Those marketing strategies and gated releases that have proven themselves over so many years, no longer bring in the sales the labels wanted. Instead it leads to an increase in P2P downloading.

Streaming has competed with P2P. Spotify has pumped millions upon millions into the recording industry. Money that was not there before. So what do the record labels, along with Apple and other misguided artists supporting Pono or Tidal want to do. Their solution to the age-old problem of access is to put it behind a pay wall.

Nice one. Let’s see how well that goes down.

Certifications, Recorded Music and That Spotify/Sony Contract

I always have a decent laugh when I read music news. It’s always interesting to see how a news item gets copied across from website to website in my Google Alerts with no changes and no critical analysis.

Remember back in the day when all the rage was about how artists are struggling to achieve platinum certifications. All the commentary focused on the moment or within a 12 month period. It was like a platinum certification was the be all and end all.

Now, back in the Eighties, MTV made every act that got rotation into a platinum act. But that was not always the case.

“Ride The Lightning” was released in 1984 and it is my favourite Metallica album. It took five years to achieve a platinum certification. 28 years later, “Ride The Lightning” was certified 6x Platinum. Music simmers away and it just keeps on connecting. It’s not about corporate deals, or mega marketing campaigns. Metallica’s “Ride The Lightning” album is proof. It competed with piracy and it still sold.

Anyway, the RIAA recently re-classed a “sale unit” to be a paid download or 100 audio/visual streams. Based on this new re-classification, did you know that Shinedown’s “Second Chance” was just certified triple platinum?

Not bad for a song that is 7 years old.

So what does this say about recorded music?

If a song connects with an audience, expect it to sell and be streamed. The facts are out there. It doesn’t happen overnight or in a year. In happens over decades.

“Second Chance” on YouTube has 9,766,633 views on the official Atlantic Records channel. Another YouTube user called “McDrinkable” has a lyric video up of the song and it has 2,749,110 views, while another unofficial YouTube user called “Dushan Galappaththi” also has their own lyric video and they have 957,103 views.

“Second Chance” on Spotify has 21,845,406 streams.

So what do we know?

We know that music is not about the instant payola. Great music that connects with an audience will be listened too and purchased for a long time.

The beauty of Shinedown is that a song that wasn’t a single has more streams than the hit radio songs. That song is “Call Me”.

But the record labels still push an agenda that piracy is killing their business, while they make millions upon millions in licence fees from the streaming music services.

If you don’t believe me, read this article on “The Verge”. The advances paid to the record labels do not filter back to the artists at all. But hang on a sec, the record labels have this power to negotiate with the techies because of the artists. And the artists get nothing in return. That, my friends is the recording business.

Which leads me to the dumb journalists and artists that rallied behind artists who spoke out against streaming services. Let me say it again, the streaming services are not the enemy here. The record labels still are.

Looks like Roger Waters never got the memo. Even APRA’s Brett Cottle doesn’t get it. He wants the government to fight against pirates, however it is the labels that are holding back royalties.

Times are a changing people, but the record labels refuse to change.
